Latham, residing at 2805 Peters Neck Road, Orient,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with'respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. Together with the adjacent groins to the west, the subject groin is part of a groin field that has historically served to control shoreline erosion and stability along this developed shoreline through beach retention; and through its replacement, the groin will continue to help maintain the sandy beach along a shoreline that is vulnerable to potentially severe erosion. LATHAM 2805 PETERS NECK ROAD ORIENT, NY SCTM#1000-32-1-12.1 Policy 4 For the purpose of maintaining the stabilized shoreline and maintaining the property's historical method of protection against erosion and flooding, the project proposes the in-place replacement of an existing timber groin and bulkheading that pre-date the Town's jurisdiction over erosion control structures along the Town's bayfront. Together with the adjacent groins to the west, the subject groin is part of a groin field that has historically served to control shoreline erosion and stability along this developed shoreline through beach retention; and through its replacement, the groin will continue to help maintain the sandy beach along a shoreline that is vulnerable to potentially severe erosion. Consistent with the permit standards for groins set forth in Section 275-11(C)(1) of the Town Code, the replacement groin is proposed with the same location, configuration, and length of the existing functional groin, with a low-profile design such that the seaward end of the groin is elevated no higher than 18 inches above the elevation of mean low water(MLW). The existing dilapidated bulkhead will be replaced with a low-sill bulkhead, the backfilling of which will allow for the creation of approximately 1,470 sf of intertidal marsh, which will provide both ecological and erosion control benefits. The project will thus maintain the historically existing site conditions without causing adverse impacts to, or increased erosion of, the beach on the subject or adjacent property, consistent with the permit standards set forth by Section 111-9 of the Town Code and with Policy 4 of the LWRP. The installation and backfillir�Iv the low-sill bulkhead will allow for the creation-of approximately 1,470 sf of intertidal marsh,which will enhance the adjacent vegetated tidal wetland's role as a sink and filter for potential runoff entering Orient Harbor;and both the new groin and low-sill bulkhead will be constructed with vinyl sheathing,thus also providing a potential benefit to surface water quality through reduction of treated timber located in and adjacent to surface waters.
