WITNESSETH, that the party of the first part to whom letters testamentary were issued by the
Surrogate's Court,County,NY,on and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of
FOUR HUNDRED FIFTY-FIVE THOUSAND AND N/100 ($455,000.00) dollars,
paid by the party of the second part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,

BEING AND INTENDED TO BE the same premises described in the deed to William A. Smith
(deceased) and Vera C. Smith (deceased) by deed dated July 27, 1954, recorded in the Suffolk County
Clerk's Office on September 9, 1954, in Liber 3754, Page 359.
TOGETHER WITH a right of way and perpetual easement for the benefit of the property now owned
by the party of the first part and known as 980 Bayview Avenue, Mattituck,NY(SCTM# 1000-106.00-
10.00-017.000) (`r980 Bayview") through and over the easterly three feet of the premises known as 830
Bayview Avenue, Mattituck,NY (SCTM #1000-106.00-10.00-016.001) to and from Bayview Avenue
to and from the garage, if any or any replacement thereof, situate on 980 Bayview. This easement shall
permit unobstructed ingress and egress and is contained in deed dated July 2, 2020 and recorded in the
Suffolk County Clerk's Office on July 29, 2020 at Liber 13065 page 483. Said easement shall run with
the land.
TOGETHER with all right,title and.interest,if any,of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in
said premises, and also the estate therein, which the party of the first part has or has power to convey or
dispose of,whether individually,or by virtue of said will or otherwise;TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the distributees or successors and assigns of
the party of the second part forever.
AND the parry of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.

Southold, County of Suffolk and State of New York, known and designated as lots No. 3
and No. 4, as shown on map entitled, "Map of Property of Mattituck Development
Company, Inc., Mattituck, L.I.", made by Daniel R. Young, Surveyor, Riverhead, New York,
dated December, 1922, and filed in the Suffolk County Clerk's office on May 1", 1923, as
file No. 776, which said lots when taken together are more particularly bounded and
described as follows:
BEGINNING at a point on the corner formed by the intersection of the southerly side of Bay
View Avenue and the westerly side of Cedar Drive;
RUNNING THENCE along the westerly side of Cedar Drive, South 22 degrees 05 minutes
39 seconds West, 139.91 feet to an iron pipe;
