The proposed beach is admittedly so they can have a sandy beach on their property. It is not designed for or intended to protect the wetlands as an effective buffer. We call your attention to the following: -the deposit of 1 foot of sand at the water's edge will change the grade and create a diversion of some of the considerable run-off from the property, and with it sand, onto our client's property, which will then be at a lower elevation than the augmented elevation of the applicant's property. As our client's marsh front is untouched with native vegetation,this will damage it and change its nature. -the deposit of 1 foot of sand, consisting of 65 cubic yards,will provide certain run-off of sand into the creek. The elevation of the property slopes from 28 feet to 3 feet, partially over lawn and driveway, so considerable amounts of water will undoubtedly cause erosion. This is already evident from the gullies in the sandy area just north of the house from which groundcover was removed for construction purposes. Further, the elevated properties on the opposite side of Broadwater's Road, with their hillside lawns and impervious driveways sloping to the road, undoubtedly supplement the run-off impact and volume of water. -the deposit of 1' foot of sand will result in inevitable scouring of the sand into the-creek in the event any appreciable storm surge, also inevitable: -Broadwater's creekfront in the vicinity of this project, and for almost all of fhe Creek area, does not have a"sandy beach", which is entirely out of place in this neighborhood. -while a non-turf buffer can consist of sand, it is generally behind an elevated bulkhead or retaining wall. This is at such a low elevation, and at the bottom of a long drop in elevation, that it is not realistic to assume that the sand 'will not end up in the creek. This is not the proper location for a sand buffer. The rock revetment and underpinnings will not hold it in the event of strong runoff or storm surge. A planted area of appropriate material is what is required to hold the area without interfering with the creek. -this is a prolific shellfishing and wetlands shoreline which will be adversely impacted by sand intrusion, as will the water depth from sand build-up. ' -the original groundcover has been removed and now is planted with grass. This grass, when covered with sand, will grow through the sand.along with every other weed known to our shores. This will require the use of chemicals adverse to the creek and the groundwater to contain. For this 'reason, a properly planted and vegetated buffer area is appropriate. -a-list of the inaccuracies in the Short Form EAF is attached; which we believe resulted in the improper conclusions of the agency comments. This should be corrected. -a list of the inaccuracies in the LWRP is attached, which we believe resulted in the improper conclusion of consistency. This should be noted in your review. -we would like to explore the implications of the sand augmentation and rock wall to our client's adjoining natural buffer, creek bottom and wafer depth, all of which can be adversely affected by the introduction of so much additional sand into the creek. The applicants "Updated Project Description"also contains inaccuracies, including: -50 cubic yards of sand is inconsistent with application of 65 cubic yards -"Additional native vegetation'will be planted" and"all existing shrubs:will remain"overlooks the extensive groundcover and multiple mature trees recently removed without a permit. -Is the Cemex sand from a Mexican company an appropriate material for a wetlands boundary? We urge that you deny this application and seek to have the applicant restore the appropriate ground cover which was removed without a permit.
