AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on December 21. 2020
and in consideration of application fee in the sum of$250.00 paid by Timothy McManus and subject to the
Terms and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits
the following:
11111 Wetland Permit to install a 151x25' in-ground swimming pool; pool safety fencing; and a 100' long
retaining wall; establish and perpetually maintain a 101 wide non-turf buffer seaward of the retaining
R wall; and as depicted on the survey prepared by Nathan Taft Corwin,III Land Surveyor,received on
November 20,2020,and stamped approved on December 21,2020.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Sea]to be affixed,and these
presents to be subscribed by a majority of the said Board as of the 21 st day of December,2020.

TERMS AND CONDITIONS
The Permittee Timothy McManus residing at 7725 Nassau Point Road Cutchogue,New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Pawlowski:
The Board of Town Trustees took the following action during its regular meeting held on
Monday, December 21, 2020 regarding the above matter:
WHEREAS, Paul Pawlowski on behalf of TIMOTHY Me-MANUS applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated February 11,
2020, and,
WHEREAS, said"application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 14, 2020, November 18, 2020 and December 21, 2020, at which
time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS the Board has determined that the project as proposed will not affect'the
health, safety-and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of TIMOTHY
McMANUS to install a 15'x25' in-ground swimming pool; pool safety fencing; and a 100'
long retaining wall; establish and perpetually maintain a 10' wide non-turf buffer
seaward of the retaining wall; and as depicted on the survey prepared by Nathan Taft
Corwin, III Land Surveyor, received on November 20, 2020, and stamped approved on
December 21,'2020.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within-six months of the
date of this notification.
Inspections are requited at'a fee of$50.00-per inspection. (See attached schedule.) '

With reference to the items you requested
Plan details, please see site plan showing cross section and height of retaining wall
Fill required will be 40-50 yards of clean topsoil material.
As for the 10' wide non-turf buffer please see site plan, please note we plan to plant native
dune grass in that area.
When it comes to final grade of the neighbors there will not be much needed as the grade
tappers up on the sided and the wall will naturally die into the neighboring grades which will
not cause any need for retention.
Fencing, currently there is pool code complaint gates on the sides of the house already, there is
most of the rear sides yards have a 4' wide fence that is pool compliant, we plan to continue
the same fence down to the bulkhead which will then be conde compliant and a 4' tall barrier
entering all sides of the property. At the main bulkhead stairs will be a pool compliant gate.
Please see attached plan showing location. The fence is 4" tall with 3.5 inch spacing between
spindles.

I am sorry, but as per Town Code Chapter 55-Noticing of Public Hearings (which was in your noticing packet), all mailings
and postings needed to be performed at least seven days prior to the date of the public hearing. In other words you
should have mailed out the notices and posted the sign on the property no later than this past Tuesday,September 8,
2020.
Because you sent out the mailings today, it does not meet the minimum requirements of the Town code Ch.55 and this
forces the application to be tabled to our October 14, 2020 public meeting date.
Also, please note that the Affidavit of Posting form should not be completed until the green sign has been posted on the
property for at least seven (7) days. On the eighth (8) day or after should this form be filled out.

Paul Pawlowski on behalf of TIMOTHY McMANUS requests a Wetland Permit to install a 15'x25'
in-ground swimming pool; pool safety fencing; and a 100' long retaining wall. Located: 7725
Nassau Point Road, Cutchogue. SCTM# 1000-118-4-5
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP provided the following is considered:
1. Clarify the need to replace the retaining wall. If replaced, an existing vegetated buffer
will be removed. Require that the vegetated non-turf buffer be re-established. A ten-foot
wide non-turf buffer was required in Wetlands Permit 1031 C.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

To Whom It May Concern:
We would like to install a 15x25 in ground pool in our rear yard, please note that we are
proposing it at the furthest point landward from the water that we can possibly do in the rear
yard, the pool equipment will be placed over 100' from the bulkhead along with the pool wash
out that will go into preexisting drywell
We would also like to install a small retaining wall that will be similar to the secondary bulkhead
wall.fiwill go in the ground roughly 4' and come even with the existing grade. Between this
proposed wall and the existing secondary bulkhead, we will be planting native beach grass.
This will help with runoff and potential erosion
