SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD OFFICE OF THE ENGINEER: The Office of the Engineer offered comments on this application in their October 18, 2019 letter. James Richter, R.A. indicated that the 400 sq. ft. reconstructed garage will not require Code compliance with Chapter 236 and further indicated that he has no other concerns beyond what the Building Department has addressed. PROPERTY FACTS/DESCRIPTION: The subject property is a 6,006 sq. ft. nonconforming parcel located in an R40 Zoning District. The parcel has 66.00 feet of frontage on Oak Street along the southerly property line, runs north for 91.00 feet, then west for 66.00 feet, before returning 91.00 feet back to Oak Street. The property is improved with a two-story frame residence, which is currently in a state of disrepair. An accessory garage is located in the rear yard that is currently under construction, but stopped due to not having the benefit of a building permit all shown on survey prepared by William R. Simmons, 111, LSPC, dated February 2, 2018. BASIS OF APPLICATION: Request for Variances from Article IV, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's July 30, 2019, Amended January 17, 2020 Notice of Disapproval based on an application for a permit to legalize an "as built" accessory garage and demolish an existing single family dwelling and construct a new single family dwelling; at, 1) accessory garage located less than the code required minimum rear yard setback of 3 feet; 2) accessory garage located less than the code required minimum side yard setback of 3 feet; 3) construction more than the code permitted maximum lot coverage of 20%; located at 135 Oak Place, Mattituck,NY. SCTM No. 1000-142-1-11. Page 2, September 17,2020 97346,Myftarago SCTM No 1000-142-1-11 RELIEF REQUESTED: The applicant requests variances to reconstruct the "as-built" accessory garage with side yard setback of 1.5 feet where 3 feet is required, and a rear yard setback of .2 feet where 3 feet is required, construction of both the accessory garage and dwelling has a lot coverage of 27.45% where no more than 20% is permitted. AMENDED APPLICATION: During the hearing on July 9, 2020, the applicant was asked to bring the plan into more conformity with the code by reducing the proposed lot coverage by either reducing the size of the house or the accessory garage in order to meet a lot coverage calculation of no more than the existing 24.19%. The Board expressed a preference for reducing the size of the accessory garage to both reduce the proposed lot coverage and to create conforming rear and side yard setbacks. Depicted on an amended site plan, dated July 24, 2020, received September 11, 2020, the applicant's design professional reduced the proposed lot coverage from 27.45% to 24.12%, by demolishing the existing accessory garage and rebuilding it from 400 sq. ft. to 200 sq. ft. in area. In addition to this modification, the site plan depicts the accessory garage with code required minimum setbacks for both the rear and side yard of 3 feet. ADDITIONAL INFORMATION: The owner of the property started the reconstruction of the existing garage without the benefit of a building permit. On February 28, 2019 a "Stop Work" order was issued on the project. The existing residence and garage have a Pre- C/O # Z-16362 was issued on November 2, 1987 for a 2-story dwelling and accessory garage. At the hearing on January 2, 2020, the owner was asked to amend the permit application to include reconstruction of the existing residence, due to the fact that the existing building was non- habitable, and without an existing use, we cannot consider an accessory use. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 2, 2020, and again on July 9, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)MM. Grant of the variance as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. At one time both the existing residence and accessory garage were habitable, and legal under-the Southold Zoning Code. The owner amended his application to include demolishing and rebuilding both the residence and the accessory garage. The lot coverage of the property will be no greater than the original lot coverage at the time the Pre-C/O was issued. The property faces a small private Right of Way and the new home and accessory garage will improve the neighborhood by demolishing very deteriorated and uninhabitable structures. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant as amended cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The accessory garage will no longer require setback relief, but both the house and garage require relief for lot coverage over the maximum 20% permitted by code 3. Town Law &267-b(3)(b)(3). The variance granted herein as amended for lot coverage at 24.12% is mathematically substantial representing 21%, relief from the code, but the applicant has reduced the originally proposed lot coverage of 27.45% pursuant to the Board's recommendation to not exceed the existing lot coverage by reducing the size of the accessory garage and has eliminated the need for two setback variances from property lines. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions imposed by this board. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a reconstructed residence and accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried, to GRANT the variance as amended for excessive lot coverage as shown on the Site Plan prepared by Jeffrey Zahn, Architect, last revised July 24, 2020. SUBJECT TO THE FOLLOWING CONDITION: 1. The applicant must install a sanitary system approved by the Suffolk County Dept of Health Services for the proposed reconstruction of the residence and the accessory garage. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three Page 4, September 17,2020 #7346,Myftarago SCTM No. 1000-142-1-11 (3)years from the date such variance was granted. During the July 9 public hearing,the Board asked that your design professional amend the plans to depict an increase in the side yard and rear yard setbacks to the garage, and/or reduce the size of the garage or the dwelling in order to create a less nonconforming lot coverage. The existing rear yard is .2' (3'-0" required) and the existing side yard is 1.5' (3'-0" required). The existing garage has been replaced in kind and on the foundation of the previous dilapidated garage. The requested'setbacks are in character with the neighborhood. Refer attached photo of detached garage located on lot 1000-142-1-9 also indicated on SP-1. For the proposed dwelling we are seeking a lot coverage variance, where a maximum of 20% is allowed. The existing dilapidated dwelling has a footprint of 1,053s.f. and the garage is 400s.f. for a total footprint of 1,453s.f. (24.19%). The proposed dwelling has a footprint of 1,248.68s.f. plus the garage is 400s.f. for a total proposed footprint of 1,648.68s.f. (27.45%). The difference in lot coverage of the existing and proposed is 195.68s.f. (3.26%). The structure is a safety concern, a blight to the surrounding homes and is not structurally sound and beyond repair. CHAIRPERSON WEISMAN : I'm just going to say one more time we're looking at an as built accessory garage with a single side yard setback at 1 foot 5 inches and a rear yard setback of 0.2' inches where the code requires a minimum of 3 feet and you're enlarging the footprint proposedly of the new dwelling which is the old one to be demolished that will bring the lot coverage up from a currently non-conforming 24.9%to 27.45%. Is that correct? JEFF ZAHN :That is correct. CHAIRPERSON WEISMAN : Can you begin by explaining why you have to increase the lot coverage since you're demolishing the house?Why can't you keep it the same size? JEFF ZAHN : We could keep it you know it's 195 sq. ft. larger than what was there. We did push back. because the existing house is 6.5 feet or 6.3 feet off the front property line. In conformance with the average front yard setback we are now at 14 % feet and just to get the house with the square footage with the four bedrooms that my client wishes for that was the size of the footprint of the house that was required.`So we were hoping that we would be able to get a variance for the lot coverage being that the existing house is 24.19% over the 20% you know in lieu of the 20% that is permitted. I'm sure you guys have seen the house. It's really in quite disrepair. CHAIRPERSON WEISMAN : Oh we've seen it alright. JEFF ZAHN : It's bad, really bad. CHAIRPERSON WEISMAN : We understand. JEFF ZAHN : In fact when my client first contacted me he wanted to actually you know try to / refurbish and you know obviously it's not even a possibility to do that. JEFF ZAHN : It's actually 14.5 feet and that's to the covered porch so it's actually the front fagade of the house is actually 17 feet, 17%feet. CHAIRPERSON WEISMAN : Is that conforming? MEMBER LEHNERT : Let me ask you the next question, if we didn't approve the lot coverage you know where would you take it from the house or the garage? JEFF ZAHN :That's a good question. (asking his client) MEMBER LEHNERT : I know what you want to do I'm just you know like I said I hate when someone comes in with a blank slate there's this close and you know were asking for a lot coverage. JEFF ZAHN : The unfortunate thing is it's a small lot, it's only 66 feet wide so it's not a large lot in any way but that is a good question as far as you know with the one that you posed with the garage. I'm sure you guys know the history of this. My clients they bought the house a little over a year ago. The garage was dilapidated also and he rebuilt it not realizing he needed permits to rebuild what was there so he was just matching basically the footprint of the existing garage. CHAIRPERSON WEISMAN : Well we also you know we've seen the property as you know Jeff and you know the garage is where it is. It was not appropriate for him to rebuild it with that kind of setback. Is he going to repair or replace the existing fencing? You can't get a toothpick between the garage and that fence but at least it provides some screening from the adjacent properties. CHAIRPERSON WEISMAN : I'll tell you, if there are precedents that the Board can rely on for j non-conforming lot coverage that's helpful to your application but if none ekists then we are much more reluctant to go ahead and grant a variance that's actually 7 %% over what the maximum allows. You only have 25% now. Increasing it is a fairly big deal dnd I think it's not a bad idea to consider if you really want that house that badly 1 think Member Lehnert suggestion removing some of that-square footage to maintain the existing non-conforming lot coverage by reducing the size of the garage is probably the better compromise, How do you respond? I JEFF ZAHN : I think that's a good idea. I would go over that with my client but I think he would rather lose the square footage out of the garage than the dwelling. MEMBER LEHNERT:Well that would be your choice. CHAIRPERSON WEISMAN : The other thing though that I might point out, if in fact you're going to remove something from the garage it would most definitely be beneficial if you removed it from the back of the garage so that that setback which is now 0.2 becomes a more conforming setback increasing that setback.
