Box 567 Mattituck, NY 11952 Re: Approval —Wickham Road LLC Office 12800 Main Road, s/e/o Love Lane & Main Road, Mattituck SCTM#1000-114.-11-15 Dear Mr. Kiely: The following resolutions were adopted at a meeting of the Southold Town Planning Board on Monday, July 12, 2021: WHEREAS, this site plan is for the proposed conversion of an existing 770 sq. ft. accessory apartment to a principle office structure, no footprint expansion or basement, with four (4) parking stalls on 0.23 acres in the Hamlet Business Zoning District, Mattituck; and WHEREAS, on August 4, 2020, the Southold Town Board issued Moratorium Waiver Reso#2020-470 for the subject parcel and site plan application; and WHEREAS, on September 30, 2020, Stephen Kiely, authorized agent, submitted materials for the Site Plan Application review; and WHEREAS, on October 19, 2020, the Planning Board found the application incomplete for review; and WHEREAS, on January 5, 2021, Stephen Kiely, authorized agent, submitted revised site plans and additional materials for Site Plan Application review; and WHEREAS, on January 11, 2021, the Planning Bound accepted the application as complete for review and waived certain application requirements pursuant to 280-133 for this existing site/building as also detailed at the October 19, 2020 work session; and Wickham Rd. LLC Office Page 2 July 13, 2021 WHEREAS, on January 11, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(2) ". . . replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes; and WHEREAS, on February 8, 2021, a Public Hearing was held and closed; and WHEREAS, on February 12, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on February 18, 2021, the Southold Town Engineer reviewed the proposed application and determined that the certain revisions were required in order for the application to meet the minimum requirements of Chapter 236 for Storm Water Management and these changes were made to the plan; and WHEREAS, on February 24, 2021, the Southold Town Code Enforcement officer verified that there were no open violations on the subject parcel; and WHEREAS, on February 24, 2021, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site; and WHEREAS, the proposed action is not subject to the review of the Suffolk County Planning Commission (SCPC) because it proposes less than 5,OOOsf of new or renovated floor area; and WHEREAS, on February 24, 2021, the Southold Town Planning Board received a request from the applicant to conduct work on site, electrical service installation to existing building, prior to site plan approval; and WHEREAS, on March 8, 2021, the Planning Board permitted the electrical service connection as requested to be completed on site prior to site plan approval; and WHEREAS, on March 11, 2021, the Town of Southold Local Waterfront Revitalization Program Coordinator reviewed the proposed project and determined it to be consistent with the Southold Town LWRP policies with certain recommendations to be considered; and WHEREAS, on April 5, 2021, the Southold Town Planning Board reviewed the proposed site plan application and required certain revisions to the plan and additional information; and WHEREAS, on May 27, 2021, Stephen Kiely, authorized agent, submitted revised site plans for review; and Wickham Rd. LLC Office Page 3 July 13, 2021 WHEREAS, at their June 7, 2021 work session, the Southold Town Planning Board reviewed revised site plans and required revisions to the site plan; and WHEREAS, on July 7, 2021, the Southold Town Chief Building Inspector reviewed and certified the proposed Business Office as a permitted use in the Hamlet Business (HB) Zoning District; and WHEREAS, the applicant coordinated with staff between June 7, 2021 and July 9, 2021 to provide final site plans for the subject site; and - WHEREAS, on July 12, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board approves the Site Plan with conditions to the plans entitled "Wickham Road LLC" prepared by Frank Uellendahl R.A., dated September 21, 2020 and last revised July 12, 2021, and authorizes the Chairman to endorse the Site Plan. Conditions 1. This site plan is for a private office only, not open to the public and not to be used as a residence. 2. Any change in use from a private office must be reviewed and approved by the Planning Board, and an upgrade to the sanitary system from the existing cesspools to an approved I/A OWTS system must be considered. 3. To mitigate the visual mass of the adjacent building's wall (to the northeast), plant two 5-6' tall evergreens five feet from each end of the adjacent building's wall and seven feet apart from each other. a. This must be done by October 1, 2021. b. The plantings will not be required if a beautification mural is painted on the wall by October 1, 2021. This is feasible due to both buildings having the same owner. 4. No exterior lighting was reviewed or approved by the Planning Board. Any future exterior light fixtures must be reviewed for compliance and approved by the Planning Board prior to installation. Please also note the following requirements in the Southold Town Code relating to Site Plans: Wickham Rd. LLC Office Page 4 July 13, 2021 1. Any new lighting fixtures beyond those approved as part of the Lighting Plan must conform to the Code and may require Planning Board approval depending on their number, size, intensity and location. Fixtures shall be shielded so the light source is not visible from adjacent properties and roadways and shall focus and direct the light in such a manner as to contain the light and glare within property boundaries and conform to §172 of the Town Code. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department. Please note the location of the Test Hole on the Site Plan. 2. The Test Hole shows poor drainage material exists throughout the first 9 feet of the soil column. The drainage design must be revised to ensure that stormwater runoff will be infiltrated into good drainage material. 3.
