BARGAIN AND SALE DEED with Covenant against Grantor's Acts
THIS INDENTURE, made the 14`h day of August, 2020 BETWEEN
CARRIE TINTLE, residing at 1235 Lupton Point Road, Mattituck, NY 11952,
party of the first part and

WITNESSETH, that the party of the first part in consideration of ten dollars and
other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part, forever,
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the
(see attached schedule "A")
Being the same premises described in the deed to the parties of the first part herein
dated August 26, 2010 and recorded September 8, 2010 in Liber 12636 Page 745 in
the office of the County Clerk, County of Suffolk,State of New York.
TOGETHER with all right, title and interest, if any, of the party of the first part
of, in and to any streets and roads abutting the above described premises to the center
lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being Lupton's Point in Mattituck, Town of Southold, County
of Suffolk and State of New York and bounded and described as follows:
BEGINNING at a concrete monument set in the northerly side of the Private Road which said concrete monument marks
the southwest corner of the premises about to be described and the southeast corner of land now or formerly of Bavaria
and which said monument is also 1226.34 feet more or less westerly as measured along the northerly side of a Private
Road from Marratooka Avenue;
THENCE North 01 degree 45 minutes 00 seconds West, along land now or formerly of Bavaria, 111.76 feet to the
approximate high water mark of Deep Hole Creek;
THENCE easterly along the approximate high water mark of Deep Hole Creek the following tie line courses and distances:

or place of BEGINNING.
TOGETHER with all right, title and interest in and to the waters of Deed Hole Creek immediately bounding said premises
on the north.
TOGETHER with a right of way over the 20 foot wide private road, to and from the premises hereby conveyed to
Marratooka Lane and to and from Deep Hole Creek at the end of said 20 foot private road, where it adjoins Deep Hole
Creek on the easterly side of Lupton's Point.
THE POLICY TO BE ISSUED under this commitment will insure the title to such buildings and improvements on the
premises which by law constitute real property.
FOR CONVEYANCING ONLY: Together with all the right, title and interest of the party of the first part, of in and to the
land lying in the street in front of and adjoining said premises.
