thence westerly and thence southwesterly along said high water mark about 260 feet more or less to land of
W.P.Tuthill;
thence along said land of W.P.Tuthill,two courses and distances as follows:(1)North 59"33'40"West 150
feet more or less,to a monument;(2)North 48°33'40"West 231.50 feet to a monument;thence along land
of the parry of the first part,North 29 degrees 22'50"East 261.05 feet to a monument on said southwesterly
line of Eugene's Road;thence along said southwesterly line,South 63 degrees, 11'20"East 459.68 feet to
the point of BEGINNING.
TOGETHER with a right-of-way for travel on foot and with vehicles between the main south road and the
premises herein conveyed over the driveways that now exist;SUBJECT to the right-of-way as set forth in
Deed in Liber 5834 of Deeds,at page 428.

Being and intended to be the same premises conveyed to the party of the first part herein by deed from

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party d the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
