SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated April 8, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is located on a 19,200 square foot parcel (.44 acres) in an Agricultural Conservation (A-C) Zoning District. The northerly property measures 192.00 feet and the easterly property measures 100.00 feet and is adjacent to Bay Home Road. The southerly property measures 192.00 feet and the westerly property measures 100.00 feet. The property is improved with two story framed residence with a covered screened porch in the front of the residence and a roof over the wood deck in the rear of the residence. There is a two-car framed garage to the northwest side of the residence as shown on the survey map prepared by Kenneth M. Woychuk, LS, and last revised February 27, 2020. BASIS OF APPLICATION: Request for Variance from Article 111, Sections 280-15 and the Building Inspector's February 24, 2020 Notice of Disapproval based on an application to legalize as built additions to an existing single- family dwelling; at 1) existing accessory garage located in other than the code required rear yard; located at 870 Bay Home Road, Southold,NY. SCTM No. 1000-56-5-2. RELIEF REQUESTED: The applicant requests a variance for a permit to legalize an existing two car garage after the "as built" addition to the house places the garage in the side yard. The proposed construction is not permitted pursuant to Article 111, Section 280-15, which states, "accessory buildings and structures or other accessory uses shall be located in the required rear yard". Page 2, September 17,2020 #7414,Baiz SCTM No. 1000-56-5-2 ADDITIONAL INFORMATION: The existing residence pre-dates zoning. The existing deck was constructed in 1984, replacing a previously existing wooden deck. The original 9-foot x 8-foot deck was built in 1946, and replaced. with no building permit and was constructed with no footings between 1965 and 1968. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing deck was constructed in 1984, replacing a previously existing wooden deck. The original deck was replaced with no building permit and was constructed with no footings. The applicant would like to rebuild the deck in kind and in place with proper footings. Although the house and garage are existing, the location of attached "as built" deck and its reconstruction in place and in- kind places the existing garage partially in the side yard. 2. Town Law §267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The previous decks were built without permits. The deck will be rebuilt in kind and in place, but its existence places the garage in the side yard, not the rear yard, thus the need for a variance. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the variance is considered "technical", there is no change in the location of the existing garage, and the deck meets all setback requirements. Since the deck already exists, it places what was a garage in the rear yard to a garage partially in a side yard. The garage pre-dates zoning and has a legal Pre- Certificate of Occupancy. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has not been self-created. The applicant is a family member and the existing family house, deck and garage all per-date zoning and have a legal pre-certificate of occupancy (#40894 12/11/2019) 6. Town Law V67-b. Grant of or the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a rebuilt deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the survey map prepared by Kenneth M Woychuk,LS, and last revised February 27, 2020. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. It was owned by Eric Baiz's mother until her death. The existing deck was constructed in 1984, replacing a previously existing wood deck. Mrs. Baiz did not obtain a building permit to replace the existing deck and it was constructed with no footings. The deck needs to be replaced again but Eric Baiz must first obtain a variance in order to rebuild the deck properly(with footings). The house and deck would cause the existing garage to be located in a"side yard". The garage is existing, the house location is existing. There will be no change to the character of the neighborhood or detriment to nearby properties by the existing garage remaining in the side yard and the deck being propoerly constructed. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Any improvements to the existing house will place the garage in a side yard. The only alternative is to build an addition that connects the garage to the house. This would be a very expensive undertaking, and not feasible for the owner.
