That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 9. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation(grasses, etc.) immediately following prgject completion or prior to permit expiration,whichever comes first. If the project site remains inactive for more than.48 hours or planting is impractical due to the season,then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. 9 10. Clean Upland Fill and Grain Size Fill must be clean upland sand of equivalent or slightly larger grain size and similar in color as is indigenous to the beach. 11. No Beach Excavation For Fill No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 12. Grade to (Match That Adjacent to Bulkhead All fill must be graded to match the elevation of the land immediately adjacent to the bulkhead. 3 13. Backfilling All peripheral berms,cofferdams,rock revetments, seawalls,gabions, bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures. 14. No Equipment below Apparent High Water Equipment operation below(seaward)apparent high water is strictly prohibited. 15. No Seaward Extension of Bulkhead The new bulkhead shall be constructed in place of the existing bulkhead with no seaward extension of the outermost bulkhead face. Groin Construction The groin shall be constructed as per the two page pian prepared by En- Consultants,page one dated 3/4/2020,page two dated 5/27/20, both plans stamped NYSDEC approved 6/25/20. 3 17. Extent of Groin The authorized groin shall not extend beyond property lines,interfere with i navigation, and/or interfere with other landowners riparian rights. is. No Structures on Groin No permanent structures shall be installed on the authorized groin without first obtaining written department approval(permit,modification, amendment). 19. No Structures on Bulkhead No permanent structures shall be installed on the authorized bulkhead b without first obtaining written department approval(permit,modification, amendment). i 20. Excavation for Bulkhead/Structure Prior to any construction or removal of bulkheads and other shoreline stabilization structures all backfill shall be excavated landward of the stricture and retained so as not to enter the waterway, tidal wetland or protected buffer area. 21. No Runoff Over or Through Bulkhead or into Wetland There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization structure or into any tidal wetland or protected buffer area. 22. Wood Preservatives a. Pressure treated wood used for construction of in-water structures must have undergone-a treatment process approved (stamped or otherwise marked as certified)by the American Wood Preservative Association. b. Wood treated with Pentachloroplienol(PCP)must not be used in marine or brackish waters. Wood treated with PCP must be aged in the open air for at least three months prior to in-water use. c. The use of creosote treated wood is prohibited both in the water and upland areas. d-Chromated Copper Arsenate (GCA)pressure treated wood must be clean and five of CCA.surface deposits. Wood with surface deposits.must be washed for at least 5 minutes under running water prior to use. The washing must occur greater than. 100 feet landward of any regulated wetland and/or water body. (Note "E." below for handling wash water.) e. Any wood debris such as sawdust or wash water must not enter any water body, including wetlands or protected buffer areas. 23. No Structures on Pilings No structures, other than structures specifically authorized by this permit,shall be constructed on pilings without further authorization from the department(permit, modification or amendment). 26. Vegetate All Disturbed Areas The permittee shall revegetate all exposed faces and disturbed areas to prevent soil erosion prior to the project co'znpletion or expiration date of this permit, whichever comes first. 27. Install,Maintain Erosion Controls Necessary erosion control measures,i.e.,straw bales, silt fencing, etc„are to be placed on the downslope edge of any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to be maintained in good and functional condition until thick.vegetative cover is established. 28. Contain Exposed,Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt curtains(or other NYSDEC approved devices)placed on'the-seaward side between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these,approved methods. 29. Maintain Erosion Controls All erosion control devices shall be maintained in good and.functional condition until the project has been completed and the area has been stabilized. ' 30. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation,or for other purposes,and no claim or right to compensation shall accrue from any such damage. 31. Precautions Against Contamination of'Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete,leachate or any other environmentally deleterious materials associated with the project. 32. State May Require Site Restoration If upon the expiration or revocation of this permit,the project hereby authorized has not been completed,the applicant shall, without expense to the State, and to such extent and in such time and manner-as the Department of Environmental Conservation may lawfully require,remove all or any portion of the uncompleted-structure or fill and restore the site to its former condition. WETLANDS ADDENDUM FOR THE JAMES PUTNAM LATHAM QUALIFIED PERSONAL RESIDENCE TRUST 2790 PETERS NECK ROAD ORIENT,NY SCTM#1000-32-1-12.2 STATEMENT OF EFFECT For the purpose of maintaining the property's historical method of protection against erosion and flooding and maintaining the stabilized shoreline, the project proposes the in- place replacement of an existing timber groin and bulkheading that pre-date the Town's jurisdiction over erosion control structures along the Town's bayfront. As the spring high water line reaches the face of the bulkhead, there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location; and without maintenance of the bulkhead, the subject and adjacent properties would be exposed to potenitally severe flood and erosion damage. However, the presently buried portion of bulkhead will remain without replacement at this time in order to minimize disturbance to the adjacent naturally vegetated areas situated both landward and seaward of that section of bulkhead. Together with the surrounding groins to the east and west, the subject groin is part of a larger groin field that has historically served to control shoreline erosion and stability along this developed shoreline through beach retention. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM for THE JAMES PUTNAM LATHAM QUALIFIED PERSONAL RESIDENCE TRUST 2790 PETERS NECK ROAD ORIENT, NY SCTM#1000-32-1-12.2 POLICY 4 For the purpose of maintaining the property's historical method of protection against erosion and flooding and maintaining the stabilized shoreline, the project proposes the in-place replacement of an existing timber groin and bulkheading that pre-date the Town's jurisdiction over erosion control structures along the Town's bayfront. As the spring high water line reaches the face of the bulkhead, there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location; and without maintenance of the bulkhead, the subject and adjacent properties would be exposed to potenitally severe flood and erosion damage. However, the presently buried portion of bulkhead will remain without replacement at this time in order to minimize disturbance to the adjacent naturally vegetated areas situated both landward and seaward of that section of bulkhead. Together with the surrounding groins to the east and west, the subject groin is part of a larger groin field that has historically served to control shoreline erosion and stability along this developed shoreline through beach retention. And consistent with the permit standards for groins set forth in Section 275-11(C)(1) of the Town Code, the replacement groin is proposed with the same location, configuration, and length of the existing functional groin, with a low-profile design such that the seaward end of the groin is elevated no higher than 18 inches above the elevation of mean low water(MLW). The project will thus maintain the historically existing site conditions without causing adverse impacts to, or increased erosion of, the beach on the subject or surrounding properties, consistent with the permit standards set forth by Section 111-9 of the Town Code and with Policy 4 of the LWRP. POLICY 6 The bulkhead will be removed and replaced in the same location; and the presently buried portion of bulkhead will remain without replacement at this time in order to minimize disturbance to the adjacent naturally vegetated areas situated both landward and seaward of that section of bulkhead. Consistent with the permit standards for groins set forth in Section 275-11(C)(1) of the Town Code, the replacement groin is'proposed with the same location, configuration, and length of the existing functional groin, with a low-profile design such that the seaward end of the groin is elevated no higher than 18 inches above the elevation of mean low water (MLW). Both the groin and bulkhead will be constructed with vinyl sheathing in place of existing treated timber sheathing, which provides a potential benefit to the quality of the adjacent surface waters through the reduction of treated timber located in and adjacent to surface waters. The project will thus effectively maintain the historically existing site conditions without causing adverse impacts to, or increased erosion of, the beach on the subject or surrounding properties, with the benefit of reducing treated materials. Therefore, the project will have no adverse impacts on the adjoining shoreline, tidal waters, or unvegetated tidal wetland area. f See attached addendum.
