SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning and under the Suffolk County Administrative Code Sections A14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 30,777 square foot parcel with two front yards in the. R-40 Zoning District. The westerly property line measures 160.71 feet,juts out 20 feet more west then measures 125.00 feet west (total 285.71feet) adjacent to Hickory Avenue, the northerly property line measures 120.00 feet and is adjacent to Pine Avenue,the easterly property line measures a total of 283.64 feet, and the southerly property line measures 98.29 feet. The parcel is improved with a one-story dwelling with an existing wood deck in the rear of the dwelling, to be demolished and reconstructed in place and in kind, and existing enclosed porch in the front of the dwelling(proposed to be converted to living space) and a framed shed(14 x 10.2) in the rear yard as shown on the survey map prepared by Kenneth M. Woychuk, LS, last revised and dated July 25, 2020. BASIS OF APPLICATION: Request for Variances from Article XXIII, Sections 280-124 and the Building Inspector's June 9, 2020 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling; at 1) located less than the code required front yard setback of 40 feet; 2) located less than the code required single side yard setback of 15 feet; located at 70 Pine Avenue, Southold, NY. SCTM#1000-77-3-12.1. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single-family dwelling. The proposed construction is not permitted pursuant to Article XXIII, Section 280-124, which states that on lots measuring between 20,000 and 39,999 square feet in total size, the minimum front yard setback is 40 feet and the minimum single side yard setback is 15 feet. The proposed construction notes a front yard setback of 34.08 feet (Pine Avenue) and a side yard setback of 9.9 feet. The submitted survey plan by Kenneth M Woychuck,LS and the Site Plan drawings submitted by Todd O'Connell,Architect shows the proposed alterations and additions to the existing dwelling. The old wooden deck in the rear yard is proposed to be Page 2,December 22,2020 #7442, Cebada-Mora SCTM No 1000-77-3-12.1 demolished and be reconstructed in place and in kind with a new deck and a proposed 8x8 foot spa. The existing front porch is proposed to be converted to living space with a new covered porch attached to the new enclosed room with the old existing stairs to be removed. ADDITIONAL INFORMATION: The applicants wish to enhance the aesthetic look of the home and improve it within the existing non-conforming setbacks. They are not requesting anything more than what already exists. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 3,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are other dwellings in this community that also have non-conforming front and side yard setbacks. The homes in the neighborhood vary in size and many have been renovated. This proposal will not be out of place in the neighborhood and the proposed changes will give the existing property a new look upgrading the area. The deck to be reconstructed in the rear yard is not visible from the street and the side property line shared with the adjacent neighbor is totally screened from view by mature evergreens. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed additions will maintain the existing non- conforming setbacks. 3. Town Law V67-WAW). The variances granted herein are mathematically substantial, representing 14.8% relief from the code for the front yard setback, and 34% relief from the code for the side yard setback. However, the proposed variances will enhance the dwelling and upgrade the neighborhood. The demolition and replacement of the attached deck in the rear yard and the enclosing of the existing front porch to convert it to habitable living space will aesthetically improve the home. Additionally, the applicant is burdened with two front yards since it is a corner lot. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit expanded living space both indoor and outdoor while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Weisman (Chairperson), and duly carried,to Page 3,December 22,2020 #7442, Cebada-Mora SCTM No. 1000-77-3-12.1 GRANT the variances as applied for and shown on the Site Plan and Building Plans (Sheets D.1 thru DA) prepared by Todd O'Connell,Architect and last revised September 25.2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Proposed 117 sq. ft. front porch shall remain unenclosed and non-habitable space. 2. Proposed 410.57 sq. ft. deck shall remain open to the sky Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted.
