SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 28, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming 10,201.10 square feet, .234 acre, rectangular- shaped, corner parcel located in the R-80 Zoning District measures 104 feet east along Main Road (also known as State Route 25) from the intersection of Platt Road, then runs south 101 feet along a residentially zoned lot to the east, then runs west 91.86 feet along a second residentially zoned lot to the south, then runs north 110 feet along Platt Road. The site is improved with a one and one half story wood frame, single family residence with front porch and covered rear deck and a side deck along with a gravel and dirt driveway, a three (3) feet high picket fence along the Platt Road frontage and extending from Platt Road along the Main Road frontage for approximately 50 feet, then continuing along the Main Road frontage as a 6 feet high stockade fence and continues as an eight (8) feet high stockade fence along the balance of the property boundaries, as shown on the survey prepared by Scalice Land Surveying,Michael J. Scalice,LLS and dated June 2, 2020. BASIS OF APPLICATION: Request for Variances from Article XXII, Section 280-105; and the Building Inspector's June 26, 2020, Amended July 7, 2020 Notice of Disapproval based on an application for a permit to legalize an "as built" 8 foot fence in the side and rear yards, and an "as built" 6 foot fence in the front yard; at 1) fence more than the code permitted maximum four (4) feet in height when located in the front yard; 2) fence more than the code permitted maximum six and one-half(6-1/2) feet in height when located in the side and rear yards; located at: 45 Platt Road, Orient,NY. SCTM No. 1000-18-6-1. Page 2, October 15,2020 #7423, Winsor SCTM No. 1000-18-6-1 RELIEF REQUESTED: The applicant requests variances to legalize an "as built" 8 feet high stockage fence in the side and rear yards where the code limits such improvements to 6.5 feet and to legalize an "as built" 6 feet high stockade fence in the front yard (from the side fagade of the residence to the eastern lot line along Main Road) where the code limits such improvements to 4 feet in height. ADDITIONAL INFORMATION: While the subject property is located in the R80 residential zone, it faces to the north a more intensive Business `B" zone, where an active gas and service station exists. Additionally, the residentially zoned parcels immediately abutting the subject,to the east and the south are not used for single family residences and are all pre-existing, non-conforming in use. The parcel to the south previously was a New York State licensed motor vehicle inspection station (no longer licensed) affiliated with the currently active gas station to the north, across Main Road, and is used to store unregistered cars and farm equipment. Several neighbors, members of the public and past tenants of the subject property, spoke in favor of or presented written testimony in support of this application. One member of the public, the daughter of the former gas station owner and owner of the property immediately to the south of the subject parcel offered written and verbal testimony against this application. The applicant's attorney submitted a Memorandum of Law on September 30,2020. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 1, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property lies on the corner of Main Road and Platt Road in Orient. The majority of the perimeter fencing that is visible to the surrounding neighborhood is 3-4 feet in height and is a picket fence. The non-conforming sections of fencing along the rear and side yards of this comer lot are barely visible to anyone other than the non-conforming properties to the south and east which, in and of themselves, are out of character with the neighborhood and a detriment to the Applicant's and other nearby properties due to the storage of unregistered cars and farm equipment. At 8 feet, the side and rear yard fence is scarcely high enough to screen the property from the extensive debris on the surrounding properties which are not residential uses. The 6-foot section in the front yard, running along Main Road behind the side fagade thereby creating privacy for the rear yard, is less than 50-feet in length and was installed years ago and is necessary to screen the property from busy traffic on Route 25 and provide privacy from the active commercial operations across the street, in addition to screening automobile headlight glare into the residence. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A compliant 6.5-foot fence in the side and rear yards is not adequate to screen the extensive debris on the neighboring parcels. A complaint 4 feet fence, in the front yard along Main Road, is likewise an insufficient barrier to the road noise and clamor stemming from the commercial operations across the street. Variance relief is sought so that the Applicant can maintain some quality of life on this uniquely situated property which has two front yards because it's a corner lot. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 19% relief from the code for an 8 feet high fence in the side and rear yards and 50%relief from the code for a 6 feet high fence in the front yard. However, the Applicant submits that the requested 1.5 and 2-foot variances are not substantial under the circumstances and are the minimum necessary to provide the relief from their hardship. In addition, the Board of Appeals has previously granted relief for 6.5 foot high fencing on properties burdened with two front yards (corner lots and "through" lots) along a front yard property line that faces SR 25 (main Road, and Page 3, October 15,2020 #7423,Winsor SCTM No. 1000-18-6-1 CR 48 (North or Middle Road) to mitigate noise and potential safety hazards from heavy traffic, and the lack of privacy in an area on the subject property that is often the applicant's "architectural"rear yard. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 8 feet high stockade fence in the side and rear yards and a 6 feet high stockade fence in the front yard (for approximately 50 feet from the back of the residence to the eastern lot line) while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to GRANT the variances as applied for and shown on the survey prepared by Scalice Land Surveying, Michael J. Scalice, LLS, and dated June 2, 2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. A cone of vision is to be maintained on the applicant's property, at the southeastern intersection of Platt Road and Main Road (State Route 25), to ensure pedestrians, bicyclists and motorists can safely navigate the corner. 2. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s) within 30 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a building permit in the time allotted. 3. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 3 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 4. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained 5. At the discretion of the Board of Appeals, failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. The 8-foot section of fence that is at issue is barely visible to anyone other than the neighbors to the south and east which in and of themselves are out of character with the neighborhood and a detriment to Applicant's property. The 6-foot section is less than 50-feet in length. The Applicant has lived in her home for 30 years and worked hard to maintain it for the betterment of the surrounding Orient neighborhood. Unfortunately, her neighbors have not been as respectful. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: A compliant 6.5-foot fence would not adequately screen the property from the extensive debris and junk on the properties to the south and east. The small section of 6-foot fence along Main Road is necessary to screen the rear yard from the Main Road. 3. The subject parcel lies on the corner of Route 25 and Platt Road and consists of.23 acres in the R-80 zoning district. The property lies across the street from pre- existing non-conforming commercial properties including a gas station and is surrounded to east and south by properties that can only be described as junk yards. Photographs provided demonstrate the deplorable condition of these properties which are strewn with debris, abandoned vehicles and construction equipment. The Applicant installed the 8 foot fence in the rear and side yard to screen her property from the unsightly surrounding conditions. Because of the existing foliage on the subject property and the volume of debris that lies to the east and south,the fence is barely visible to passersby. The short section of 6 foot fence along the front yard serves to provide privacy from the commercial operations across Route 25 and to quell road noise from ferry travelers so that the property owner can quietly enjoy the premises. For the following reasons,the Applicant submits that variances from the fence height restrictions in Section 105A are warranted. POINT I THE APPLICANT HAS MET THE TEST FOR THE GRANT OF AN AREA VARIANCE SET FORTH IN TOWN LAW§267-B Under §267-B,the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a 2 j SEP 3 0 2020 detriment to nearby properties; �Zcn rw Bjard 0f Ahprals f (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. The Applicant submits that under the facts and circumstances presented here,the Applicant can clearly meet the standards set forth in Town Law§267-B and, as a result,the relief requested herein should be granted. Y. The Grant Of The Variance Will Not Cause An Undesirable Change In The Character Of The Neighborhood Or Create Detriment To Nearby Properties. The property lies on the corner of Main Road and Platt Road in Orient. The majority of the perimeter fencing that is visible to the surrounding neighborhood is 3-4 feet in height. As noted above,the non-conforming sections of fencing along the rear and side yards of this corner lot are barely visible to anyone other than the non-conforming properties to the south and east which, in and of themselves, are out of character with the neighborhood and a detriment to the Applicant's and other nearby properties. At 8 feet, the fence is scarcely high enough to screen the property from the extensive debris on the surrounding properties which are not residential uses. The 6-foot section in the front yard is less than 50-feet in length was installed years ago and is necessary to screen the property from busy traffic on Route 25 and provide privacy from the active commercial operations across the street. The Applicant lived in her home for 30 years and worked hard to maintain it for the betterment of the surrounding Orient neighborhood. The new owners would like to be able to enjoy the property as well. 3 ET 14),3 SEPAppe ® 2 { 2. The Benefits Sought To Be Achieved By Applicant Cannosb�Jyk__r --als Achieved By Some Method Other Than The Requested Area'Variance. Unfortunately, a compliant 6.5 foot fence is not adequate to screen the extensive debris on the neighboring parcels. A complaint 4 foot fence is likewise an insufficient barrier to the road noise and clamor stemming from the commercial operations across the street. Variance relief is sought so that the Applicant and the new owners of the property can maintain some quality of life on this uniquely situated property. 3. The Area Variance Sought Is Not Substantial. The Applicant submits that the requested 1.5 and 2-foot variances are not substantial under the circumstances and are the minimum necessary to provide the necessary relief. 4. The Grant Of The Variance Will Not Have An Adverse Impact On'The Physical or Environmental Conditions In The Neighborhood Or District: As stated previously, the 8-foot fence will only be visible to the applicant and neighbors to the east and south whose neglect of their properties has necessitated this application. The small length of 6-foot fence in the front yard maintains privacy and peace in the rear yard. There is no perceivable environmental impact from either structure. 5. The Self-Created Nature Of The Alleged Difficulty Should Not Preclude The Granting Of Area Variance Relief. The apparent difficulty stems from the actions of surrounding property owners and the unique location of this property. In searching the Suffolk County Clerk website, it appears that Ms. Windsors Deed has been transferred to a new owner. Therefore, the new owner has purchased the property with Violations in place and they should be removed. It makes me sick to my stomach to read her application that in my opinion is full of untruths. Every single experience with Ms. Winsor'had been a horrible one, full of her screaming, bullying, threats, renters and all that comes with the steady stream of airbnb and VRBO. I am not an attorney or claim to know the law. However, if I am reading the law correctly, she is a corner lot and should follow town code section 280-106 which states: A. On a corner lot, front yards are required on both street frontages, and one yard other than the front yard shall be deemed to be a rear yard, and the other or others side yards. B. On all corner lots, berms, walls, fences and hedges or any other potential obstruction to vision shall not exceed a height of 2-Y2' feet above the average street level within an isosceles triangle having thirty-foot sides along each street to preserve sight lines for traffic. I believe that the above property fencing is between 4' and 6' in these areas. On both Rt 25 and Platt the view is not only obstructed 'by the fence, it's obstructed by the wisteria, briars, a tree, bushes and a mess of whatever else is growing there. She also has a gate to get her kayaks out on Rt.25 behind the briar patch and blocks traffic with no concern to others safety. 4zb 3 ?O As far as the East and South properties, I believe it should follow section 2Q80-105t Town code with some of the fencing being only 4' high up to 6-'/z'. She hp�a/s those areas between 8' and 8-'/2'. This has made a very dangerous situation for the adjacent property owners. They have been robbed a number of times since this huge obnoxious fence was put up. Ms. Windsor knew the fence was against town code, yet continued to build it, as she threatened to sue me for questioning her on the direction of the fence and height. She then spray painted it to make it look old like it had been there for a long time. The fence is so loaded with bracing and so big and heavy it kept blowing over. She now has it attached to the East neighbors electric pole, as well as attached to a tree with screws and brackets. Prior fencing was wire for years and years with small trees growing on both sides that she cut down on tossed on the other properties. Funny, all these years the white picket fence and wire fence was fine. She purchased in February 1992, for $77 thousand. She spent $15 thousand in heating. In her application, she claims it's necessary to preserve the value of her property. She already sold the property for $589 thousand. Please check your minutes of meetings, Ms. Winsor brags about renting and her real estate listing brags of an excellent rental history. I did not look up the code or permits for the (most likely illegal) deck and extra bathrooms that were listed on her real estate ads. My main concern at this time is the conditions of entering and exiting our property and being robbed. You may want to look into the basketball hoop as that is on town property. At least it's not in the original spot approximately 20' from the entrance of Platt on the West side. We've tolerated her for 28 years. Please give us some justice. No neighbors should be allowed to have fences that are so high they create dangerous conditions.
