WITNESSETH,that the party of the first part,in consideration of Ten Dollars and No Cents
($10.00)and other valuable consideration paid by the party of the second part,does hereby grant and
release unto the party of the second part,the heirs or successors and assigns of the party of the second part
forever;
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon
erected,situate,lying and being at Nassau Point,Town of Southold,County of Suffolk and State of New
York,bounded and described as follows:
BEGINNING at a monument of the Easterly line of Bayberry Road,which point comprises the
Southwest corner of land of Carl D.Hillmer and Hermine F.Hillmer;
RUNNING THENCE the following two courses and distances along said land of Hillmer;
(1) North 86 degrees 00 minutes East 115.00 feet to a monument and
(2) (2) South 15 degrees 00 minutes East 287.00 feet to a monument on the Northerly side of
Bridge Lane;
RUNNING THENCE Westerly along the Northerly line of Bridge Lane as the same winds and
turns on a tie line course and distance of South 67 degrees 03 minutes West 140.92 feet to a
monument in said Northerly line;
RUNNING THENCE Northerly along the Easterly line of Bayberry Road as the same winds and
turns on a tie course and distance of North 10 degrees 21 minutes 20 seconds West,329.52 feet to
the monument at the point of place of BEGINNING.
BEINGAND INTENDED TO BE the same premises conveyed to Anthony S.Pagoto and
Patricia J.Pagoto by deed dated April 11, 1980 and recorded in the Suffolk County Clerk's Office
on April 21, 1980 in Liber 8809 at Page 118.

TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 1.3 of the Lien Law,covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as.a trust fund to be applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total.of the same for any other purpose.
