SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 13, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 6, 2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is recommended that the proposed action to construct additions and alteration to a single-family dwelling resulting in exceeding the minimum allowed lot coverage of 20% is INCONSISTENT with LWRP policy. This action is not supported by the purpose of zoning regulations, does not enhance community character, and therefore Policy 1 of LWRP standards is not met. The action to legalize a shed having less than the required minimum setbacks is EXEMPT from Coastal Consistency Review. The increase of the lot coverage from 22% to 22.4 percent is minimal, less than 2% increase, and can therefore be considered CONSISTENT with LWRP policy because the minor additions totaling 157 sq. ft. will not have any significant impact. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 47,203 square foot waterfront parcel located in an R-40 Zoning District. The parcel has 100.00 feet of bulkhead frontage along Great Peconic Bay, measures 100.00 feet fronting Jackson Street along the northerly property line measures 458.88 feet along the easterly property line, and measures 465.52 feet along the westerly property line. The parcel is improved with a one-story frame residence with a second story wood deck, a two-story frame garage, a tennis Court, an in-ground gunite pool with patio, two existing sheds, a bulkhead, and three existing wood jetties. All is shown on a survey prepared by Jack Allison Hall,LS, dated October 2,2009. Page 2, October 15,2020 #7424, Bellando SCTM No. 117-10-10 BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article IV, Section 280-18; and the Building Inspector's February 11, 2020, Amended March 11, 2020 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling and to legalize an "as built" accessory shed; at 1) shed located less than the code required minimum side yard setback of 15 feet; 2) more than the code permitted maximum lot coverage of 20%; located at: 1370 Jackson Street, (Adj. to Great Peconic Bay)New Suffolk,NY. SCTM No. 1000-117-10-10. RELIEF REQUESTED: The applicant requests a variance to make additions to a single-family dwelling that will result in lot coverage of 22.4% where town code permits no more than 20% lot coverage, and to legalize an existing shed with a side yard setback of 2.3 feet where a minimum side yard setback of 15 feet is required. The existing lot coverage, according to the design professional's site data, (page 2 of 4) of the architectural plan submitted to this board, states that the existing improvements on the property constitute 22% lot coverage which already exceeds the allowed of 20%. Maximum, largely due to an as built tennis court which was constructed by a previous owner. ADDITIONAL INFORMATION: The existing 15.1 x 5.1 square foot shed existed prior to 1988. Prior to 1988 sheds were permitted to have a minimum side yard setback of 3 feet. Testimony from the applicant was taken by the Board regarding the use of the second floor of the as built accessory garage which the applicant stated is conditioned finished space and is currently used as an "overflow" bedroom for visiting family and guests,where the Board noted only storage is permitted by code. BINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 1, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood which consists of waterfront homes. The non-conforming lot coverage is caused by the tennis court. The tennis court is similar to an at grade patio which is not counted as part of lot coverage. The tennis court is not a raised structure and it does not have any electric, plumbing, or mechanical equipment as part of its operation. The proposed additions and alteration are to create a modest entry porch and expand the existing kitchen on the landward side of the dwelling. The house is set back far from the street and theses proposed additions will not be seen from the street. The non-conforming shed is being used to house the pool equipment, which is in a code conforming location, and protects the neighbor from having to look at and hear the pool equipment. The minor additions totaling 157 sq. ft. will not have any significant impact. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant already exceeds the code permitted maximum lot coverage; therefore, any additions will require the benefit of an area variance. The applicant could make additions and conforming to the maximum lot coverage requirements by removing the tennis court. The applicant could move the shed, however, then the pool equipment would be exposed and the neighbor would be burdened by the sight and noise from the pool equipment. 3. Town Law X267-b(3)(b)(3). The variances granted herein for the non-conforming lot coverage is mathematically substantial, representing 12% relief from the code. However, the proposed increase from the existing 22 % lot coverage, largely created by the existing tennis court, to 22.4% is de minimus in nature at only Page 3, October 15,2020 #7424,Bellando SCTM No. 117-10-10 0.4%. The variance granted herein for the accessory shed is substantial representing 85 % relief from the code. However, the shed is used to contain the pool equipment and mitigate the sound and sight of the pool equipment and is very heavily screened from view by the adjacent neighbor by existing mature landscape screening. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new front entranceway and expanded kitchen and pool shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes , seconded by Member Lehnert, and duly carried,to GRANT the variances as applied for, and shown on the Architectural plans prepared by Elizabeth Thalheimer, Architect(Sheets 1 of 4,2 of 4, 3 of 4 and 4 of 4) dated January 30, 2020 SUBJECT TO THE FOLLOWING CONDITIONS: 1) The applicant shall perform one of the following options within 90 days of receipt of this decision and prior to the issuance of a building permit: a. Remove the existing bedroom above the accessory garage and convert it to a conforming use (unconditioned storage space) per the requirements of the Southold Town Building Department; b. Apply to the Zoning Board of Appeals to request a Special Exception for an accessory apartment to be located on the second floor of the accessory garage in order to legalize the"as-built"bedroom. 2) In the event that the swimming pool is removed or rebuilt and pool pipes are re-built,then the pool shed shall be moved to a Town Code conforming location. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. The proposed action is located with the Residential 40 low density zoning district: The purpose of the Low-Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit full development densities of approximately one dwelling per.acre and where open space and agricultural preservation are not predominate objectives. The lot coverage variance, if approved,would set precedent and reinforce a traditional land use pattern that is not supported by the purpose of zoning regulations and the bulk schedule.
