A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held via Zoom Webinar online platform on Thursday, October 15, 2020 commencing at 3:00 P.M, pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo in-person access by the public will not be permitted, Present were: Leslie Kanes Weisman, Chairperson Nick Planamento, Member Eric Dantes, Member Robert Lehnert, Member Patricia Acampora Kim E. Fuentes, Board Assistant Elizabeth Sakarellos, Office Assistant William Duffy, Town Attorney Heather Lanza, Town Planning Director Mark Terry, Assistant Town Planning Director Carrie O'Farrell, Environmental Consultant,Nelson Pope &Voorhis Osman Barrie,Nelson Pope &Voohis Ken Skipka, RTP Environmental Consultants Call to Order at 3:00 P.M. by Chairperson Weisman. EXECUTIVE SESSION: 3:00 P.M. Motion was offered by Chairperson Weisman, seconded by Member Acampora to enter into Executive Session in order to receive Attorney Advice. Vote of,the Board: Ayes: Page 2—Minutes Special Meeting held October 15,2020 Southold Town Zoning Board of Appeals Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted (51a A. The Board discussed applications currently under SEQRA Review by the Environmental Consultant. 5:12 P.M. Motion was offered by Chairperson Weisman, seconded by Member Lehnert to exit Executive Session. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted 5-0Z WORK SESSION: A. The Board reviewed future agenda items. B. Cono Cimino #7338 - The Board discussed an applicant's request to rescind a condition of approval for determination dated June 25, 2020. C. The Board discussed possible future plans for "in person" meetings in the Town Hall Meeting Room. D. Michael Kreger #7420 — The Board discussed a resolution to reopen the hearing in order to accept correspondence from the Building Department advising the Board of their interpretation of the code that prohibits three stories in a single family dwelling. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: ANTHONY TARTAGLIA AND JAMES HOWELL #7396 —Request for Variances from Article XXIII, Section 280-123; Article XXIII, Section 280-124; and the Building Inspector's January 29, 2020, Amended September 1, 2020 Notice of Disapproval based on an application for a permit to reconstruct an "as built" sunroom to an existing single family dwelling, and to legalize an "as built" deck/patio to an existing accessory garage with apartment ; at 1) "as built" addition and alteration to the nonconforming accessory garage with apartment is not permitted; a nonconforming use shall not be enlarged or structurally altered or moved, unless the use of the building is changed to a conforming use; 2) proposed construction to the single family dwelling is located less than the code required minimum side yard setback of 15 feet; 3) proposed construction is more than the code permitted maximum lot coverage of 20%; located at: 55255 Suffolk County Route 48, (adj. to the Long Island Sound) Greenport, NY. SCTM No. 1000-44-1-9. RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Acampora to Adjourn the hearing to the Regular Meeting of November 5, 2020 . Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0) Page 3—Minutes Special Meeting held October 15,2020 Southold Town Zoning Board of Appeals DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following application. The original determinations of each of the following applications as decided are filed with the Southold Town Cleric: GRANT RELIEF AS APPLIED MICHAEL AND VANESSA REBENTISCH#7430 GRANT RELIEF AS APPLIED WITH CONDITIONS: DEBRA WINSOR#7423 JOHN BELLANDO #7424 JOHN AND MARY ANNE CASSIMITIS #7425 SCOTT AND STACY BOWE#7426 TIMOTHY FROST#7413 Vote of the Board: Ayes: Members Weisman(Chairperson),Acampora, Dantes,Lehnert and Planamento. Resolutions were duly adopted (5-0). RESOLUTIONS: 1. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to authorize advertising of hearings for Regular Meeting to be held on November 5, 2020 which Regular Meeting will commence at 9:00 A.M., Public Hearings to begin at 10:00 A.M., and to be held via Zoom Webinar online platform,pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo in-person access by the public will not be permitted. Vote of the Board: Ayes: Members Weisman (Chairperson) Acampora, Dantes, Lehnert, Planamento. Resolutions were duly adopted (5-0). 2. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Dantes to approve minutes from October 1, 2020, Regular Meeting. Vote of the Board: Ayes: Members Weisman (Chairperson) Acampora, Dantes, Lehnert, Planamento. Resolutions were duly adopted (5-0). 3. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Planamento to reopen the public hearing of Michael Kreger#7420, closed on September 3, 2020, to accept written correspondence from the Building Department. Vote of the Board: Ayes: Members Weisman (Chairperson) Acampora, Dantes, Lehnert, Planamento. Resolutions were duly adopted (5-0). RESOLUTION ADOPTED : Motion was offered by Chairperson Weisman, seconded by Member Lehnert to rescind Condition No. 1 of the Determination for Appeal No. 7338, Cono Cimino dated June 25, 2020 and Amend the Decision. Vote of the Board: Ayes: Members Weisman (Chair—person Acam ora Dantes LehnertPlanamento. Resolutions were duly dopted (5-0). There being no other business properly coming before the Board at this time, Chairperson Weisman declared the meeting adjourned. The meeting was adjourned at 5:55 P.M.
