SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 2, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 13, 2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a code conforming 53,161 square foot waterfront parcel located in an R-40 Zoning District. The parcel has 256.07 feet of bulkhead frontage along Little Peconic Bay and along the easterly property line, measures 255.00 feet along the northerly property line, measures 249.23 feet fronting Smith Road along the westerly property line and measures 178.71 feet along the southerly property line The parcel is improved with a one story frame house, attached porch and deck, and steps and landing down to beach. All is shown on a survey prepared by Robert A. Smith L.L.S., last revised August 17, 2020. BASIS OF APPLICATION: Request for Variances from Article IV, Section 280-18; Article XXIII, Section 280- 116A(1); and the Building Inspector's June 16, 2020 Notice of Disapproval based on an application for a permit to demolish an existing single family dwelling and construct a new single family dwelling; at 1) less than the code required minimum front yard setback of 50 feet; 2) located less than the code required 100 feet from the top of the bluff; located at: 10075 Nassau Point Road, (Adj. to Little Peconic Bay) Cutchogue, NY. SCTM No. 1000-119-1- 13.1. Page 2,November 19,2020 #7436,Byers SCTM No. 1000-119-1-13.1 RELIEF REQUESTED: The applicant requests variances to demolish an existing single family dwelling and construct a new one story single family dwelling having a front yard setback of 35.7 feet and 50 feet setback to the top of the bluff where town code requires a minimum front yard setback of 50 feet and minimum top of the bluff setback of 100 feet. ADDITIONAL INFORMATION: The existing home, proposed to be demolished is currently located only 28.6 feet from the top of the bluff. The applicant's representative-listed various comparable variances granted to neighboring properties which were also included in the application as an addendum: Appeal#7003, December 15, 2015, for 7324 Nassau Point Road,variance granted for the construction of a single family dwelling at 34 feet from the top of the bluff; Appeal No. 7128, March 15, 2018, 9775 Nassau Point Road, variance relief for a swimming pool located 51 feet from the top of the bluff; Appeal No. 7170, June 21, 2018; 9475 Nassau Point Road,variance relief for additions and alterations to a single family dwelling located 45 feet from the top of the bluff. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 5,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)W. Grant of the variances will not produce an undesirable change in the character of the neighborhood ox a detriment to nearby properties. The property is located in an old neighborhood which consists of single-family waterfront homes. The existing home is currently located 28.6 feet from the top of the bluff. The new home is proposed to be located 50 feet from the top of the bluff. Smith Road is a-gravel road that is lightly traveled. The proposed house meets the code conforming 50-foot setback from Nassau Point Road and the proposed non-conforming front yard setback from Smith Road will have little impact on the few others properties that share this small,unpaved access road. 2. Town Law X267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is constrained on its east side which requires a 100-foot setback and on the West side by Smith Road. The 100-foot bluff setback nearly reaches the front lot line on the south side of property. It is impossible to locate a dwelling which conforms to both the 100-foot minimum bluff setback and the 50-foot minimum front yard setback. The proposed location of the house balances between the two setbacks by seeking a significant improvement in the bluff setback without overly encroaching upon the adjacent roadway. 3. Town Law X267-b(3)(b)(3). The variance granted herein for the bluff setback is mathematically substantial, representing 50% relief from the code. The variance granted herein for the front yard setback is mathematically substantial representing 28.6%relief from the code. However,the proposed bluff setback is more conforming than the bluff setback of the existing dwelling to be demolished and the variance for the non-conforming front yard setback allows the applicant to move the home further landward of the existing bluff. 4. Town Law X267-b(3Nb)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Acampora, and duly carried,to GRANT-the variances as applied for, and shown on the Architectural plans by Cevat Ayhan Ozan;Architect, dated March 9,2020,and labeled'Ab.1-08 and A 13.1-09, and the survey prepared by Robert A. In the event that-this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. Evaluation of this property has been conducted. This single-family dwelling is located adjacent to the bluff, facing the Little Peconic Bay, in a residential area. The proposal for this site is to demolish the existing dwelling and to construct a larger structure with renovations to the properties vegetation. This document contains information on what has been observed in relation to potential bluff erosion issues. A site visit was conducted on 10/20/20, in response to your request to review and evaluate a proposal for the parcel located at 10075 Nassau Point Road, Cutchogue,NY. The proposal has been previously disapproved for the following reasons: The proposed construction, on this conforming 1.39 acre parcel in a Residential R-40 District, is not permitted pursuant to Article XXII Section 280-116A(1),which states: "No building or premises shall be used and no building or part thereof shall be erected or altered in the Low-Density R-40 District unless the same conforms to the requirements of the Bulk Schedule and of the Parking Schedule with the same force as if such regulations were set forth herein full." A front yard setback of 50 feet is required. The proposed construction notes a front yard setback of 35.7 feet. Office Hours:Monday through Thursday 7:30 a.m.to 4:00 p.m. Friday 7:30 a.m.through 3:00 p.m. Furthermore the proposed construction is not permitted pursuant to Article XXII Section 280- 116A. (1),which states: "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff. The construction notes a setback of 50 feet from the top of the bluff. Observations and Current Conditions: Upon arrival, it was noted that the topography of this property is mostly sloped west,towards the front of the property. The vegetation on the property has not been well-maintained. Areas of the property, especially around the property boundaries,have a buffer of trees, shrubs, and other plants. Ground cover is moderately poor,with uneven patches of mixed vegetation and many areas with bare soils and sand exposed. No gutters were observed on the dwelling, and there were minor signs of stormwater runoff on the gravel/dirt driveway. This continues onto the face of the bluff where there are a few areas that are moderately vegetated, and then several areas where the soil and sand is exposed. The staircase on the face of the bluff seems stable. There is bare soil and evidence of bluff erosion underneath the staircase. Halfway down the face of the bluff,on the south side of the staircase,a small black pipe was observed. The outlet was underneath the staircase and the pipe can be seen along the bluff face,towards the top of the bluff,where it disappears under groundcover. A few wooden stakes were also observed on the face of the bluff as well. The bulkhead at the toe of the bluff seemed moderately stable and secure. An old wooden fence can be seen on the south end of the property that appears to end at the top of the bluff. I have attached photos below to illustrate the above observational comments. View of wooden stake seen on face of bluff on north side of staircase. r Facing SE;view of old,existing fence on south side of property p Comments: Since most of the property will be undergoing renovations; it is important to follow proper New York State Standards and Specifications for Erosion and Sediment Control prior,during, and after the excavation,demolition,and construction of the proposed dwelling and landscaping. Heavy equipment should not be too close to the top of the bluff and capturing all stormwater runoff and sedimentation is necessary to protect the bluff. If any irrigation pipes/heads are installed on the property,they should not be near or on the top/face of the bluff. Any intentional discharge of water over the bluff is not recommended and can speed up the erosion process for the bluff. Since the dwelling will be replaced by a larger structure,proper drainage structures for stormwater need to be implemented. This includes drainage structures like those indicated on the Proposed Map for Alison M. Byers. Since the vegetation near and on the bluff is already moderately poor,materials such as geotextiles may be installed and a diversity of native bluff plant species should be planted to improve the restoration and protection of the bluff. The removal and trimming of any debris such as dead trees/shrubs is encouraged to further protect the bluff and encourage more plant biodiversity and an increase in establishment. Relief is requested from Section 280-116(A)(1) for location of a reconstructed dwelling 50 feet rather than the required 100 feet from the crest of bluff; and §280-18 (Bulk Schedule) for location of the dwelling 35.7 feet rather than the required 50 feet from the front lot line adjacent to "Smith Road." The requested bluff setback relief will not have an undesirable impact on the character of the neighborhood because the proposed dwelling location and bluff setback will be consistent with those located throughout the developed shoreline community of Nassau Point Road. Specifically, it appears that virtually property on the east side of Nassau Point Road within at least one-half mile of the subject property is improved with dwellings and/or accessory structures located substantially less than 100 feet from the bluff, including the applicant's, whose existing dwelling is located only 28 feet from the bluff. The preexisting nonconforming neighborhood character is the result of 1) the surrounding shoreline community having been developed long prior to the code changes in 2004, which first introduced-a 100' bluff setback under Town Wetlands Code (Chapter 275), and in 2015 and 2017, which extended the 100' bluff setback set forth in Town Zoning Code (Chapter 280) to bay ' bluffs; and 2) zoning variances granted for nonconforming dwelling reconstruction and/or expansion subsequent to those code changes. For example, variance relief was granted in December 2016 at 7324 Nassau Point Road (1000-118-4-1), located approximately one-half mile to the north, for the reconstruction of a new dwelling situated 34 feet from the top of bluff(Case No. 7003); in March 2018, variance relief was granted to 9775 Nassau Point Road (1000-119-1-6.1), located four properties to the north, for the construction of additions, alterations, and a swimming pool located 51 feet from the top of bluff-, and in June 2018, variance relief was granted to 9475 Nassau Point Road (1000-119-1-1), located eight properties to the north, for the construction of additions and alterations located 45 feet from the top of bluff. Thus, with respect to §280-116(A)(1), the proposed dwelling's 50-foot bluff setback would thus be consistent with the character of the surrounding properties and associated variance determination's. Due to the configuration of Smith Road, a southeasterly spur of Nassau Point Road at the most southerly tip of Nassau Point, there are only two properties facing this unpaved roadway, the applicant's and the property located directly opposite the road to the west, known as 10375 Nassau Point Road (1000-119-1-15). Therefore, with respect to the relief required to locate the proposed dwelling less than 50 feet from the front lot line, this opposing property is the only,potentially affected property. And the neighboring property is similarly characterized by a nonconforming front yard setback of roughly 23 feet to a two-story detached garage, which was constructed pursuant to variance relief granted in December 2005 (Case No. 5734). That variance determination characterized the relief as "insubstantial" and recognized that with "continued maintenance of the existing landscaping and screening," the front yard setback relief would not cause an undesirable change to the neighborhood character. 2. The site is presently improved with a 1-story, seasonal dwelling constructed prior to 1957, which is positioned only 28 feet from the top of bluff adjacent to Little Peconic Bay. As it is severely aged, outdated, and highly vulnerable to hurricane strength winds, the benefit sought by the applicant is the replacement of the existing structure with a modern, year-round, hurricane-resistant, solar-powered, net-zero energy efficient, single family dwelling relocated as far landward of the bluff as reasonable and practicable. The property,however, is constrained on its east side by the bay bluff, associated with which since 2015 is a 100-foot setback required by Town Code Section 280-116(A)(1). Because of the limited lot depth between the top of bluff and Smith Road(the 100' bluff setback nearly reaches the front lot line on the south side of the property), it is impossible to locate a dwelling anywhere on the property where it would meet both the required bluff and front yard setbacks. And even establishing a nonconforming but substantially improved bluff setback of 50 feet creates the need for setback relief from the required 50' front lot line setback. Therefore, it is not reasonably possible to construct a new dwelling without necessitating some degree of relief from both the bluff and front yard setback requirements. However, the proposed location and design of the house was specifically intended to create a careful and reasonable balance between the two setbacks by seeking a significant improvement in the bluff setback without overly encroaching upon the adjacent roadway. 3. The requested bluff and front yard setback variances are both mathematically substantial, constituting 50 percent and almost 29 percent relief, respectively. However, the requested relief is not substantial in fact given 1) the preexisting nonconforming nature of the property, which was developed prior to 1957 and not subject to the required bluff setbacks enacted more than 60 years later; 2) the limited lot depth that makes it impossible for a dwelling to meet both the required bluff and front yard setbacks anywhere on the property; 3) the fact that the proposed 50-foot bluff setback represents a 22-foot and nearly 78 percent increase over the existing 28-foot setback; and 4) the fact that the proposed 35.7 front yard setback will not deleteriously impact the only potentially affected property, whose nearest structure is located 25 feet from and thus even closer to the adjacent road. 4. The project has been designed and will be mitigated to effectively minimize or eliminate any potential adverse effects on the physical and environmental conditions of the subject property and surrounding natural resources. While approximately 5,390 sf of existing vegetative cover situated more than 15 feet from the top of bluff will need to be cleared for the proposed construction, approximately 8,195 sf of the property will be replanted with native vegetation. e. A 15' wide, approximately 3,685 sf non-turf buffer will be-established adjacent to the top of bluff, from which existing invasive vegetation will be removed and existing native vegetation will be supplemented with additional native plantings. f. A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction. 5. The difficulty in meeting the code is not self-created. The existing dwelling was constructed prior to 1957, as recognized by Pre-C/O No. 33648; and the property was purchased by the applicant in 2009. While it is reasonable to anticipate that a dwelling of that age in a waterfront location would inevitably need to be substantially renovated, reconstructed, and/or expanded, it could not have been anticipated at the time of purchase that in December 2015, Local Law 9-2015 would modify the language of §280-116(A)(1) to require a 100' setback from the bluff.
