I have a memorandum from the Planning Board, "We have reviewed this request for a waiver and recommends denying the waiver based on concerns of public safety." That's all I have. SUPERVISOR RUSSELL: Who would like to address the Town Board on this local law? CAROLINE BURGHARDT: Good evening, my name is Caroline Burghardt and I work for Mr. Kiely, representing his firm. Our office is located on the Main Road in Mattituck. Mr. Kiely apologizes for not being here tonight, he was called away to a Mattituck Park District special meeting. I am here on behalf of applicant Wickham Road LLC owner of 12800 Main Road Matittuck who is seeking a variance on the subject moratorium for the reasons set forth in our October 21, 2019 letter. Inaudible the variance is being sought to have the moratorium in order to turn a vacant building, which has been in existence since 1950 into offices. (inaudible) on the subject property has caused an unnecessary hardship for the applicant. By one,preventing the applicant from making any financial return on his investment, if the building stays vacant, he Request for Waiver from Moratorium Public Hearing March 10, 2020 page 2 pays taxes on a parcel he cannot use. Inaudible of the subject property is one of the only improved commercial properties sitting vacant in the area encumbered by the moratorium. The variance will not alter the essential nature of the level of commercial (inaudible) but rather allow the property be in keeping with it and turn a vacant building from a blight to a productive, professional office. And lastly, the hardship here has not been self-created as the applicant owned the property prior to the imposition of the moratorium which acts of the sole impediment of the property use as a professional office. Therefore, it is respectfully submitted as the applicant clearly meets the criteria to justify the grant of the variance (inaudible) it should be noted that tonight we are not asking the Board to approve this project but rather just lift the moratorium of this property so we can go forward with the building. Do you have any questions? SUPERVISOR RUSSELL: I do but I would feel bad asking them of you, I would much rather the counsel be here so I am going to reserve my questions. JUSTICE EVANS: Can you point out the building? MS. BURGHARDT: It's this building. Inaudible. It was an office building. COUNCILMAN GHOSIO: What was that building? MS. BURGHARDT: It was an office building. SUPERVISOR RUSSELL: Liberty data? MS. BURGHARDT: Yes. Yes, they are looking to make that back building into (inaudible). SUPERVISOR RUSSELL: Inaudible. LYNN SUMMERS: Lynn Summers, 1290 Oriole Drive. I lived in that area for 40 years. Just out of curiosity, I know Mr. Kiely has his law office in one building, is this going to be connected to that building? MS. BURGHARDT: No, it's a separate building. MS. SUMMERS: It's a separate building for a separate client? MS. BURGHARDT: Yes, his neighbor. MS. SUMMERS: And what is the name of the company that is going to be there?Are they going to share that whole parking area? I am familiar with.... MS. BURGHARDT: I am not sure if they are going to share that parking area. Inaudible. COUNCILWOMAN DOHERTY: They still have to go through the planning process and the Planning Board would determine the parking and (inaudible)... SUPERVISOR RUSSELL: You know, honestly, and (inaudible) but I feel bad because I get a little confused when the statement said they weren't asking for a waiver for the moratorium but to lift the moratorium. MS. SUMMERS: Yes, that is a very...... SUPERVISOR RUSSELL: If that's exactly what their (inaudible) says, then I think that's an issue that has to be raised and discussed by the Board but my understanding was the application was for a waiver. MS. SUMMERS: Yes. Thank you. MS. GEIS: So I was just a little confused, I would definitely like to see the moratorium extended so that was just, I am just not sure if this is the proper time to express that or would you have a different meeting? SUPERVISOR RUSSELL: Well, we'll have a public hearing on the extension of the moratorium. That would be on the 24th but it's always okay to make comment on any issue. MS. GEIS: Yes, sure. Especially with the crazy traffic, crazy season coming up, I am definitely, I lived in Mattituck my whole life and definitely would hope that the moratorium is extended for at least another six months and hopefully we can figure out something (inaudible). Changing the use of this site from an apartment to an office will likely increase the number of cars and pedestrians that enter the site, and may put the health, safety and welfare of the public at risk. This parcel is located on the south side of State Route 25 at the intersection with Love Lane and Sound Avenue. The moratorium is in place to allow this and other nearby intersections to be studied for improvements to safety for pedestrians and traffic. This subject site will likely benefit from the results of the study as they relate to improved safety for its driveway entrance, as well as any pedestrians that might need to access it. Said disapproval was issued in connection with a building permit application submitted for the conversion of an existing building (with no change to the footprint), formerly a legal accessory apartment, into office space. The property is located at 12800 Route 25, Mattituck, NY and was previously the site of "Grabie Appliances" and "Liberty Data Systems" and is within a hamlet business zoning district, which it should be noted permits [b]usiness, professional, and governmental offices... (subject to site plan approval)". As you are aware, the Board on August 27, 2019, voted to extend the above referenced moratorium, and as such my client is unable to procure a building permit to effectuate the aforementioned conversion. Therefore, pursuant to §6 of the subject moratorium, let this letter serve as a request for a variance therefrom, due to the "unnecessary hardship" as described below: 1. My client cannot realizegn return,reasonable orotherwise,as the subject building is vacant and requires a variance from the moratorium in order to make any use of the property whatsoever. In order to realize any pecuniary benefit from the property a variance is necessary to procure the requisite site plan approval, building permit, and ultimately the certificate of occupancy in order to make the as of right office use. 2. The hardship is unique and does not apply to a substantial portion of the area as my client has one of the only vacant buildings on a historically developed commercial' property, amid the bustling Love Lane business hub. 3. The requested variance would not alter the essential character of the neighborhood, as again, the subject building has been in existence since prior to 1957, used in conjunction with retail businesses, namely "Grabie Appliances" and "Liberty Data Systems" etc.; and the office use is in absolute keeping with the commercial character of the neighborhood. 4. The unnecessary hardship was not self-created, but rather exclusively caused by,the moratorium,which is the sole impediment to development. Said disapproval was issued in connection with a building permit application submitted for the conversion of an existing building (with no change to the footprint), formerly a legal accessory apartment, into office space. The property is located at 12800 Route 25, Mattituck, NY and was previously the site of "Grabie Appliances" and "Liberty Data Systems" and is within a hamlet business zoning district, which it should be noted permits "[b]usiness, professional, and governmental offices... As you are aware, the Board on August 27, 2019, voted to extend the above referenced moratorium, and as such my client is unable to procure a building permit to effectuate the aforementioned conversion.
