The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. In his memorandum, the LWRP Coordinator recommends that the project be found "inconsistent" because the "structures were constructed without a permit;" "that"unpermitted structures cannot be replaced and are reviewed as as-builts or new construction;" and that "it is unknown when the structures were built." However, as indicated in our wetlands application, the existing bulkhead is in fact a permitted structure pursuant to Board of Trustees "Grandfather Permit" No. 1782, which was issued in 1983 based on a survey prepared by Roderick Van Tuyl, which appears to be dated October 19, 1979. These documents are of course readily available on the Town's"Laserfiche WebLink." Therefore, while I hope that the Trustees will issue a "consistent" determination for all other aspects of the project, such as construction of the proposed landing and steps, I respectfully request that the Board determine the proposed in-place bulkhead replacement to be "exempt" based on the above information, as Town Code Section 268-5 ("Review of Actions") and the corresponding definitions of "action" and "minor action" set forth by §286-3 ("Definitions") dictate that the proposed in-place bulkhead replacement be deemed a minor action not subject to waterfront consistency review. Specifically, exempt minor action "GG" is defined as follows: "Within all Town Creeks, replacement of existing bulkhead on the applicant's property in the same location with a silt contain deployed prior to and during construction."
