c.The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f.Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date.If no zoning amendments,or-other regulations affecting the

Upon the application of William D, Gaillard, filed pursuant to 19 NYCRR 1205 on September 16,

2019, and upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT -'
The petition pertains to alterations to an existing one-family dwelling,2 stories in height, approximately
1,424 square feet in area and located at 556 Bell Hill Avenue., Fishers Island, Town of Southold, County of
Suffolk, State of New York.
Relief is requested from:
19 NYCP.R Part 1220, International Residential Code (2015), Section R311.7.10.1, which
provides, in part, as follows: Spiral stairways are permitted, provided that the clear width at and
below the handrail is not less than 26 inches.......
[The petitioner requests relief to allow a spiral stairway with a clear width of only approximately 24'/2 inches
at and below the handrail.]
FINDINGS OF FACT '
1. The petition refers to the conversion of an existing-garage on the first story into habitable space in the
subject building.
2. I-n order to access the second story from the first story, a spiral stairway was constructed. However,
the spiral stairway only has-a clear width of 24 '/2 inches instead of the required 26 inches.
3. The 1 '/-inch deficit in width represents a deviation of approximately 6 percent from the required 26
inches.
4. In that the subject space is in a dwelling unit, used by individuals who are accustomed to their
surroundings, the reduction to the width of the stairway would not have a substantial negative effect

on their health or life safety and would be considered de minimus
5. There is an exterior deck on the second story with a compliant stairway that goes to grade at the first
story which could be used to move any items to the second story that may not fit on the spiral stair.
6. It is proposed that the exterior deck and stair will be maintained with the dwelling.
7. It is proposed that the spiral stairway will meet all other provisions found in Section R311.7.10 of the
2015 Intemational Residential Code.
8. The local code enforcement official has been consulted in this matter and does not object to the
granting of a variance under the provisions of 19 NYCRR 1205.6.
CONCLUSION OF LAW
The proposed variance will not substantially adversely affect the Code's provisions for
health,safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building
Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because
such would be unnecessary in light of alternatives which, without a loss in the level of safety, achieve the
intended purpose of the code.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from, Section R311.7.10.1, to allow
a spiral stairway with a clear width of only 24 '/2 inches at and below the handrail, be and is hereby
PROPOSED TO BE GRANTED with the following conditions:
1. That the exterior deck and stair will be maintained with the dwelling.
2. That the spiral stairway will meet all other provisions found in Section R311 7.10 of the 2015
International Residential Code
This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in a writing received
by the department, the decision shall become FINAL after fifteen days of receipt of the decision by the
parties.
