THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO.2020-826 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
DECEMBER 15, 2020:
RESOLVED that the Town Board of the Town of Southold authorizes and directs the Town
Supervisor Scott A. Russell to execute an intermunicipal agreement between the Town of
Southold and the Town of Brookhaven for a term of three(3) years, regarding disposal of the
Town of Southold's municipal construction and demolition debris solid waste at a rate of sixty
dollars ($60.00)per ton, subject to approval from the Town Attorney, funded from budget line
SR 8160.4.400.810.

and demolition debris from the Town of Southold for a 3-year agreement. G/L Account:
A8160.32130 (Landfill Fees). 2021 Revenue Budget=$57,500.00.

BY THE BROOKHAVEN TOWN BOARD MEETING: DECEMBER 17, 2020
AUTHORIZING THE
SUPERVISORIDEPUTY SUPERVISOR
TO ENTER INTO AN INTER-
MUNICIPAL AGREEMENT TO ACCEPT
UNPROCESSED C&D FROM THE
TOWN OF SOUTHOLD
WHEREAS, the Town of Brookhaven operates a Landfill facility located at 350
Horseblock Road, Yaphank, NY capable of accepting construction and demolition
debris; and
WHEREAS, the Town of Southold collects annually approximately 4,000 tons of
construction and demolition debris; and
WHEREAS, the Town of Brookhaven wishes to accept and the Town of Southold
wishes to deliver to the Brookhaven Landfill construction and demolition debris at
$60.00 per ton commencing January 1, 2021, paid to the Town of Brookhaven; and
WHEREAS, the Town Board finds that intermunicipal cooperation in providing for
cost effective and environmentally sound waste management strategies can be of great
benefit to the people of Brookhaven and to the people of Suffolk County as a whole; and
WHEREAS, this Town Board finds that it is in the best interests of the people of
the Town of Brookhaven to cooperate with the Town of Southold to accept construction
and demolition debris; and
WHEREAS, the term of the Inter-Municipal Agreement shall be for a period of
three (3) years commencing April 8, 2020 nunc pro tunc, with the possibility to extend
upon mutual consent.
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of
Brookhaven, that the Supervisor/Deputy Supervisor is authorized to execute an
Intermunicipal Agreement and all necessary documentation to effectuate this Resolution
between the Town of Brookhaven and the Town of Southold to accept construction and
demolition debris, for a period of three (3) years commencing April 8, 2020 nunc pro
tunc, with the possibility to extend upon mutual consent; and be it further
RESOLVED, that the form of the contract shall be subject to the review and
approval of the Town Attorney's Office, and be it further
RESOLVED, that the Town Clerk shall send a certified copy of this Resolution to
the Town of Southold, and be it further
RESOLVED, the Commissioner of Finance is hereby authorized, empowered
and directed to take all actions necessary and appropriate to effectuate the terms of this
resolution; and be it further
RESOLVED, that this Resolution shall take effect immediately.
