Upon the application of Scott De Simone, filed pursuant to 19 NYCRR 1205 on March 2, 2011,
and upon taking testimony and hearing argument thereon at a duly noticed hearing before the Southern
Region Board of Review held at the Perry B. Duryea Jr. State Office Building, 250 Veterans Memorial
Highway, Hauppauge, New York, on March 10, 2011 and upon all other papers in this matter, the Board
makes the following determination
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the construction of a pool enclosure for an in-ground swimming
pool that is an accessory use to a one-family dwelling, two stories in height, wood framed construction,
approximately 3,000 square feet in area, located at 41780 Route 25, Peconic, Town of Southold, County of
Suffolk, State of NewYork. The Petitioner is seeking relief from: .
19 NYCRR Part 1220, The Residential Code ofNew York State (2007), Section AG105.2, part 8,which
requires that Access gates shall comply with the requirements of section AG105.2, Items 1 through 7, and
shall be securely locked with a key, combination or other child-proof lock sufficient to prevent access to the
swimming pool through such gate when the swimming pool is riot in use or supervised. Pedestrian access
gates shall open outward away from the pool and shall be self-closing and have a self-latching device. Gates
other than pedestrian access gates shall have a self-latching device. Where the release mechanism of the
self-latching device is located less than 54 inches (1372 mm) from the bottom of the gate, the release
mechanism and openings shall comply with the following:

8.1. The release mechanism shall be located on the pool side of the gate at least 3 inches (76 mm)
below the top of the gate, and
8.2. The gate and barrier shall have no opening greater than 0.5 inch (12.7
mm)within 18 inches (457 mm) of the release mechanism.
[The Petitioner requests relief to permit an access gate, other than pedestrian, to not be self latching ]
FINDINGS OF FACT
1. The Petitioner has had an in-ground swimming pool constructed in the rear yard of an existing single-
family dwelling As per section AG1 05.2 of the Residential Code of New York State, the pool is
required to be provided with a barrier to provide protection against potential drownings and near-
drownings by restricting access to the pool. The section has 10 parts and the Petitioner is seeking
relief from a portion of part 8 of that section.
2. The pool barrier that the Petitioner has constructed incorporates a good portion of the property, the
dwelling unit, an accessory structure and the driveway which has gates.
3. The Petitioner has stated that the pool has been equipped with a automatic pool cover. The
information provided with this application does not stipulate if the cover is in compliance with ASTM
F1346 standards.
4. Part 8 of section AG1 05.2 requires that gates for other than pedestrian access shall be self latching.
The gates for the driveway are not self latching which is a violation of that part of the Code.
5. The Petitioner has proposed to install motorized drive gate operators with battery back up to address
the self latching requirement. The Petitioner has stated that the gates can only be opened by remote
control or by a key pad and are desjgned to close immediately after a vehicle or pedestrian has
passed through. The Petitioner further states that the gates are designed to be rigid and could not be
moved without motor operation even by an adult.
6. The Petitioner has stated that the pool cover and gate operators have added an additional
$15,000.00 to the cost of the pool installation.

CONCLUSIONS OF LAW
The Board finds that, strict compliance with the Uniform Fire Prevention and Building
Code would entail practical difficulty or unnecessary hardship, and will not substantially adversely affect
the Uniform Code's provisions for health, safety and security, and would be unnecessary in light of
alternatives which ensure the achievement of the Code's intended objective, or in light of alternatives
which, without a loss in the level of safety, achieve the Code's intended objective more efficiently,
effectively or economically
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220,
Section AG 105.2, part 8 , be and is hereby GRANTED with the following conditions:
1. The pool cover shall be in compliance with ASTM F-1346
2 The petitioner shall install motorized drive gate operators with battery backup for the driveway
gates.
3. The motorized drive gate operators shall be maintained in accordance with the manufacturer's
instructions.
4. The pool installation and barriers meet all other applicable provisions of the Residential Code.
Furthermore, it should be noted that the decision of this Board is limited to the specific building
and application before it, as contained within the petition, and should not be interpreted to give implied
approval of any general plans or specifications presented in support of this application.
