CA O is F G • �. r g wnhams,Absent - --- -- 1.• TERMS AND CONDITIONS The Permittee Jonathan Rebell &Noah Levine, residing at 4790 Blue Horizon Bluffs, Peconic,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 582 Bohemia, NY 11716 RE: JONATHAN REBELL & NOAH LEVINE 4790 BLUE HORIZON BLUFFS, PECONIC SCTM# 1000-74-1-35.56 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its Regular meeting held on Monday, December 21, 2020, regarding the above matter: WHEREAS, Jeffrey Patanjo, on behalf of JONATHAN REBELL & NOAH LEVINE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated October 20, 2020, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: the revetment will be beneficial by preventing erosion; WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 21, 2020, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS the-structure complies-with the__standards-set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of JONATHAN REBELL & NOAH LEVINE to construct a 110 linear feet of rock revetment at the toe of the existing bluff landward of the mean high water line; in addition, the existing bluff will be re-vegetated with Cape American beach grass plugs at 12" on center for entire disturbed area; and 2x12 ACQ terracing will be installed to retain soil on bluff; and as depicted on the site plan prepared by Jeffrey Patanjo, dated September 10, 2020, and stamped approved on December 21, 2020. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. Located: 4790 Blue Horizon Bluffs, Peconic. SCTM# 1000-74-1-35.56 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. The NYSDEC EAF Mapper Summary Report indicates that the Piping Plover, a protected bird species may occur on or in the vicinity of the parcel (beach). If the project is approved it is recommended that the applicant contact the NYSDEC for guidance. The proposal for the rock revetment would help prevent erosion of the toe of the bluff in this location, however, since the neighboring properties do not have protective structures; during storms, they would erode quicker than the subject parcel. Correspondingly, the construction of a rock revetment along this portion of the coast would set precedent where there are no similar structures (2020 Aerial) and will begin to change the geomorphology of the beach. Beaches erode in front of large areas of hardened shorelines due to loss of sand supply from bluffs and deflection of wave energy. The applicant suggests that the revetment would have a "positive effect on neighboring properties but does not identify what effects. Portions of the LWRP Policy 4 relate to this action and it is recognized that a rock revetment may be the only natural option to control erosion at the toe of the bluff. It is recommended that if approved, the action be limited to the minimum scale necessary and that adequate mitigation is provided and maintained to ensure that there is no adverse impact to adjacent property or to natural coastal processes and natural resources. { F , o Figure 1.
