Thank you. /ms Enclosures RESOLUTION 2020-331 myQa ADOPTED DOC ID: 16186 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO: 2020-331 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON JUNE 2,2020: RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott A. Russell to execute an agreement between the Town of Southold and Jonathan K. Farrar to perform services as a Fishers Island Bay Patrol, effective June 1, 2020 through December 31, 2020, at a compensation rate of$3,000.00,plus approved expenses, subject to the approval of the Town Attorney. Funds are available in A.3130.4.500.400 (Bay Constable- FI Harbor Patrol). Elizabeth A. FISHERS ISLAND BAY PATROL AGREEMENT THIS AGREEMENT made this 16 day of June, 2020, by and between the TOWN OF SOUTHOLD, a municipal corporation of the State of New York, having its principal office at 53095 Main Road, P.O. Box 1179, Southold, New York 11971-0959 (hereinafter the "Town") and JONATHAN K. FARRAR, with an address at 173 Hinkley Road, Milton, MA 02186, (hereinafter"Farrar"). WHEREAS, pursuant to Town Board Resolution No. 2020-331, adopted on June 2, 2020, the Town agrees to contract for Farrar's services as a Fishers Island Bay Patrolman; and WHEREAS, the term of such service shall be effective on June 2, 2020 through December 31, 2020; and WHEREAS, the duties of Bay Patrol shall be completely performed by White to the satisfaction of the Fishers Island Harbor Committee and the Town Board of the Town of Southold and White shall be assigned specifically to the areas in and around the Town at Fishers Island; and WHEREAS, these duties include patrolling the waters in and around Fishers Island, making reports as necessary, assisting law enforcement i personnel in a civilian capacity, assisting the residents and visitors of Fishers Island in maintaining the peace and safety of the waters and contiguous areas in and around Fishers Island. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. The Town will pay Farrar at the prorated amount of $3,000.00 per annum effective June 2, 2020 through December 31, 2020. -1- 1 2. Ferrar will provide a boat for the purpose of performing the duties of Bay Patrolman. 3. The Town will reimburse fuel required for the operation of the boat up to fifty (50) gallons per year while performing services for the Town; provided timely proof of mileage and fuel usage is submitted for the Town's review. Any amount in excess of fifty (50) gallons may be reimbursed at the sole discretion of the Town Board only upon good cause shown and provided the request for reimbursement is made in a timely manner and accompanied by proof of mileage and fuel usage. 4. The Town will pay reasonable costs for servicing the motor of the boat actually used while performing services for the Town. Proof of servicing must be provided before reimbursement will be made by the Town. In no event shall the Town pay more than $250.00 per annum. 5. The Town will NOT reimburse Ferrar the cost of dock space, dockage fees, registration, insurance, or any other expense not specifically addressed herein. 6. Farrar agrees to comply with all stated standards of performance, policies, rules and regulations of Bay Patrolman, as specified by the Fishers Island Harbor Committee and the Town Board of the Town of Southold. -2- 7. This Agreement may terminate upon the occurrence of any of the following events: (a) failure to perform duties satisfactorily to the Town Board or the Fishers Island Harbor Committee after notice thereof; (b) for just cause based upon non-performance of duties by White; or (c) upon four(4) weeks written notice by either party. w IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed on the day and year first above written.
