FINDINGS, DELIBERATIONS AND DETERMINATI -9®U old Town Clerk MEETING OF NOVEMBER 19, 2020 ZBA FILE: #7431 NAME OF APPLICANT: Barbara and Bob Martucci PROPERTY LOCATION: 360 Goose Creek Lane(Private Road#31), Southold NY SCTM: 1000-77-3-23 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 18, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 33,467.8 square feet, .72-acre, rectangular corner lot located in the R40 Zoning District measures 240.00 feet along Goose Creek Lane then runs west 139.66 feet along a right of way, then runs south 240.00 feet along the same private right of way, then runs 139.24 feet along a residentially developed lot to the south. The parcel is improved with a two-story single-family residence with covered front porch and driveway, along with an irregular-shaped, rear deck (subject of this application) as shown on the site plan prepared by Anthony M. Portillo, Registered Architect and dated August 17, 2020. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's August 4, 2020 Notice of Disapproval based on an application for a permit to legalize an "as built" addition, and construct new additions and alterations to a single family dwelling; at 1) less than the code required minimum rear yard setback of 50 feet; located at: 360 Goose Creek Lane (Private Rd. #31), Southold, NY. SCTM No. 1000-77-3-23. RELIEF REQUESTED: The applicant requests a variance to legalize and expand an `as built' deck, measuring approximately 45.4 feet by 22 feet when complete, with a rear yard setback of 40.2 feet where the code requires such improvements to maintain a minimum rear yard setback of 50 feet, while adding a covered, unconditioned screen porch measuring 21.54 feet by 17 feet, over part of it. ADDITIONAL INFORMATION: No member of the public or an immediate neighbor spoke in favor of or against this application. The subject property has the following Certificate of Occupancy on file: Z-28457 issued May 22, 2002 for a one family dwelling with covered front porch and attached two car garage. On November 5, 2020 the Page 2,November 19,2020 #7431,Martucci SCTM No. 1000-77-3-23 applicant provided the Board, per request, with two prior Zoning Board of Appeals decisions (#5491 &45223) for similar relief granted in the immediate area supporting this application. At the hearing, the Board discussed with the applicant's agent the potential problems associated with the location of the existing sanitary system under the "as built" deck, over which the Board has no jurisdiction FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 5,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Goose Creek Lane is a private right of way servicing over a dozen residentially developed lots. The subject parcel faces lands owned and maintained by Suffolk County which provides for open space and establishes the feeling of a low density, rural neighborhood. Furthermore, the subject parcel backs up to a third right of way, a paper road, approximately 30 feet in width. The applicant's property is well landscaped and the reduction in required rear-yard setback of approximately 9 feet, to accommodate the `as built' deck and the addition of a screen porch will not be discernable to surrounding properties, area residents or those using Goose Creek Lane. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The `as built' deck has existed for several years and the applicant proposes to maintain the existing rear yard setback of 40.2 feet where 50 feet is required, while expanding on the overall size of the deck `squaring it off and adding a 17 feet by 21.5 feet screen porch. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 20% relief from the code. However, the paper road, located behind the house and parallel to Goose Creek Lane, is approximately 30 feet in width which adds a mutually beneficial buffer between the subject property and the residences to the west, and creates the feeling of a conforming rear yard. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an attached wood deck measuring approximately 22 feet by 45.4 feet and the addition of a screen porch measuring 17 feet by 21.5, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Lehnert, and duly carried, to Page 3,November 19,2020 #7431,Martucci SCTM No. 1000-77-3-23 GRANT the variance as applied for, and as shown on the site plan prepared by Anthony M. Portillo, Registered Architect and dated August 17, 2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The screen porch shall remain unconditioned and without the benefit of`storm' or other windows or eisenglass or similar. 2. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s) within 30 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 3. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within six(6)months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 4. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained 5. At the discretion of the Board of Appeals, failure to comply with the above conditions may render this decision null and void Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. PROPERTY FACTS/DESCRIPTION: The applicant's 18,873.48 sq. ft. parcel is bordered on the east with 120 ft. frontage along a private right-of-way, 139.71 ft, frontage along a private right-of-way along the south side, and 120 ft. frontage along a private right-of-way at the west side. The applicants' property is improved with a two-story residence and two accessory buildings as shown on the November 14, 2003 survey prepared by Stanley J. Isaksen, Jr., L.S. BASIS OF APPLICATION: Building Department's October 17, 2003 Notice of Disapproval, citing Code Sections 100-242A and 100-244 in its denial of a building permit application concerning a proposed addition at less than 35 feet from the rear yard line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 18, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a 14' x 34' carport with deck above the first story, at 23.9' from the north lot line, and a 243 sq. ft. addition behind the existing dwelling at 37.9 feet from the east lot line, at its closest points. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable,change in the character of the neighborhood or a detriment to nearby properties. The house faces the westerly front yard, and the carport addition would appear to be in a side yard (north side)with a minimum 24 ft. setback. 3. The difficulty was self-created when knowledge of the zoning restrictions continued since the time of acquiring the property. 5. The Building Department has determined these boundaries as front lot lines. The applicant's plan is constrained by the fact that this property bounds a right-of-way on three sides, and therefore is considered as having three front yards, each requiring a minimum setback of 35 feet. One of the rights-of-way is unpaved and grassy. 3. The variance granted herein is not substantial because the applicant will maintain two front yards at greater than the required minimum setback of 35 feet. The total lot coverage will also be conforming to the close at less than 20 percent(15 percent) after the completion of the project. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to this board to suggest that this minor variance will have any adverse impact. The scope of the project is very limited, and the rear yard is already nonconforming at 18 feet. 5. The difficulty for the applicant has not been self-created because the zoning code defines the property,with three front yards when three lines border rights-of-way. 6. The relief offered to this applicant is the minimum determined necessary for this applicant to enjoy the benefit of a porch and sunroom, while at the same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of,the surrounding community.
