SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 8, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD: This application was referred for review and comments to the Town of Southold Planning Board who issued its response dated December 3, 2020, indicating that they have no objection to the proposed use. The Planning Board is currently in the middle of its Site Plan review process and reserves the right to make any necessary changes after reviewing all proposals thoroughly. PROPERTY FACTS/DESCRIPTION• The subject property is an 84,400 sq. ft. parcel located in an AC Zoning District. The property starts approximately 1,876 feet north of NYS Route 25, and had a 400.00 feet frontage along a shared dirt road, then turns east for 211.00 feet, then turns south for a rear yard of 400 ft, before returning west for 211.00 feet. The property is improved with a two-story framed house, two 1 story storage buildings, a one- story metal building used for helicopter storage, and a wood barn to be removed as shown on survey prepared by John T.Metzger, L.S., last revised August 3, 2020. BASIS OF APPLICATION: Request for a Variance from Article 111, Section 280-14 and the Building Inspector's September 24, 2020 Notice of Disapproval based on an application for a permit to demolish an existing barn and construct a new barn building; at 1) located less than the code required minimum front yard setback of 60 feet; located at: 830 Sterling Lane, Cutchogue,NY. SCTM No. 1000-96-3-2.1. RELIEF REQUESTED: The applicant requests a variance to demolish an existing wood barn and construct a new barn with a proposed front yard setback of 21.6 feet where a minimum 60 feet setback is required. Page 2,December 22,2020 #7441, 1750 Sterling Lane,LLC SCTM No. 1000-96-3-2.1 ADDITIONAL INFORMATION: During testimony by the owner of the property at the public hearing, it was stated that the new barn was to be-used for storage for farm machinery. When asked why it is set so close to the property line, it was stated that there was existing septic & drywells between the existing wood barn, and the existing metal building used for helicopter storage that the owner did not want to disturb. The proposed setback from the road is so that trucks can safely turn around and allow for a drive through section of the proposed barn. As this is a prefabricated building, the owner must work within established parameters from the barn company and doesn't have much latitude in changing the design. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 3,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is in an agricultural district surrounded by other agriculture operations with various buildings and outbuildings. This project is an update to the existing barn on the site to make it more useable for the existing agriculture operation currently on the site. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to existing buildings, existing septic systems and drainage, the proposed barn would have to be placed where proposed, thereby needing an area variance for setbacks. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 64%relief from the code. However, with the exception of a small portion of the proposed barn, most of it will be sited at the setback line of the existing building. Due to many circumstances on the property, existing buildings, septic and drainage pools, truck turn-arounds, etc., this is the only feasible location for the proposed barn which is needed for the owner's current agricultural operation. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new metal barn while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried,to Page 3,December 22,2020 #7441, 1750 Sterling Lane,LLC SCTM No. 1000-96-3-2.1 GRANT the variance as applied for, and shown on the survey prepared by John T. Metzger, L.S., and last revised August 3, 2020. SUBJECT TO THE FOLLOWING CONDITION: 1. Obtain Site plan approval by the Southold Town Planning Board. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The proposed agricultural storage building is located on a 1.9 acre parcel (SCTM#96.-3- 2.1) with development rights intact and would be in addition to existing accessory storage buildings and a single family dwelling, adjacent to a 16.8 acre farm with development rights held by the Town of Southold. A Site Plan application for the agricultural storage building is currently being reviewed by the Planning Board for the removal of an existing storage barn and the proposed construction of the subject 4,584 sq. ft. storage building in generally the same location. Please be advised that the Planning Board is currently in the middle of its Site Plan review process for this application and reserves the right to make any necessary changes to the Site Plan after reviewing all proposals thoroughly.
