Moore as agent for Love Lane Village LLC, property location is 13650 Main Road Mattituck,N Y, (SCTM#1000-114-11-24.3) for a waiver of the "A Local Law in relation to the six (6) month Extension of a Temporary Moratorium on the issuance of approvals and/or permits for the parcels of property in"The State Route 25 Love Lane Intersection and surrounding area," and the Town Clerk is hereby directed to refer the application to the Planning Board for comment. I have a notarized signed affidavit that this hearing was advertised in the Suffolk Times. I have a letter from the Planning Department, the Planning Board has reviewed this request for a waiver from the moratorium and recommends approving the waiver. And a notarized affidavit that this was noticed on the Town Clerk's bulletin board and that is it. SUPERVISOR RUSSELL: Would anybody like to address the Town Board on this particular public hearing? PATRICIA MOORE: Good evening everybody. I look forward to seeing everyone in person but thank you very much for the opportunity to be heard on this application. As you know, from the paperwork I gave you, this is the Kardwell building which my client Scott Colletti through the LLC purchased the property and is ready to have tenants occupy the building. I have Mr. Colletti out there in zoom land and I also have the prospective tenant Stephanie Stahl, the CEO of(inaudible) out there as well, so if any issues or questions you have for them, I hope that they will be able to join in. Similar to the last hearing you just had, this is an existing building with former tenants, we want to place new tenants in the building. We think the Building Department will be amenable to issuing permits for interior work however, we wish to have solar panels added to the building, exterior work and we potentially need to have a directory sign for the tenants. So for purposes of being able to get the permits now and in the future, we hope that you will allow us to get a variance or waiver to the moratorium so that we can proceed with this tenant and if possible additional tenants in the building. It is an existing building as I said which has been somewhat dormant, empty, while the Kardwell family was closing out their business. If you have any questions I would be happy to answer them. SUPERVISOR RUSSELL: Yes, I have a question. I thought the waiver was specific to a specific building, pending building permit application, it reads here as if it's a waiver in its entirety of the moratorium for I guess the duration of the moratorium, which you know I can't, I don't know what future anticipated uses might be or construction might be and it's difficult, that's not how my understanding of how waivers work, I thought they were specific such as the previous hearing, it was for a specific application. MS. MOORE: We had a specific request for this tenant in the back end of the, the brick building has the back portion, that's the existing space, that's the space we needed alterations on. I also noted that the advertisement had it generically for the property, so if it's possible to occupy with other tenants since it's an existing building, it would have to meet whatever zoning uses had been previously, the CO for the building is for business uses. So I noticed that in the advertisement but certainly my client is more interested in making sure they can proceed with this tenant because that is the most urgent need. Specifically to add the solar panels and the sign so the deliveries can identify where they are going. The problem seemed to be with issuing permits for any exterior work. Interior, my understanding was that, the moratorium would not affect property interior building permits of existing buildings but whatever we need to get here tonight to allow us to proceed, that's what we are interested in. COUNCILMAN DINIZIO: Can I ask a question? MS. MOORE: Sure. COUNCILMAN DINIZIO: Pat, what does your notice of disapproval say? MS. MOORE: Notice of disapproval is to make alterations to an existing business building at 13650 Main Road Mattituck, the proposed construction is not permitted because no permits can be issued while the current moratorium is in effect. So it's very generic. COUNCILMAN DINIZIO: Yes, it is very generic. I think she's okay, Scott, quite honestly. There's an existing building, they can't do anything, certainly they can't even put in a handicap ramp obviously because, you know, the application before requested that, so I think the Building Department has it right. SUPERVISOR RUSSELL: I am just a little confused because certainly the application that was pending seems more than reasonable to me and frankly, necessary for waiver but this is basically a blanket waiver for any future uses. I thought the moratorium only pertained to exterior expansion or improvements, I was unaware of it pertaining to interior changes. I don't know, unless I misunderstood. COUNCILMAN DINIZIO: I don't believe that it is but my understanding is, from what I can get from Ms. Moore is that the building is so large that there could be other tenants and there will probably be, in my opinion building permits that are needed, like moving walls, things like that, fire inspections whatever. So you are not going to be changing the exterior of that building, it already has site plan, it already has parking so, you know.... TOWN ATTORNEY DUFFY: I think we can amend the resolution to specifically address the installation of solar panels. SUPERVISOR RUSSELL: I would say the pending application as applied for. The building permit application, because this essentially would simply be a waiver for everything, interior, which I honestly didn't think the current waiver pertained to but if it does, it does. TOWN ATTORNEY DUFFY: Inaudible. SUPERVISOR RUSSELL: It does not address interior changes. TOWN ATTORNEY DUFFY: Inaudible. COUNCILMAN DINIZIO: It's just the solar panels. SUPERVISOR RUSSELL: But the wording would be a waiver of everything, so that would mean interior, exterior, any anticipated changes in the next several months. TOWN ATTORNEY DUFFY: Right. SUPERVISOR RUSSELL: That's very broad. TOWN ATTORNEY DUFFY: Agreed. SUPERVISOR RUSSELL: I support the waiver for the improvements that need to be made per the pending building application. But I can't anticipate, you know, I think none of us can anticipate what might come down the pipe in the next few months that might require exterior work, substantially. COUNCILWOMAN DOHERTY: Inaudible. SUPERVISOR RUSSELL: Both resolutions should be specific to the applications that were applied for. MS. MOORE: Can we include our sign though? Because you issue building permits for signs, I want to make sure a sign would be permitted. The building department, I think, without some guidance to allow certain things exterior, we might be in the same position when we try to put up a sign for this tenant. SUPERVISOR RUSSELL: You didn't have the building permit pending on that? MS. MOORE: No, because.... SUPERVISOR RUSSELL: I think that's more than a reasonable request. COUNCILWOMAN DOHERTY: That one is for signs and solar and what else? The proposed tenant to the existing building is Stephanie Stahl, the CEO of a startup company called Ace of Air, a beauty and wellness company specializing in zero-waste skincare and nutritional supplements. The Mattituck location will be their headquarters, as well as their cleaning and distribution facility. There are some small projects that need to be done to make the building fully operational. A building permit is required to modify an existing bathroom for handicap access, partitions in the open warehouse area, and preparing the space for the specialized equipment. The owner, Love Lane Village LLC, promised to have Ms. Stahl operating by January 1, 2021. The owner and tenant have been working very diligently to meet this timeline. The Temporary Moratorium will unnecessarily delay the use and occupancy of an existing building. The proposed use is a "permitted use" and an adaptive re- use of an existing building. In August, Kardwell (JKNK, LLC) sold the property to Love Lane Village, LLC. Scott Colletti, managing member. The new owner has a proposed tenant to occupy the existing 1,378 sq.ft. concrete block building, located to the rear of the 2-story brick building. The tenant is Stephanie Stahl, CEO of Ace of Air. She markets and distributes beauty products. Ms. Stahl contracts with the manufacturer of the cosmetic company, markets, and re-uses the retail containers which are used by customers. The cosmetic containers are collected, sterilized, and refilled with new cosmetics. These refilled cosmetic containers are then returned to the manufacturer for distribution. The equipment required for this process is a very specialized segment of the cosmetic industry and will be housed within the existing building. The equipment is cleaned and refilled in a "clean room". The clean and refilled cosmetic container is then packaged, stored, and distributed. This business is unique and will provide well-paying jobs within the community. There is no need for any exterior alterations to the building. A building permit is required to convert an existing bathroom to a handicap bathroom, some warehouse partitions, and the specialized equipment provided by an outside vendor for the "Clean Room". The business is an adaptive re-use of the existing building and a welcome, clean, use to the Town of Southold and the Hamlet of Mattituck. (1)The applicant cannot realize a reasonable return, if lack of return is substantial as demonstrated by competent financial evidence; The lease requires the owner to prepare the interior space for this tenant. The lease is to begin January 1, 2021. (the lease is confidential and can be provided upon request). A clean business of this high quality and unique opportunity to employ locally as well as to occupy a large existing space is extremely difficult to find. If the owner loses this tenant, he will experience significant financial hardship. The tenant's inability to have the modifications to the existing space will also cause economic hardship. Ace of Air's Public Benefit Corporation (Certified B Corp) with a stated public benefit "to promote a positive effect (or to reduce negative effects) on the environment by creating and commercializing products that seed to preserve, protect and restore the environment through the reuse, reduction and recycling of materials, and through operational optimization to reduce water use, energy use, greenhouse gas emissions, chemical use, toxicity and waste activities; furthermore, in order to advance the best interests of those materially affected by corporation's conduct, it is intended that the business interests of those materially affected by the Company create a material positive impact on society and the environment, taken as a whole" This purpose requires use of specialized equipment and adequate space to run the business. Finally, Ace of Air has committed to contribute 3% of revenue to their not- for-profit planet partners. Their launch partners are Ocean Conservancy, 5 i Gyres and Peconic Land Trust. Consequently, the economic hardship extends beyond the tenant. (2)that the alleged hardship relating to the property in question is unique and does not apply to a substantial portion of the district or neighborhood. The property is unique in that it was developed prior to zoning, contains large existing buildings, and has maintained the following former uses: • Lumber Yard: Prior to zoning, in 1957, a Certificate of Occupancy No Z12023 was issued to Reeve Lumber & Woodworking Co. The use was a "lumber and woodworking business" • In 1989 the Town of Southold updated its zoning regulations and maps. The property was re-zoned from C-Light Industrial to HB Hamlet Business. The Lumberyard continued as a pre-existing non- conforming use until 1993. The Lumber company ceased to exist (went out of business), however, the woodworking business was a permitted use in both C-Light Industrial District and the re-zoning of 1989 to HB. The woodworking business continued to operate after the re-zoning. • In 1999 Southampton Lumber Corp. (consisting of 200 shareholders) applied to the Zoning Board of Appeals (Appeal #4668) to re- establish the Lumber Yard use. The pre-existing use had ceased for more than 2 years, the appeal to re-establish the Lumber yard use was denied, an Article 78 was filed, but the ZBA denial was upheld. Thereafter, an Appeal for a "use Variance" was filed in 2000, but the appeal was discontinued when Southampton Lumber went to contract with Kardwell Associates Inc. • The buildings, as seen on the survey today, are the same buildings when Kardwell purchased the property. Interior improvements were made by Kardwell to the existing buildings and landscaping was added along the front and property lines. As the tenants are selected for the property, minor interior alterations may be necessary. The owner's inability to obtain these building permits during the moratorium create unnecessary delay and is unique to the parcels within the moratorium. The commercial property owners within Hamlet of Mattituck are hampered from finding tenants for their existing buildings. It is particularly difficult for both the owners and tenants during the economic pressures of the i pandemic. The moratorium began prior to the pandemic and without the relief from the moratorium the building has remained vacant. Occupancy of this space and other spaces in the existing building will depend on tenants occupying spaces without building permit changes. The alterations, even small ones, are customary as new tenants occupy existing buildings. (3) that the requested variance, if granted, will not alter the essential character of the neighborhood; The Planning Board in 2000 reviewed the site conditions of the property for the Kardwell Businesses. Ward Associates presented the calculations of parking, at 100% occupancy of all the buildings, 49 spaces would be required. Dick Ward confirmed that the existing paved surfaces (formerly the Lumber Yard) would accommodate 49 spaces. The proposed occupancy needs very few parking spaces. Ms. Stahl plans to employ six to eight people. There will be no tractor trailers,just LPS and Fed Ex for deliveries. This is no different than Kardwell use. (3)that the alleged hardship has not been self-created. The buildings are existing and previously occupied by Kardwell until closing. The owner marketed the property and understood that tenants may continue to occupy existing spaces. Ms. Stahl found this property perfect for her start-up business in a new community. The plans were presented to the Building Department for preliminary review, 8 weeks passed and purely by chance, the owner was advised that the moratorium would prevent the issuance of building permit for very minimal alterations. No site plan review is required because the use will not generate any additional traffic, parking, or drainage.
