Vanderbeek, et al. ,PROPERTY LOCATION: 1150 Ruch Lane, Southold,NY SCTM# 1000-52-2-35 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 23, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 6, 2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 8,558 square foot waterfront parcel located in an R-40 Zoning District. The northerly property line fronting Ruch Lane, a 25-foot-wide private road, measures 50.00 feet, the easterly property line measures 175.21 feet, the southerly property line, tie line along Arshamomaque Pond, measures 54.05 feet, and the westerly property line measures 177.33 feet. The parcel is improved with a one-story framed house, with an attached deck and outside shower, and a deck and wood steps leading to the waterfront. All is shown on a survey prepared by John T. Metzger L.L.S., last revised November 7, 2019. BASIS OF APPLICATION: Request for Variance a from Article XXIII, Section 280-124 and the Building Inspector's November 21, 2019 Notice of Disapproval based on an application to legalize an "as built" deck addition attached to an existing single family dwelling; at 1) located less than code required total side yard setback of 25 feet; located at 1150 Ruch Lane(Adj.to Hashamomuck Pond)Greenport,NY SCTM No. 1000-52-2-35. RELIEF REQUESTED: The applicant requests a variance to legalize and as-built deck addition with a total side yard setback of 15.9 feet where code requires a minimum side yard setback of 25 feet. Page 2, September 17,2020 #7416,Vanderbeek SCTM No. 1000-52-2-35 ADDITIONAL INFORMATION: The Notice of Disapproval was issued as a result of the owner applying for a Pre-Existing Certificate of Occupancy for the dwelling, as well as to legalize the"as built"deck addition. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of waterfront homes on fifty-foot-wide lots that pre-dates zoning. Houses and decks with non-conforming side yard setbacks are common in this neighborhood. The subject dwelling was built prior to zoning and the attached deck has existed for decades. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is 50 feet wide therefore any house built on the lot would need the benefit of an area variance. Any proposed deck addition to a house on this size lot requires the benefit of an area variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 37% relief from the code. However, the variance is to legalize an "as-built" attached deck which will remain open to the sky. Due to the size of the lot and proximity to the wetlands there are no code conforming locations to build an attached deck on this property. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law t 267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to GRANT the variance as applied for, and shown on the Architectural Plan prepared by Joseph Fischetti,P.E., dated June 1,2020; and survey prepared by John T. Metzger L.L.S. last revised November 7,2019 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require anew application and public hearing before the Zoning Board of Appeals. Any deviation from the,variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other 'than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by.the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. This letter formally serves as a request for an extension of ZBA—Application#7416(SCTM 1000-52-2-35) which expires on September 17,2023.While we continue to finalize the work granted under the various permits,we want to make sure the variance granted does not lapse.Unfortunately,the Certificate of Occupancy has not been received yet under the 3 year period granted under the variance. My request is for a 3 month extension of the variance.The extension is requested under the Zoning Board of Appeals Findings(see attached)—page 3,which states a request for an extension may be made to the Board of up to 3 consecutive 1 year terms under Chapter 280-146(B)of the Southold Code. This has mainly been a result of COVID as well as the difficulty in securing reliable,capable and available contactors combined with some personal health issues this summer. My contractor has been meeting with both the Southold Building Department and Board of Trustees this week.My understanding is we are waiting on final inspections to obtain a CO.While I do not expect it to take 3 months,I ask the Board to grant a 3 month extension just in case.If that is not possible,I would request a one year extension under the Southold Code.
