Box 1179 Southold, NY 11971 Via Electronic Mail Re: Trustee Applications of Sampieri and Gray Dear Mr. Hagan, I write to you regarding the Trustee Applications of Mr. Heath Gray and The Sampieri Trust in a single letter, as the issues regarding each application are identical. I have attached multiple documents dating from 1987. Each of these documents supports the fact that the land underwater associated with Tax ID 1000-118-2-11.4 is privately owned, and Jennifer Burrell and I are the current owners. 1 am sure you are well aware that Town Code 275-6-A-1 requires either ownership, or permission from the owner for work to be done on any Wetlands within the Town of Southold. Neither of these criteria has been met for the above applications. Therefore, if the Trustees were to issue permits they would be in violation of the Town code and my Constitutional Rights. Additionally, the issuance of the permit with the knowledge that the Sampieri's have made a legal claim for ownership of the land underwater in question is problematic. The decision by the NYS Supreme Court is still pending. I would ask that you advise the Trustees to wait for the Court's decision prior to issuing any permits. This would avoid violation of the Town Code, my Constitutional Rights and the Supreme Court's jurisdiction, thus creating potential damage liability for the Town and the individual Town Trustees. Please feel free to contact us if any questions arise. Of important concern to us is the desparate condition of the mouth of Richmond ereek. We are currently working towards Department of Conservation cooperation to resolve this matter. We do recommend that you dredge this as an emergency project under the specifications of the latest permit. Another concern which recently arose was the desire by the Wunneweta Lagoon Association to have the County maintenance dredge the inlet mouth. Our reaction, after a review of the file by the Board and the Town Attorney, is that it is inappropriate to do work on private property using public funds. Please don't hesitate to contact me. Inland recreation facilities Within Reach 8 there are only three inland recreational facilities: the playing fields, playground and two tennis courts of the Cutchogue East Elementary school are located south of SR 25 midpoint between Skunk Lane (Bay Avenue) and Eugene's Road. A standard 18-hole golf course and two/four tennis courts are located at the North Fork Country Club. The Club is located south of SR 25, on either sides of Linden Avenue. The golf course fronts on and offers great views of West and Downs creeks as well as Great Peconic Bay. However, access to the Club's facilities is restricted to a limited membership and their guests. The Cedar's Par-3 Golf Club lies south of the CUtchOgue Village t ireen on Case's Lane and Cedars Road. This nine hole course encompasses about 14 acres and is open to the general public for a fee. 7. New opportunities for public access and recreation provision Like Reach 7, Reach 8 has a highly developed waterfront. Although there are 111any property owners' associations which own waterfront properties reserved for use by their members, the degree of existent development means there is a significant demand for access, but also limited opportunities to increase the number of access points. There is little vacant bay front left in Reach 8, and only slightly more creekfront. Accordingly, the Town should be open to a public/private partnership to acquire the 3.5-acre Harbor Inn Marina/restaurant property at the foot of Main Street in New Suffolk in order to establish a wider range of public recreational uses within New Suffolk. The use of this property could be combined with private investment to effect a revitalization of New Suffolk's waterfront that is in keeping with the scale of this community. 8. Natural resources (i) Wetlands Reach 8 contains a fairly extensive wetland system of approximately 140 acres within the Cutchogue Harbor area, encompassing tidal marshes that fringe Wickham Creek, East Creek, Mud Creek, and Broadwater and Haywater Coves. The various tidal creeks here are classified as mudflats, with narrow channels of littoral zone where the water is deeper. The wetland areas adjacent to these creeks consist primarily of intertidal marsh, with limited areas of high marsh. Smooth cordgrass and saltgrass dominate the vegetation in these marsh areas. Cutchogue Harbor and its adjacent wetlands have been designated as a SCFWH. These coastal wetlands provide critical habitat to several species listed as endangered, threatened and of special concern in New York State. In addition, the wetlands serve as valuable feeding areas for waterfowl and shorebirds, as well as productive nursery areas for finfish and shellfish. Little Creek and Beach has also been designated as a SCFWH. My grandparents owned a house on this lagoon and actually bid for the house which Jennifer Burrell's parents(George and Ionne) were successful in buying. At that time(1965 or so)the bottom of the lagoon was owned 50%by Dr. Hammer, (who sold to Burrell)and 50%by the Betrece Glenn's. My grandparents then remained on the lagoon until their deaths,after which I took care of the house for several years. I have spoken with Robert Sturdy, Sr,George Burrell and Jennifer Burrell about this on several occasions over the last twenty or so years. I think two summers ago while the Trustees were on field inspections with Don D, he received a call to respond to Robert Sturdy, Sr. about this complaint. Don D. determined that the deed which Burrell has was valid. Don has responded to more then a few calls over the years to chase clammers away. Burrell has asserted their ownership with the placement of no trespassing signs on their land, and tells people who clam that they must leave. 1 would recommend that consideration be given to have Don be included in this conversation. Given my personal history with this lagoon, I would very much like to attend this meeting. As such, I would request that it be scheduled for 8 AM one day. Another option,the Trustees have field inspections on July 14 so we might be able to fit a brief meeting into the day. We will all be attending the workplace violence meeting at 8 AM that day.
