SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated July 28, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is on a nonconforming 34,498 square foot parcel with two front yards in the Residential R-80 Zoning District. The northerly property line measures 127.61 feet, the easterly property line measures 223.77 feet and is adjacent to Indian Neck Road, the southerly property line measures 118.16 feet and the westerly property line measures 166.82 then continues northerly at 93.31 feet and is adjacent to Leslie Road. The property is improved with a two-story framed residence with a covered porch on the southwest side of the residence and another porch located at the southeast side of the residence. There is a gravel and grass driveway that runs from Leslie Road to Indian Neck Road. There is a greenhouse to the south of the driveway and the remains of a shed to the north of the driveway near Leslie Road as show on the survey prepared by Nathan Taft Corwin III, LS, and dated October 20, 2008. The property also has many plantings, many of which are surrounded by mesh wire fences along with existing fenced areas. BASIS OF APPLICATION: Request for Variance from Article XXII, Sections 280 -105C (3) and the Building Inspector's June 5, 2020 Notice of Disapproval based on an application for a permit to construct a deer fence; at 1) more than the code permitted four (4) feet in height when located in the front yard; located at: 3100 Indian Neck Road, Peconic,NY. SCTM No. 1000-98-1-2.14. Page 2, September 17, 2020 #7419, Cohen SCTM No. 1000-98-1-2.14 RELIEF REQUESTED: The applicant requests a variance to construct a deer fence at 3100 Indian Neck Road, Peconic, NY. SCTM No. 1000-98-1-2.14. The proposed deer fence is not permitted pursuant to Article XXII Section 280-104C(3), which states"Deer fencing is prohibited in or along the front yard of any property." The deer fence will be located in the front yard along Indian Neck Road and Leslie Road per drawing entitled, "Proposed Plan Deer Fencing&Planting Diagram," date stamped September 10,2020. ADDITIONAL INFORMATION: The applicant wishes to install an 8-foot-high deer fence around the property to enable her to launch an agricultural/horticultural business with two partners, specializing in seed farming and horticultural specialties on this property. Presently, there is a large agricultural site across Leslie Road which supports a vineyard. The history of this property documents that it has been used for agricultural purposes. The previous owners of the property had a viable agricultural/horticultural business. Many of the plant varieties left by the previous owner continue to flourish. Over the past ten years gardening and limited seed farming activities have continued. The applicant wishes to expand and launch a new agricultural(horticultural)production business which would be curtailed by destructive behavior of the growing deer population. At the hearing the applicant's business partner spoke as to the fragility of the specific plants they plan to promote and that containing deer is essential to their success. Also,Mr. Robinson spoke on behalf of North Fork Authentic which promotes North Fork products and helps growers expand their markets. The applicant also stated they will strategically place evergreen screening to minimize the visibility of the fencing along Indian Neck Road and Leslie Road. The proposed fencing will not enclose the entire property. At the southern boundary, a 45-foot setback will allow for the east/west migration of the deer. At the hearing,the applicant was asked to submit a proposed planting diagram showing the production of woody peony plants from seedlings to sales and the introduction of growing plants to be utilized for natural dyes in spinning wool as described in the applicant's proposed business plan and at the hearings. The plan was received by the ZBA on September 9, 2020. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing character of the neighborhood will not be affected, as the history of the area reflects the R-80 and the A-C Zoning Districts that have existed to allow residential and agricultural uses. Furthermore, evergreen screening will minimize the visibility of the fencing along the two roads. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. In order for the applicant to launch her new agricultural/horticultural business the plants must be protected from the deer. Other agricultural entities throughout the Town of Southold have installed deer fencing in order to protect their product and the continuing viability of their business. In addition,the subject lot is a through lot and is therefore burdened with two front yards 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the deer fencing is essential to the success of the applicant's agricultural business. Page 3, September 17, 2020 #7419, Cohen SCTM No. 1000-98-1-2.14 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community, also zoned for agricultural use, will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant has proposed deer fencing that does not fully enclose the entire subject property. The applicant provides a 45 feet setback on the southern portion that will allow for the natural east-west migration route of the area's deer population to be maintained, and further reasons that it will avoid any change in existing conditions of the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deer while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance as applied for, and shown on a map (undated and unstamped) showing the proposed deer fencing and plantings, date stamped September 10, 2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall have four(4)years from the date of this decision to start a viable business in full agricultural production, as proposed. If at the end of four years the business fails to be successful,the applicant shall remove the 8-foot-high deer fence from the two front yards. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Cohen, owner and full-time resident ("Applicant") to the Southold Town Board of Appeals. The subject property ("Site") is located at 3100 Indian Neck Lane, Peconic, New York 11958. The Site is an,irregular-shaped, non-conforming lot with two front yards — Indian Neck Lane and Leslie Road. This application respectfully requests a waiver from Article XXII, Section 280-105 to allow for the installation of deer exclusion fence (8 feet in height), more than the code required maximum 4 feet in height when located in the front yard. The relief requested will allow for the launch of an agricultural business, specializing in seed farming and horticultural specialties on the subject property. Subject Site & Surrounding Area -- The subject property is mapped within an R-80 zoning i;ztt district and is a legal, non-conforming lot with a total lot C¢T dam.. area of approximately 0.79 acres, or 34,496 square feet. F According to the latest survey, the subject property has �dq 223.77 feet of frontage on Indian Neck Lane and 93.31 feet 8D of frontage on Leslie Road, thereby creating two front as Q 1 yards. The southwest and southern property line combined total 284.98 feet and the northern property line totals 127.61 feet. a dg�-e 4 The agricultural characteristics of the surrounding area is represented by the adjacent AC zoning district which supports Rafael's vineyard directly opposite the Site along Leslie Road4, and and the Indian Neck Farms equestrian complex to the south. The large area of open space supports the enhanced farming activities represented by the proposed plan. The residence is situated on the lot closest to the northern boundary line with the front of the house (its architectural front yard) facing south, not Leslie Road nor Indian Neck Lane. In effect, the technical front yards (Indian Neck Lane and Leslie Road) function and appear more as side yards instead of the actual front yards of the property. Appendix A contains the certificate of occupancy documents and other property documentation. Appendix B provides surveys, maps, planting plan, and photos of the subject property. Unique Site Conditions The subject site is unique in the neighborhood with its non-conforming lot area (at approx. 0.79 acres), its unusual shape, its two.front yards (Indian Neck Lane and Leslie Road), and the recognized historical pre-existing, single family house and accessory shed building. All .of these site conditions are inherent in the Site and are not self-created by the applicant. According to the R-80'zoning district guidelines, both residential use and agricultural production is permitted, as is the installation of deer exclusion fencing. However, deer fencing is prohibited in or along the front yard of any property. The subject site is at a comparative disadvantage due to its non-conforming lot size (R-80 designation requires minimum lot size of 80,000 sf, or 1.84 acres for residential use) which reduces flexibility in the layout and assignment of activities on the property. If the Site were larger, then the agricultural production activities and its protective deer fencing could be situated to avoid front yard exposure. Second, the irregular-shaped lot also acts as a constraint towards the efficient functionality of the Site. However, the diagonal west and southwest boundary line facing Leslie Road does provide a deep setback from Leslie Road, thereby minimizing any visual impact of the proposed deer fencing. Mature trees and planting exist along all boundary lines which will also reduce the visibility of the proposed fencing. 3100 Indian Neck Lane, Peconic 2 RECEIVED F III Third, the Site's two front yards, Leslie Road to the west and Indian N9ck La L ASO- t, is a unique site condition that is the primary trigger for this variance request. iZoning Board OF Appeals The proposed deer fencing along Indian Deck Lane and Leslie Road represented-by th open spaced, non-reflective materials, combined with the existing mature trees and plantings, would not be perceived as unappealing or inappropriate for the landscape, nor would it cause any negative impact on neighbors. In sum, the unique physical characteristics at the subject site represent the challenge for the applicant to benefit from the opportunities provided by the R-80 zoning designation as it relates to agricultural production. The requested variance addresses these practical difficulties in providing the necessary minimum relief to the applicant. Property History and Use As current owner and Applicant, I have made every effort to undertake improvements that restore and preserve the historic, architectural character of the individual structures, as well as maintaining the agricultural landscape. In addition, a new property boundary line was drawn to create the triangle-shaped property at 2900 Indian Neck Lane and its conversion of an existing barn to a single family residence. The current tax map shows the subject site as Lot 2.14. The prior owners of the subject site, Judy "Plant" Randlett and Tom Burdy, nL. operated a landscape design business that served the community. Ms. Randlett's horticultural specialties and rare specimens have been maintained and enhanced throughout the subject property. At the time of the sale of the property in 2008 to the applicant, Ms. Randlett prepared a :' Planting Plan that identifieddthe horticultural varieties, many of which F ;;A continue to flourish today. .. .. Judy"Plant"Randlett The continued use of the subject property for residential use and agricultural production is supported by the historical documentation. The proposed plan to formalize the agricultural (seed farming and horticultural specialties) activities to launch a new business is consistent with,the history of use at the subject site and its R-80 zoning district designation as well as the character of the surrounding neighborhood. Proposed Plan: Deer Exclusion Fencing and Launch of New Agricultural Business Deer Exclusion Fencing The proposed plan provides for the installation of deer exclusion fencing that would parallel the boundary lines of the subject property, but not encapsulate the entire Site. On all sides, except for the Indian Neck Lane frontage and-the northern boundary line, the installation of,deer fencing is significantly setback from Leslie Road and from the southern boundary line. As shown on the Proposed Plan Deer Fencing Diagram, the setback of the proposed deer fencing from Leslie Road ranges from 68 feet at the Leslie Road point of entry to 119 feet at the southwest corner post, a long distance that reduces visibility from Leslie Road. The setback from the southern boundary line is approximately 45 feet, which allows for open space and the maintenance of the existing, natural east-west migration route of the deer population in the area across the-subject property. Neighbors will not be adversely affected by the proposed fence, as the movements of the deer will remain unchanged. Aside from the gray cinderblock wall erected by the owner of 3380 Indian Neck Lane, naturalistic evergreen screening and mature trees and plantings exist along all the Site's, boundaries. Intensive gardening and limited seed farming activities on a small scale have occurred at the Site for over 10 years. The desire to expand, formalize and launch a new agricultural (horticultural) production business has been curtailed by.the destructive behavior of the growing deer population. There is no alternative; deer fencing is essential to move forward with the launch of the new business that depends on the full access to the open space at the subject property to grow product. Launch of New Agricultural Business The launch of a new agricultural production business, specifically seed farming, is enhanced by my partnership with Mr. Brent Robertson in creating a company known as North Fork Authentic, Inc. (www.NorthForkAuthentic.com). Established in July 2017 and a recent recipient of a NYS Economic Development— Market NY Grant, North Fork Authentic is,the homegrown regional umbrella brand promoting North Fork products while improving year-round sustainability for the North Fork region and its local economy. Beyond the overall marketing and communications plan, North Fork Authentic works with producers to build their brands and expand their markets. As a seed farming business at the subject site, the expected sales revenue would be derived from several sources: wholesale direct to North Fork Authentic for resale under the "North Fork Authentic" brand name, direct online and in-store-retail, and potentially a collaboration with North Fork Authentic as aggregator for local farms to provide product, on a contract basis, to larger seed companies. The business relationships within the seed farming industry are varied and provide opportunities. For example, The Salt of the Earth Seed Company supported by its Invincible Summer Farms in Southold is an example of a local farm that produces seeds for additional income. Row7 Seed Company, located in Westchester County, relies on both multiple small farmers to provide organic seeds and chefs who define the demand'. Furthermore, partnership opportunities_exist with other organizations such as, Long Island Regional Seed Consortium, The Long Island Native Plant Initiative, among others. The opportunities for a seed farming business, particularly organic seeds, are summarized below. Zoning Board of Appeals It is expected that the agricultural operation at the subject site will o th'i`n aI1 apptreable commercial cultivation and harvest permits and'certifications required by New York State (specifically Article 9 — Inspection and Sale of Seeds) and local government. If successful, the applicant would expect that the operation would ultimately qualify as a "bona fide" farm on land smaller than seven acres. Market research, business planning and preparation for the proposed new seed farming business is underway. The proposed plan allows for removing the unattractive, yet necessary, individually fenced planting areas. The single fence line not only provides full access to the open space critical to the agricultural operation, but also presents a far more attractive solution to support the agricultural component of the proposed plan. I am excited at the prospect of connecting with the North Fork community on a deeper level as a full-time resident and a small business in terms of building relationships and contributing to the local economy. Conclusion I Findings 1. Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the variance requested. If the variance is granted, there would be no negative effect or impact on altering of the neighborhood character and would not impair appropriate use or development of adjacent properties. More specifically, the history of uses of the area and at the subject premises demonstrate that the proposed variance (deer exclusion fencing) is consistent with and will not alter the essential character of the neighborhood. The existing character of the area reflects the goals of the R-80 and adjacent AC zoning districts, permitting both agricultural and residential use, and recognizes the history of use at the Site. Furthermore, as the Applicant, I am very sensitive to the visual impact the subject property has on the neighborhood. The improvements made to the subject property since the ownership in 2008 have demonstrated the special attention to design aesthetics to ensure the visual attractiveness of the Site. The proposed plan will include strategically placed, evergreen screening, where necessary, to minimize the visibility of the fencing facing Indian Neck Lane and Leslie Road, the two (zoning) front yards. 3100 Indian Neck Lane, Peconic 6 ~ RECEIVED 2. Whether the requested variance is substantial. The requested variance is minimal and appropriate, as it represents a single waiver request of Article XXII, Section 280-105. The proposed plan is limited to the installation of deer fencing only and does not seek to change any other provisions of the R-80 zoning regulations. Moreover, since the architectural front yard at the subject site faces south, not the technical front yards (Leslie Road and Indian Neck Lane), the proposed fencing is minimal and would not be perceived as out of place. The challenges inherent in the subject site cannot be overcome without the variance approval. 4. Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. In fact, the proposed deer fencing does not fully enclose the entire subject property, and at the southern boundary line, a 45 setback allows for the natural east-west migration route of the area's deer.population to be maintained, thereby avoiding any change in existing conditions of the neighborhood. The property has 223.77 feet of frontage on Indian Neck Road, with 284.98 feet along the northerly property line, 93.31 feet along Leslie's Road and 127.61'feet on the southern property line. BASIS OF APPLICATION: Request for Variance from Code Section 280-15,based on an application for building permit for "as built" accessory shed, and the Building Inspector's January 25, 2010 Notice of Disapproval concerning"as built" 10X16 accessory shed, location of accessory shed in the front yard rather than code required rear yard. RELIEF REQUESTED: The applicant proposes to maintain an as-built Accessory Shed in the approximate same location as a pre-existing nonconforming accessory shed that was removed by the applicant due to its severe disrepair. Van Tuyl, P.C. dated Feb. 26, 1979 shows the location of sheds in the front yard, one of which is the approximate location of what is being proposed by the applicant in this appeal. The applicant testified that the pre-existing nonconforming shed was in tensible disrepair and had termite infestation. The applicants/owners are pursuing improvements to restore and preserve the historic architectural character of the individual structures on this parcel as well as its existing landscape and garden features. The applicants' property has two front yards and the rear yard created by the principal residential dwelling is narrow and heavily treed which does not afford a feasible location for a 10'x16' shed without the removal of a mature tree(s). 3. The variances granted herein are not substantial when considering that there was a pre-existing nonconforming accessory shed in the approximate same location of what is being proposed in this appeal. The distance from the as-built accessory shed location to the edge of pavement of Leslie's Road is approximately 21 feet,as scaled from the survey prepared by Nathan Corwin,L.S.dated October 20,2008. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that granting of variances for the as- built accessory shed in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
