Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on July 18, 2018, and in
consideration of application fee in the sum of$250.00 paid by Nicholas & Georgia Notias and subject to the
Terms and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits

469sq.ft. porch, 1,002sq.ft. patio, and 17sq.ft. patio; construct a 4,919sq.ft. two-story dwelling;
construct a 295sq.ft. seaward side porch; construct a 900sq.ft. pool on seaward side of dwelling;
construct a 2,234sq.ft. covered terrace and open terrace between dwelling and pool; abandon
existing sanitary system and install a new septic system; and install a system of gutters to
leaders to drywells, and in accordance to Chapter 236 of the Town Code—Stormwater
Management;with the condition to establish and perpetually maintain a 10'wide non-turf
buffer landward of the Zone "X" line,and that the area seaward of the Zone "X" line be

Monday, December 21, 2020:
RESOLVED, that the Southold Town Board of Trustees APPROVE the One.(1)-year Extension
to Wetland Permit#9281, as issued on July 18, 2018 and for-an Administrative Amendment to
Wetland Permit#9281 for the removal of 996sq.ft. seaward,patio;-removal of 55.6sq.ft. outdoor
kitchen/BBQ area; removal of 3,64.88' x 4'wide pervious walk; and removal of 5'x6'x8' outdoor,
shower along northerly portion of dwelling, as well as the concrete slab on which it sits;,and as
depicted on the-site plan prepared by Suffolk'Environmental Consulting, Inc., dated November
13, 2020, and stamped approved on December 21, 2020.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Members of the Board,
As per the Boards request, our Firm would like to amend the original project
description of the subject properties application to include the following specifications;
1. Removal of the seaward patio thereon (±996.0 s.f.);
2. Removal of the existing outdoor kitchen/BBQ area thereon (±55.6 s.f.);
3. Removal of existing 4' wide pervious walk thereon (±364.88) and;\
4. Removal of existing outdoor shower along northerly portion of the existing
dwelling (±5' wide x 6' deep x 8.0' high) as well as the concrete slab on which it
sits.
Additionally, in accordance with the instructions set forth by your Board, please find a
check made out to the Town of Southold,in the amount of fifty dollars ($50.00) in
satisfaction of the requisite fee.

Dear Mr. Domino,
As you know, on October 16, 2020, 1 requested an extension of the wetland permit referenced above. I
am in receipt of your inspection report in which state "not okay for extension need to amend permit ".
This determination was made based on your observation of a constructed walkway, outdoor shower and
a kitchen barbecue without a permit. Please be advised that under the permit sought to be extended,the
property owner proposed to demolish all structures existing on the lot.Accordingly,the walkway outdoor
shower and kitchen lot barbecue is proposed to be demolished.
Please accept this correspondence as amendment to our permit application as it concerns the demolition
of all structures on the property. Also, if possible, please process this amendment along with the request
for permit extension.

This Firm represents the Nicholas and Georgia Notias, owners of the above referenced property in
connection with a Trustee Wetland Permit approved by your Board on July 18, 2018. Request is hereby
made to extend the wetland permit for an additional year. Please take notice that Town Hall was closed
in July due to Covid-19. Please also take and that all proposed structures were located and continue to
be located beyond 100-feet from the wetland boundary (except the path to the beach) and that a 100-
foot non-disturbance buffer and a 10-foot non-turf buffer was established from the wetland boundary by
permit condition that was covenanted.

TERMS AND CONDITIC _.
The Permittee Nicholas& Georgia Notias residing at 450 Paradise Road Southold, New York
as part of the consideration for the issuance of the Pen-nit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, July 18, 2018 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting on behalf of NICHOLAS & GEORGIA NOTIAS

Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June
5, 2018, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be found
Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies of the Local Waterfront Revitalization
Program to the greatest extent possible through the imposition of the following Best
Management Practice requirements: establish and maintain a 10' wide non turf buffer landward
of Zone "X" line and area seaward of Zone "X" line to be established as a non-disturbance
buffer; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
July 1.8 220l-8;--at-which timL—alHnterested-persons-were-given-an-opportunity-to-be-heard;-and,-------
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management Practice
requirement imposed above, the Board of Trustees deems the action to be Consistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-6 of the Southold Town Code,
and,
RESOLVED, that the Board of Trustees APPROVE the application of NICHOLAS & GEORGIA
NOTIAS to demolish existing 1,259sq.ft. two-story dwelling with 526sq.ft. garage, 469sq.ft.
porch, 1,002sq.ft. patio, and 17sq.ft. patio; construct a 4,919sq.ft. two-story dwelling; construct a
295sq.ft. seaward side porch; construct a 900sq.ft. pool on seaward side of dwelling; construct a
2,234sq.ft. covered terrace and open terrace between dwelling and pool; abandon existing
sanitary system and install a new septic system; and install a system of gutters to leaders to
drywells, and in accordance to Chapter 236 of the Town Code—Stormwater Management; with
the condition to establish and perpetually maintain a 10'wide non-turf buffer landward of the
Zone "X" line, and that the area seaward of the Zone "X" line be designated as a non-
disturbance buffer; a planting plan for new trees equivalent to the number of trees removed,
which are to be of a 2 '/" caliper size; and as depicted on the revised site plan prepared by
Suffolk Environmental Consulting, Inc., dated September 18, 2018, and stamped approved on
October 9, 2018; and the planting plan prepared by Suffolk Environmental Consulting, Inc.,
dated August 15, 2018, and stamped approved on October 9, 2018.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

approval, your Board required a survey amendment depicting a 10-foot non-turf buffer, and a variable
non-disturbance buffer adjacent to the non-turf buffer and extending from the FEMA Zone X to the high
water mark accepting the existing access path. You also requested a planting plan landscaping the
driveway with red oaks as a means of offsetting trees which would be cut as a result of the
redevelopment of the site. Attached herewith please find four surveys prepared by Fox Land Surveying
last dated September 18, 2018 which depict the required 10-foot-non-turf buffer and the non-

survey, I will cause the survey,to- be reduced and substituted for the un-stamped survey at

Suffolk Environmental Consulting on behalf of NICHOLAS & GEORGIA NOTIAS requests a
Wetland Permit to demolish existing 1,259sq.ft. two-story dwelling with 526sq.ft. garage, 469sq.ft.
porch, 1,002sq.ft. patio, and 17sq.ft. patio; construct a 4,919sq.ft. two-story dwelling; construct a
295sq.ft. seaward side porch; construct a 900sq.ft. pool on seaward side of dwelling; construct a
2,234sq.ft. covered terrace and open terrace between dwelling and pool; abandon existing sanitary
system and install a new septic system; and install a system of gutters to leaders to drywells, and in
accordance to Chapter 236 of the Town Code —Stormwater Management. Located: 450 Paradise
Point Road, Southold. SCTM# 1000-93-1-3
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the below listed Policy Standard and therefore is
INCONSISTENT with the LWRP
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction
It is unclear why the setback to the structure is measured from the High Water Mark. A beach is
a wetland. Verify the wetland vegetation limits and the line to establish the accurate setbacks.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
In the event the action is approved;
i) It is recommended that a vegetated, non-turf buffer is required landward of the beach
to further Policy 6.
ii) Retain mature trees on the property to the greatest extent practicable.
iii) Consider requiring an innovative/alternative wastewater treatment system (I/AOWTS)
to meet Policy 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
