SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 8, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The agency added a comment to their response which advised that any contemplated increase in density or use should only be effectuated through the enacted amendments of the zoning ordinance with standards for such proposed"Farm Labor Camp"use. SUFFOLK COUNTY PLANNING - FARMLAND AND OPEN SPACE: This application was referred for review and comments to the Suffolk County Department of Development and Planning, Farmland and Open Space. In email correspondence dated June 23, 2020 from August Ruckdeschel, Department Coordinator, he described the County and State's policies for labor housing on agricultural operations as essential for"Right to Farm"protections to the farmer. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING DEPARTMENT: This application was referred for review and comments to the Town of Southold Planning Board who issued its response dated August 25, 2020, indicating that they have no objection to the proposed use. The Planning Board is currently in the middle of its Site Plan review process and reserves the right to make any necessary changes after reviewing all proposals thoroughly. PROPERTY FACTS/DESCRIPTION: The subject property consists of a conforming 39.3525-acre parcel located in an AC Zoning District. The parcel runs 159.71 feet fronting Aldrich Lane along the easterly property line, runs 282.40 feet on the South side before turning and running 940.64 feet on the East side Page 2, September 17,2020 #7412SE, 5645 Aldrich Lane,LLC SCTM No. 1000-120-3-11.13 & 11.14 and then turning 971.11 feet on the South side. The parcel then runs 1,269.83 feet on the West side and 1,523.20 feet on the North side. The parcel is improved with 41 greenhouses and a metal barn upon the portion having 4.9704 acres in area that has retained it development rights, and the remaining portion of 34.3821 is encumbered by a Town of Southold Conservation Easement located north and south of the 4.9704-acre portion. All is shown on a survey prepared by Howard W. Young L.L.S. last revised December 11, 2013. BASIS OF APPLICATION: Request for Special Exception per Code Section 280-13B (9), the applicant is requesting permission to construct a Farm Labor Camp to accommodate up to ten(10) seasonal workers in an existing storage building currently situated upon agricultural property; located at 5645 Aldrich Lane, Mattituck,NY. RELIEF REQUESTED: The applicant proposes to convert the second story of an existing metal agricultural building into a "farm labor camp" as defined by Southold Town Code for sleeping and living accommodations for up to Ten(10)members of the farm's labor force. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 3, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280- 142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. The parcel is located in an agricultural district and is surrounded by properties which are in agricultural use. Lots 11.13 and 11.14 are divided to indicate that the 34.3821-acre portion is encumbered by a Town of Southold conservation easement while the smaller portion, 4.9704 acres, retains its development rights. The requested special exception will not change the principle use of the subject parcel. According to the Town of Southold Land Preservation Coordinator, the two tax map nos. 11.13 & 11.14, depicted by a dotted line in the SCTM album, have been created only to identify the portion of the property that have been encumbered by a Conservation Easement; 34.3821 acres. Technically, the subject tract of land is identified as one lot and is depicted as a solid line surrounding both lots in the SCTM album. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. The construction of a farm labor camp within an existing agricultural building will not change the use of the subject property or the exterior appearance of the building. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. The proposed farm labor camp is not located near a residential building. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. The proposed farm labor camp is accessory to parcels in agricultural production. The easement portion of the parcel surrounding the subject development portion is in agricultural production. Page 3, September 17,2020 #7412SE, 5645 Aldrich Lane,LLC SCTM No. 1000-120-3-11.13 & 11.14 E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The proposed farm labor camp will be built in an existing agricultural building. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. G. That the proposal shall comply with the requirements of Chapter 236, Stormwater Management In making such determination, consideration was also given to: A. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. B. The conservation of property values and the encouragement of the most appropriate uses of land. The subject parcel is restricted by an agricultural conservation easement and the proposed farm labor camp will help keep the parcel in agricultural use by providing housing for people who work on the farm. C. The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. D. The availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent(whether liquid, solid, gaseous or otherwise)that may be caused or created by or as a result of the use. E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases, odors, smoke or soot. F. Whether the use will cause disturbing emissions of electrical discharges, dust, light, vibration or noise. G. Whether the operation in pursuance of the use will cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, if existing or if proposed by the Town or by other competent governmental agencies. H. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located. I. Whether a hazard to life, limb or property because of fire, flood, erosion or panic may be created by reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus or by the undue concentration or assemblage of persons upon such plot. J. Whether the use or the structures to be used therefor will cause an overcrowding of land or undue concentration of population. K. Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. The parcel is over 39 acres therefore there is ample space for agricultural production as well as a farm labor camp. L. Whether the use to be operated is unreasonably near to a church, school, theater, recreational area or other place of public assembly. M. Whether the site of the proposed use is particularly suitable for such use. N. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed use. O. Whether adequate provision can and will be made for the collection and disposal of stormwater runoff, sewage, refuse and other liquid, solid or gaseous waste which the proposed use will generate. Page 4, September 17,2020 #7412SE, 5645 Aldrich Lane,LLC SCTM No. 1000-120-3-11.13 & 11.14 P. Whether the natural characteristics of the site are such that the proposed use may be introduced there without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. In your letter, you explain that the New York Department of State Building Code requires an automatic sprinkler system installed throughout the proposed living quarters and that a two (2) hour load bearing fire wall must be installed, all which required a reconfiguration of the approved plans. The revised plans dated August 19, 2022, (sheets A-4 & A-6) prepared by Mark Schwartz, Architect, show newly configurated two hour load bearing walls, two hour fire rated doors, fire bearing staircases, as well as the addition of bathrooms on the first floor. Since the amended improvements will maintain the Special Exception granted by the Board of Appeals ZBA File No. 7412SE, I have determined that your request is de minimus in nature. Under the State of new York dept. of State building code 19 NYCRR Part 1221, section 903.2.8 requires an automatic sprinkler system be installed throughout a Group R rated building, which is the rating for the existing building. The majority of the building is storage and the cost to sprinkler the entire building would be prohibitive. In addition, the property does not have adequate water supply for the entire building. As such, we applied for a variance to just provide a sprinkler system for the new proposed living quarters. In order to receive a variance, a two (2) hour load bearing wall with 2 hour fire rated doors, provide a new reconfigured staircase and fire rate both staircases. The owner proposes to install a first floor mens bathroom with handicapped access and a womens bathroom for handicapped access. The bathroom additions are not part of the zoning variance for the second floor workers living quarters . I have enclosed a copy of the State variance and two (2) prints of the revised A-4 architectural drawing for your review. I respectfully request you issue a de minimus letter in that the proposed revisions were a requirement of the Department of State variance requirements.. Sincerely, Michael A. Wilcenski, Chairman 0*, Members of the Planning Board Date: August 25, 2020 Re: Request for Comments for 5645 Aldrich Lane LLC SCTM#1000-120.-3-11.13 & 11.14 ZBA#7412SE The Planning Board received your request for comments regarding the above- referenced Special Exception application for a "farm labor camp" to be located on the second floor of an existing agricultural building in the A-C Zoning District, Laurel. The farm labor camp is proposed on a 5.0 acre parcel with development rights intact, on the second floor of an existing 80' x 125' (10,000 sq. ft.) agricultural storage building which was granted Site Plan approval in 2005. An amended Site Plan application for the farm labor camp is currently being reviewed by the Planning Board and the Board generally has no objection to the proposed use as part of an existing wholesale nursery business. There is no proposed footprint expansion to the existing building, the farm labor camp would help sustain the existing agricultural use and would provide support for up to ten (10) seasonal farm employees. Please be advised that the Planning Board is currently in the middle of its Site Plan review process for this amended application and reserves the right to make any necessary changes to the Site Plan after reviewing all proposals thoroughly. Thank you for this opportunity to provide comments. If you should have any questions or require additional information, please do not hesitate to contact the Planning Office. ,Ag COUNTY OF SUFFOLK 1V1X RECEIVED M.✓✓ / a2 1 . f; .1' 2020 el OFFICE OF THE COUNTY EXECUTIVE Zoning Board Of Appeals Steven Bellone SUFFOLK COUNTY EXECUTIVE Natalie Wright Department of Commissioner Economic Development and Planning April 8, 2020 Town of Southold Zoning Board of Appeals 53095 Main Road P.O. Zoning a3oa ®a`A¢pQ ', Thanks Kim, For the most part, I am simply happy to reiterate what I mentioned previously. I can confirm that these two parcels are enrolled in NY State's Agricultural District program in Suffolk County's Ag District#1. Enrollment in an agricultural district does confer some protections to the farmer, include the "right to farm". https://agricultur6.ny.gov/land-and-water/about-agricultural-districts https://www.dos.ny.gov/lg/publications/Local Laws and Agricultural Districts.pdf "Local governments, when exercising their powers to enact and administer comprehensive plans and local laws, ordinances, rules or regulations, shall exercise these powers in such manner as may realize the policy and goals set forth in this article[Article 25-AA of the Agriculture and Markets Law], and shall not unreasonably restrict or regulate farm operations within agricultural districts in contravention of the purposes of this article unless it can be shown that the public health or safety is threatened." There is case las supporting the provision or construction of labor housing on agricultural operations. In Lysander v Hafner, the Court agreed with the Commissioner of Agriculture and Markets that"Frequently, farmers rely on mobile home housing for their farm laborers to accommodate the long work day, seasonal housing needs and to address the real shortage of rental housing in rural areas. Local government prohibitions or restrictions on the use of mobile homes can significantly impair the viability of farm operations." I hope this additional information is helpful in the Town's evaluation of the farmers' proposal. Have a great day! Hi August, See attached comments from Ted Klein and a copy of the above subject "Special Exception" application for a Farm Labor Camp. The farmer is proposing finishing the second floor of an existing metal building to accommodate 10 farm workers. The subject parcel SCTM# 1000- 120-3-11.13 has retained development rights and, I believe is in an Agricultural District, but surrounding lots are preserved with Southold town conservation easements. Hope this is helpful. Kim E. Fuentes Secretary to the Zoning Board of Appeals Town of Southold 54375 Main Road Southold, NY 11971 631-765-1809,Ex. 5011 E-mail:kimf@southoldtownny gov Mail to:P.O. I am happy to take a look, but to be truthful, it's not really accurate to say that our division "reviews applications that propose Farm Labor Camps". We do review applications for agricultural structures on County preserved farmland, but we do not allow housing of any kind (residential or farm labor) on preserved County parcels. We do review and permit structures like barns, greenhouses;farmstands, etc.We do understand that parcels in an ag district are generally permitted to build ag labor.structures, but not if they have sold those development rights away to the County. I also understand the Town of Southold has different rules and regs for its farmland preservation program and does,to my understanding, allow housing on preserved land. It would be most helpful to me if you could send me the version with Ted's comments and I can add to those comments as appropriate. Thanks for reaching out. Have a great weekend!
