SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 1, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated September 17, 2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted as well as the records available it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 27,622 sq. ft. lot located in an R-40 Zoning District, and in a AE-6 FEMA zone. The property has 70.03 feet of road frontage on Corey Creek Lane on its northern boundary, then turns 307.96 feet again along Corey Creel Lane along its eastern boundary. The property runs 140. 47 feet along Corey Creek, before turning north 232.17 feet back toward Corey Creek Lane. The subject property is improved with and existing two-story frame house with attached wood decks, two attached sheds, and three accessory sheds as shown on survey prepared by Peter A. Groben,L.S., dated February 17,2020. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15F; Article XXIII, Section 280- 124 and the Building Inspector's June 18, 2020, Amended August 7, 2020 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling and construct an accessory garage; at 1) dwelling is located less than the code required minimum front yard setback of 40 feet; 2) accessary garage located in other than the code required rear yard; located at: 1580 Corey Creek Lane (Adj. to Corey Creek), Southold,NY. SCTM No. 1000-78-4-19. Page 2,October 15,2020 #7430 Rebentisch SCTM No. 1000-78-4-19 RELIEF REQUESTED: The applicant requests variances to construct an accessory garage in the front yard where accessory structures are only permitted in the rear yard, with the exception of waterfront properties which allow accessory structures in the front yard only if the proposed setback conforms to the code required front yard setback for principal buildings The proposed accessory garage will be set back 30 feet in the front yard where a 40 foot minimum setback is required. The proposed addition to the main house will be set back 15.4 feet where a minimum of 40-feet is required. ADDITIONAL INFORMATION: The applicant's agent gave oral testimony on the subject of the proposed additions to the main house, and the proposed accessory garage. The garage will be located in the front yard due to the fact that this is a waterfront parcel and the wetlands within the property lines limit the buildable area. Furthermore, because of the proximity of the property to the waterfront, the applicant is proposing an Innovative Advanced (IA) Septic System to be installed in the northeast corner of the property facing Corey Creek Lane. The applicant testified at the hearing that the second floor of the proposed accessory garage will be unheated, unfinished storage space. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 1, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is at the dead end of a small road that wraps around the property so there is very little traffic and few other homes are close by. Therefore few, if any other homes in the neighborhood will be visually impacted by the proposed non-conforming front yard setback for the accessory garage. The proposed accessory garage in the front yard is typical of waterfront parcels where accessory buildings are allowed in the front yard. The relief sought from the setback is necessary to distance proposed improvements from the wetlands on this waterfront property. The addition to the main house is in keeping with the character of the neighborhood, as houses in this neighborhood have increased in size throughout the years, and is not out of character or scale/size with those other homes. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Any additions to this property would require an area variance due to the conditions of two front yards, existing non-conforming setbacks and wetlands on the subject creekfront property. location. 3. Town Law 4267-b(3)(b)(3). The variances granted herein for the accessory garage located in the front yard with a non-conforming front yard setback is mathematically substantial, representing 25% relief from the code. However, accessory buildings are allowed in front yards on waterfront parcels as long as the setback is consistent with the setback for principal buildings, and, in this instance, the relief from the code is sought to have the least impact on the creek and wetlands on the subject property. The other variance requested for a front yard setback for the addition to the main house is again mathematically substantial, representing 61.5% relief from the code. However, this is mitigated by the fact that the proposed addition is behind the line of the front yard setback of the existing house, and that any addition to the house would require a variance. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Page 3, October 15,2020 #7430 Rebentisch SCTM No. 1000-78-4-19 applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and an IA wastewater treatment system is proposed to be installed. 5. Town Law U67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum•action necessary and adequate to enable the applicant to enjoy the benefit of a accessory garage, and addition to the residence while preserving and protecting the character of the neighborhood and the health, safety and melfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried,to GRANT the variances as applied for, and shown on the site plan and architectural drawings (Sheets D-1 to-D5) prepared by Anthony M Portillo,Architect, and dated August 20, 2020. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances granted herein as shown on the architectural drawings, site plan and/or survey ,cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms. Several area homes have covered front porches which are typical to this neighborhood and the Town of Southold, overall. While the"as built"porch roof aesthetically enhances the house, it covers a permitted access stoop and also adds visual interest enhancing the community and functions to provide shelter against inclement weather. Furthermore,as a result of several bends in the road it is difficult to distinguish neighborhood front yard setbacks for the subject and area homes. 2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As illustrated on the survey and site plan provided, the existing residence is constructed with a 34.7 feet front yard setback, including a 2-foot-deep cantilevered second floor, and as such, any addition to the front fagade will require relief from the code. 3. Town Law 6267-b(Vb)(3). The variance granted herein is mathematically substantial, representing 12.5% relief from the code. However, given the natural terrain and geography, along with a variety of bends in the road it is difficult for any area resident or passer-by to distinguish the relief sought. 4. Town Law 6267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a"as-built" covered front portico while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
