Butler, P.E. last dated November 9, 2005, inspected the property on Wed., April 11, 2007 and determined the proposed building envelope on Lot 4, which is 113' from the flagged wetlands, to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Furthermore, it was determined that the corner of Lot 4 is +/- 68' from the edge of the wetlands. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Box 1179 MAR 1 5 2007 Southold, New York 11971 Re: Conklin Point Estates Dear Ms. Doherty; Pursuant to our conversation last week regarding the wetlands proximity to the proposed building lot#4 on the attached map, I have had the surveyor go out and reestablish the wetlands line on the map. Just as we had suspected, the wetlands are indeed closer to lot 4 than had previously been mapped. The new distance from the rear corner of the lot is 68 feet, 3inches, while the proposed building envelope (based on standard lot setbacks) is 113 feet, 4 inches. As we discussed, it would be prudent to meet at the site to further verify these setbacks. I have had the surveyor stake the rear of the building envelope and verify all other stakes as we had discussed. The applicant would like to join us and discuss the possibility of restricting the building envelope on this lot as part of the subdivision approval so that all future proposals are out of the trustees jurisdiction. The flags are in the correct places for the delineation of the wetland boundary, except for the area closest to the corner stake for Parcel#4. We measured that stake to be 58' from the wetlands. The survey shows the stake to be 80' from the wetlands. #53-4-44.3 is 50%wetlands and is next to a wetland/drainage area. It would not be possible to get the required setbacks for this lot. There are also wetlands across the road that would be impacted by development of this lot.
