SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 23,893 sq. ft. parcel located on the corner of Jennings Road & Hortons Lane and in an R-40 Zoning District. The parcel has a road frontage of 149.55 feet along Hortons Lane along the easterly property line, turns west for 150.00 feet, before turning north for 147.68 feet, then there is a road frontage of 173.59 feet along Jennings Road where it meets with Hortons Lane. The parcel currently has a foundation placed upon it which is the subject of the variance application as shown on survey prepared by Kenneth M. Woychuk, L.S., last revised August 30, 2020. BASIS OF APPLICATION: Request for a Variance from Article 111, Section 280-15 and the Building Inspector's September 18, 2020 Notice of Disapproval based on an application for a permit to construct a single-family dwelling; at 1) less than the code required minimum rear yard setback of 50 feet; located at: 6505 Horton Lane, Southold,NY. SCTM No. 1000-54-7-17. RELIEF REQUESTED: The applicant seeks a variance for a 44. 4-foot rear yard setback for a new single-family residence where the code requires a minimum of 50 feet. ADDITIONAL INFORMATION: The agent for the applicant testified that there is currently a building permit open on this property for the construction of a single-family residence. The permit#44937,was issued on June 30, 2020 for a residence to be built in a conforming location. The agent stated that the plans were amended, creating a non-conforming rear yard setback, and before they could be filed with the Building Department, the foundation was installed. On September 16, 2020, a stop work order was issued for the subject property which is currently still in effect. A letter from a neighboring property owner states opposition to the variance request. SCTM No. 1000-54-7-17 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 5, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The original house plan, and the amended plan, will both fit within the setbacks designated by the zoning code. Setbacks on corner properties in the neighborhood are typically conforming. Allowing this non-conforming setback will set a precedent in the community, thereby changing its character, and will encroach upon the privacy of the adjacent properties. 2. Town Law$267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could conceivably move the proposed residence to a conforming location without hardship because only a foundation exists on the property currently. Therefore, a change to the location of this foundation, or a change in the proposed plan to comply with current zoning laws does not constitute a hardship for the owner. 3. Town Law §267-b(3)(b)(3). The proposed variance relief herein is mathematically substantial, representing an approx. 11.2 % relief from the code. Prior setback variances granted on Hortons Lane and Jennings Road were for renovations and additions to existing homes, and not for new construction. 4. Town Law §267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. There are significant flooding issues on Horton Lane directly across from the subject property that could be exacerbated by a non-conforming setback on the subject property. However, the applicant must comply with Chapter 236 of the Town's Storm Water Management Code when the site is developed. 5. Town Law §267-b(30)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The overall objective of the Zoning Board is to grant the smallest variance possible. 6. Town Law §267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single-family residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
