Sepenoski Jr. Tom Stevenson Mark VanBourgondien Opening: The Agricultural Advisory Committee meeting was called to order at 7:05 pm on September 23, 2020 in the Southold Town Hall meeting hall. Next Meeting(s): th The next regular AAC meetings will be on Wednesday, October 7, 2020 at 7:00 pm in the Southold Town Hall meeting hall. Minutes and Administration: Acceptance of minutes dated February 26, 2020 approved with a minor correction and the minutes th dated March 11, 2020 are approved. The September 9 minutes approval is postponed to a future meeting. An email needs to go out to the Town Attorney asking for clarification on the current Quorum rules and time limits for public comments. An email needs to go out to Town Clerk to straighten out committee member terms. A request for a copy of a revised sample easement should be sent to Melissa Spiro. A letter needs to be drafted and sent to Town Board opposing PDR deals without revised easement language acceptable to AAC. Review Proposed Acquisition of Development Rights:  No new proposed Acquisitions presented to the committee for review.  John P. Sepenoski suggests that Land Preservation be divided into two separate committees. One for open space and one for farmland preservation.  LPC conducts all development right purchases in their meetings in executive session so the public is not granted access to that information, but the AAC should have access to better understand the purchase rights. Maybe have representative from the AAC in the executive session. Page 1 | 3 Town of Southold Agricultural Advisory Committee Meeting Minutes of September 23, 2020  Agricultural production is being excluded from what is being bought so LPC shouldn’t be the ones reviewing.  Development rights could use a cleaner definition, flip it so it’s defined positively.  If agricultural production includes all sorts of structures then why should LPC have jurisdiction to review agricultural structures  John P Sepenoski- How can an advisory committee grant permits. Only the building department has staff and the guidance documentation to issue permits on agricultural structures. Advisory committees should have the power to issue permits.  The most pushback from the LPC was on permission to review structures Proposed Agricultural Revisions to Town Code:  Committee review of the Draft of Chapter 70, Agricultural Lands Preservation.  Committee notes changes to the code, which will be redrafted by Chris Baiz to include those changes.  Agricultural Production definition should include parking.  Discussion on the definitions of agricultural Structures.  Discussion on easements defining structures and the restrictions on placement of those structures.  Discussion of 70-4. Appraisals and sellers need to be more informed of what the prices are based on.  Review of 70-5 Alienation of development rights. That C. Should become 70-6.  Regarding existing easements, can the language be changed by mutual agreement between the landowner and the Town, to allow changes  Chapter 280 for the was discussed. No definition of development rights in there, but it should be.  Clustering discussed with regard to buildings on a parcel. Review of Agricultural related Site Plan Applications/Sub-Divisions:  No Agricultural related Site Plans or Applications/Sub Divisions were submitted to the Committee. Review Potential Agricultural District changes in Zoning: .  No Agriculture District Zoning changes presented. Local, County, State and Federal Legislation related to Agriculture:  No new Legislation to report. Review Applications for structures related to Agriculture on parcels with Town /County owned development rights. New Business:  The Water Advisory Committee is advertising for Committee members, it would be a good idea to have an Agricultural Advisory Committee member join or go as a liaison.  Vacancy of Steve Mudd is still open and needs to be filled. Southold should have a representative. . Motion to enter into executive session: to discuss possible land purchase at 9:10 by Doug Cooper, seconded by Chris Baiz, All in favor.
