and WHEREAS, on September 23, 2020, William Kelly, authorized agent, submitted a portion of materials for Site Plan Application review; and WHEREAS, on November 18, 2020, William Kelly, authorized agent, submitted additional materials for Site Plan Application review; and WHEREAS, on December 7, 2020, the Planning Bound determined the application as incomplete for review; and WHEREAS, on May 3, 2021, William Kelly, authorized agent, submitted a portion of materials for Site Plan Application review; and WHEREAS, on May 6, 2021, William Kelly, authorized agent, submitted the Site Plan application fee and revised site plans for Site Plan Application review; and WHEREAS, on May 27, 2021, William Kelly, authorized agent, submitted the building elevations for Site Plan Application review; and Murtha Farm Ag Building Page 2 August 10, 2021 WHEREAS, at their work session on June 7, 2021, the Southold Town Planning Board accepted the site plan application for review, and WHEREAS, on June 7, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(3) agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming; and WHEREAS, on June 7, 2021, pursuant to Southold Town Code §280-131(H), the Southold Town Planning Board agreed to waive the requirement for a public hearing regarding this application which involves uses strictly related to agriculture; and WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work session staff reports on June 7, 2021 and July 26, 2021, the Planning Board agreed to waive certain application requirements of§ 280-133 for this application which involves uses strictly related to agriculture (but excepting retail winery operations); and WHEREAS, on June 24, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on June 24, 2021, the Southold Town Fire Inspector stated there were no objections to the proposed site plan; and WHEREAS, on July 1, 2021, the Southold Town Code Enforcement officer verified that there were no open violations on the subject parcel; and WHEREAS, on July 8, 2021, the Southold Town Engineer reviewed the proposed application and determined that the certain revisions were required in order for the application to meet the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on July 15, 2021, the Town of Southold Local Waterfront Revitalization Program Coordinator reviewed the proposed project and determined it to be consistent with the Southold Town LWRP policies with certain recommendations issued; and WHEREAS, on July 19, 2021, the Southold Fire District determined that there was adequate fire protection and access for the proposed action; and WHEREAS, on July 26, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; and WHEREAS, on July 27, 2021, the Agricultural Advisory Committee provided comments supporting the proposed project for approval; and Murtha Farm Aq Building Page 3 August 10, 2021 WHEREAS, on July 27, 2021, the Southold Town Chief Building Inspector reviewed and certified the proposed Agricultural Storage Building as a permitted use in the A-C Zoning District; therefore be it RESOLVED, that the Southold Town Planning Board hereby waives the requirement for a public hearing and certain application requirements as described above; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board approves the Site Plan with conditions, listed below, to the site plan entitled "Murtha Ag Barn" prepared by Nathan Taft Corwin III, L.S., dated March 25, 2020 and last revised April 30, 2021 and authorizes the Chairman to endorse the Site Plan. Conditions 1. All Suffolk County Farmland Committee requirements shall be met as issued October 12, 2017 for Committee Resolution Number FC-33-2017; 2. This site plan was reviewed and approved with no exterior lights. Any future exterior lighting must be approved by the Planning Board by letter prior to installation. 3. Fences a. Fencing as shown on the site plan may be relocated as needed; and, additional fencing may be installed without the need to amend the Planning Board site plan approval. b. As permitted by the Suffolk County Farmland Committee. c. Prior to installing fencing closer than 100' to the wetlands, a permit or letter of non jurisdiction from the NYS DEC and Southold Town Trustees shall be obtained. d. A buffer* shall be provided between the fences and the wetland boundaries. *Consult the NYS DEC or the local Natural Resources Conservation Service Center for advice on buffer size and composition. 4. Drainage requirements for this small barn and gravel area have been waived. All stormwater runoff must be prevented from entering wetlands and contained within the property. The agricultural barn building location may be changed to any location on the property within required setbacks without any amendment to this site plan approval and without further consultation with the Planning Board. 6. Provide an as-built survey to this department upon completion of the barn construction. Please also note the following requirements in the Southold Town Code relating to Site Plans: 1. Any new lighting fixtures beyond those approved as part of the Lighting Plan must conform to the Code and may require Planning Board approval depending on their number, size, intensity and location. Fixtures shall be shielded so the light source is not visible from adjacent properties and roadways and shall focus and direct the light in such a manner as to contain the light and glare within property boundaries and conform to §172 of the Town Code. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department. Drainage requirements • This site is located at the end of a 640' private driveway, and is embedded within a 45-acre property. There is no possibility of stormwater runoff from this barn and gravel area reaching a road due to the length and topography of the site being relatively flat. • The proposed barn and gravel areas will be surrounded by pasture and grass areas. The nearest property lines are over 100' away and the topography is relatively flat. There is little potential for stormwater runoff to leave the property as a result of this proposed construction. • Therefore the Planning Board might consider waiving additional drainage structures. • The current plan shows the proposed barn to be 104' from the wetland boundary on the plan, and the driveway to be only 48' from the wetland boundary. • Add a condition that the wetlands must be protected from runoff and siltation. • Add a condition that they need Trustees and potentially NYSDEC permits to build the driveway and barn in the location shown on the plan. B. Building location • At the site visit on 7/20/2021, the owner proposed that the location of the barn might be changed. • Add a condition that the location of the barn and gravel areas can be changed to be anywhere within the required setbacks (minimum of 75' from the southern property line) without having to amend the site plan. Require an as- built be submitted after construction. • Add that they need to comply with any Suffolk County Farmland Committee requirements. C. While we appreciate that Planning has waived many of the site plan requirements because it is an agricultural barn, we still feel strongly that farmers have enough hurdles to overcome and should not need to delay critical infrastructure improvements for many months or years while going through this process. (B) These activities can and do generate dust, smoke, noise, vibration and odor. These activities may occur on holidays, Sundays and weekends, at night and in the day. Such activities are presumed to be reasonable. Such activities do not constitute a nuisance unless the activity has a substantial adverse effect on the public health, safety and welfare. III: Items to consider: 1. Accept the application as complete for review to begin the process as specified below; in addition, consider the following: a.
