So to assist them in achiveing this privacy they should be required to plant and maintain 10 to 12 foot tall arborvitaes along the north property line. Another matter, they should be required to trim the tree limbs or branches of their Maple and Locust trees that are or soon will be hanging over the north property line and in a storm could fall and damage my home or fence. Located: 7165 New Suffolk Road, New Suffolk. SCTM# 1000-117-5-31 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP based upon: 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction B. Comply with statutory and regulatory requirements of the State's wetland laws. 3. Comply with the regulatory requirements of the Tidal Wetlands Act for the protection of mapped tidal wetlands including coastal fresh marsh; intertidal marsh; coastal shoals, bars and flats; high marsh or salt meadow; littoral zones; and formerly connected tidal wetlands. The applicant cleared a non-disturbance buffer established by NYSDEC Tidal Wetland Permit 1-4738-04308/00001 and does not meet this policy. Information in the application is deficient. A planting plan with species of vegetation to be planted, fertilization or non-fertilization and irrigation requirements and survivability terms has not been submitted. Soil conditions within the buffer have not been provided. What type of plant species would be best suited? A plan showing the proposed kayak rack has not been submitted and therefore the action cannot be reviewed. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The existing non-disturbance buffer adjacent to the wetlands boundary that was established pursuant to New York State Tidal Wetlands Permit No 1-4738-04308/00001 (which remains valid through April 202 1)will be maintained, allowing for the natural revegetation of a 45 sf area inadvertently cleared for the dock path, which will be relocated outside the buffer. The application also proposes the repair and/or replacement of existing fencing and installation of a removable timber storage rack for kayaks adjacent to the existing dock. The currently proposed scope of work will thus vegetatively restore the currently proposed clearing outside the dock pathway;restore and maintain the existing non-disturbance buffer adjacent to the wetlands boundary;and allow for pedestrian access to the existing dock. As a result, the project will unprove the existing site conditions and will have no adverse impacts on the adjacent tidal wetlands or waters of Schoolhouse Creek. 617.20 'Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification.
