Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of in an authorized solid waste management facility. These materials shall be suitably stabilized as not to re-enter any water body, wetland or wetland adjacent area. 7. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities, 8. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 9. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation(grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination, to. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 75 linear feet from the tidal wetland boundary, or as per the NYSDEC-approved plan, prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 15. Runoff Directed to Upland Drywells Roof runoff shall be directed to drywells a minimum of 75 linear feet landward of the tidal wetland boundary for immediate on-site recharge. 16. Driveway/Parking Area of Pervious Material Driveway and parking areas shall be constructed of NYSDEC-approved pervious materials. 17. Direct Runoff Away from Tidal Wetland and Buffer Roads, driveways, and parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer areas. 18. Authorized Innovative/Alternative Onsite Wastewater Treatment Systems (l/A OWTS) Septic Systems This permit authorizes the installation of any models of I/A OWTS septic system which have received the approval of the Suffolk County Department of Health Services (SCDHS). If SCDHS rescinds its approval of one or more of these models during the term of this permit, DEC will no longer approve new installations of that model. The list of I/A OWTS systems which have received approval by SCDHS are found on the Suffolk County Website under the Reclaim Our Water-Homeowner section at: Overview of Provisionally Approved Technologies. 19. Maintenance of Installed Innovative/Alternative Onsite Wastewater Treatment Systems (I/A OWTS) The permittee must maintain, service and repair the installed I/A OWTS in accordance with the maintenance schedule set forth in the Suffolk County Department of Health Services (SCDIIS) permit issued for the system. 20. Plant Beach Grass American Beach Grass must be planted 12 inches on center on all restored seaward beach slopes. 18 inch centers may be used on landward slopes and level grades. The permittee shall maintain plantings at a minimum survival rate of at least 85%for a period no less than 5 years. 21. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt curtains (or other NYSDEC approved devices) placed on the seaward side between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods. 22. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional condition until the project has been completed and the area has been stabilized. 23. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, p and no claim or right to compensation shall accrue from any such damage. 24. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested.- A. uggested.A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 5. Because the Geomats occupy a smaller footprint and could thus be rotated roughly 90 degrees while still maintaining SCDHS-required setbacks,the nearest component of the absorption field can also now be situated 80 rather than 74 feet from the wetland boundary to the north. Reductions in the proposed elevations associated with the modified sanitary system also allowed the total required fill volume to be decreased from the previously proposed 150 to 85 cubic yards. In addition to incidental adjustments to the proposed gravel driveway and masonry steps adjacent to the modified absorption filed, an additional, unrelated design change is the replacement of the previously proposed 137 sf roof over the waterside deck with a trellis of the same dimensions. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 16, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.The LWRP Coordinator issued a recommendation dated February 27,2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, since the prosed new dwelling will be FEMA compliant, thereby mitigating the impacts of flooding, and based upon the conditions imposed herein, the Board now finds the action to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION-.-N. The parcel is a non-conforming 7, 875 square foot waterfront parcel located in an R-40 zone with 60 feet of frontage on Great Peconic Bay. A17DLITlONAt INFORMATION: As per testimony from agents of the applicant,the following is found to be true. A variance for the lot coverage for as -built construction was issued in January 2016, ZBA file # 6908, approving the lot coverage of 25.7%. The applicant also proposed a new IA Septic system for the property, and FEMA compliance. On March 18, 2020, the applicant's representative submitted a revised site plan, floor plans and elevations, last revised March 13,2020,to reflect amended elevations as discussed during the public hearing. FIND NGS`OF.FACT/REASONS FOR BOARD`,ACTIONN The Zoning Board of Appeals held a public hearing on this application on March 5,2020 at which time written and ; oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law. 267-b(3)(b)(1). Grant of the variances or will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family water front ; homes. The proposed replacement of the existing home is in keeping with the character of the existing ' neighborhood since many of the original waterfront cottages have been re-built and enlarged in recent years. 2. Town Law 426:7-b(3)'b)(2). -The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject property is very narrow and the construction of any reasonably modest sized dwelling on the property would require variance relief. 3. Town La*-X267=b(3){b1(3}. The variance granted herein for the proposed lot coverage is not t mathematically ^ substantial, representing 3% relief from the code.The variance granted herein for the proposed combined side yard setback is mathematically substantial representing 14. 8% relief from the code. However, the proposed combined setbacks and lot coverage remain the same as the existing dwelling currently on the property and, because of the increase to the properties buildable land area since 2016 due to environmental factors, maintaining;the existing dwelling's footprint of 2000 square feet, actually results in a proposed decrease in lot coverage to 20.6 percent from the prior ZBA variance(96908)for 25.6% lot coverage. 4. ,Town Lair° X267-b(3)(b)(4), No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed dwelling will be FEMA compliant, and raised to the appropriate Ievels, thereby mitigating the impacts of flooding; and the proposed LA septic system will mitigate nitrogen loading in the local waterways. Specifically, the new dwelling, which will be raised to a FEMA-compliant base flood elevation, has been designed in approximately the same location as the existing dwelling with no increase in lot coverage, thereby creating minimal disturbance outside the presently developed portion of the property; minimal change in existing drainage and runoff patterns; and little to no encroachment on existing setbacks associated with the tidal waters of Great Peconic Bay to the south and vegetated tidal wetlands to the north on the opposite side of Beachwood Road. In fact, most of the dwelling is located more than 100 feet from wetlands, as the dwelling is located 114 feet from wetlands to the north and 90 feet from mean high water to the south, the same setback as the existing dwelling. A significant portion of the house is located outside Chapter 275 jurisdiction entirely. The project also includes additional mitigation measures designed to further the goals of protecting and improving water quality and protecting the quality and function of the surrounding shoreline and wetland ecosystems, consistent with LWRP Policies 5 & 6, including: a. The existing nonconforming septic system will be replaced farther landward with a low-nitrogen, innovative/alternative sanitary system (FA OWTS) in the front yard, where it will remain downgradient of the tidal wetlands to the north and almost 180 feet from the surface waters of Great Peconic Bay. Unlike conventional septic systems, the FA OWTS is designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters by using aerobic and anaerobic bacteria to convert organic nitrogen to nitrite and nitrate and then gaseous nitrogen into the atmosphere. b. A new drainage system consisting of leaders, gutters, and leaching galley drywells will be installed to collect and recharge roof runoff. c. The patio areas proposed to the side and front of the new dwelling are designed as pervious gravel patio areas to minimize impervious surface area and potential surface runoff. - d. Specifically, the new dwelling, which will be raised to a FEMA-compliant base flood elevation, has been designed in approximately the same location as the existing dwelling with no increase in lot coverage, thereby creating minimal disturbance outside the presently developed portion of the property; minimal change in existing drainage and runoff patterns; and little to no encroachment on existing setbacks associated with the tidal waters of Great Peconic Bay to the south and vegetated tidal wetlands to the north on the opposite side of Beachwood Road. In fact, most of the dwelling is located more than 100 feet from wetlands, as the dwelling is located 114 feet from wetlands to the north and 90 feet from mean high water to the south, the same setback as the existing dwelling. A significant portion of the house is located outside Chapter 275 jurisdiction entirely. The project also includes additional mitigation measures designed to further the goals of protecting and improving water quality and protecting the quality and function of the surrounding shoreline and wetland ecosystems, consistent with LWRP Policies 5 &6, including: a. The existing nonconforming septic system will be replaced farther landward with a low-nitrogen, innovative/alternative sanitary system (UA OWTS) in the front yard, where it will remain downgradient of the tidal wetlands to the north and almost 180 feet from the surface waters of Great Peconic Bay. Unlike conventional septic systems, the UA OWTS is designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters by using aerobic and anaerobic bacteria to convert organic nitrogen to nitrite and nitrate and then gaseous nitrogen into the atmosphere. b. A new drainage system consisting of leaders, gutters, and leaching galley drywells will be installed to collect and recharge roof runoff. c. The patio areas proposed to the side,and front of the new dwelling are designed as pervious gravel patio areas to minimize impervious surface area and potential surface runoff. d. A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction. e. Any naturally vegetated area on the waterside of the proposed dwelling that may be disturbed for the purpose of installing the proposed leaching galleys will be restored to its pre-construction condition and revegetated with Cape American beach grass. u See attached addendum.
