That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause " for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Country Road Brookhaven, NY 11719 RE: MATTITUCK PARK DISTRICT VETERANS MEMORIAL PARK 11280•GREAT PECONIC BAY BOULEVARD, -MATTITUCK SCTM# 1000-126-6-18 Dear-Mr. Dwyer: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 14, 2020, regarding the above matter: . WHEREAS, L.K. McLean Associates, P.C., on behalf of MATTITUCK PARK DISTRICT applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,,the Wetland Ordinance of the Town of Southold, application dated March 9, 2020, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 14, 2020, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of MATTITUCK PARK DISTRICT to demolish one building (148sq.ft. yellow shed), and to construct a new 250sq.ft. comfort station for those residents and tourists utilizing the park/beach which' will include a conventional foundation, ADA accessible walkways, a new sanitary manhole with pump, electric/water service from,pavilion, and restoration proposed to disturbed areas using,native beach grass; and as depicted on the site plan prepared by .L.K. The Mattituck Park District proposes to demolish one building and construct a new comfort station for those residents and tourists utilizing the beach at Veterans Memorial Park, located at 11280 Peconic Bay Boulevard in Mattituck, NY. Veterans Memorial Park is Mattituck Park District's main recreational facility, featuring open recreation areas, a playground, a beach, pavilion and on-site parking lot. The proposed comfort station will feature modern plumbing and lighting fixtures, thereby reducing energy use and water consumption at the facility. It will be fully ADA-compliant and accessible, thereby increasing public access to the waterfront, in accordance with the goals the Town of Southold's LWRP and New York State's Coastal Management Policies. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III—Policies Pages 3 through 6 for evaluation criteria. Construction shall avoid disturbance or adverse effects on any object of archaeological or paleontological interest situated' on or under lands that may be discovered during the construction and demolition phases. Proposed comfort station shall be similar architecture of existing surrounding buildings. Policy 3.Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III—Policies Pages 6 through 7 for evaluation criteria. The building to be demolished had been used as a shed. The proposed comfort station will be designed in accordance with traditional coastal architecture. The structure and foundation type was selected to minimize disturbance to the natural conditions at the park. The land surrounding the proposed comfort station will be kept graded in accordance with surrounding grades (within ADA compliance), and planted with 1,625 sf of native beach grasses. No existing trees, shrubbery, or natural plant life will be disturbed. Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria. The proposed comfort station will be a pre-fabricated concrete building installed on a slab on grade, and will be designed in accordance with current local, state and federal building codes. It is a non-habitable structure that will withstand most forces associated with flood waters, and the first floor elevation is proposed to be above the base flood elevation of 6.0 feet By keeping the structure within .5' of the grade, the area to be disturbed as a result of ADA compliance is minimized, and overall disturbance to soil structure is minimized, thereby reducing potential impacts from flooding events. The prior comfort station had been connected to an aged on-site sanitary system, whereas the proposed comfort station will be connected to the newer SCDHS- approved sanitary system,which is in full compliance with all current Suffolk County Department of Health water quality regulations, thereby minimizing adverse effects to water quality The proposed comfort station will feature modern plumbing and lighting fixtures,thereby reducing energy use and water consumption in comparison with the prior structure. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife habitats and wetlands.See LWRP Section III-Policies; Pages 22 through 32 for evaluation criteria. The proposed building will be located landward from the bulkhead (and tidal wetlands), thus no coastal fish and wildlife habitat, or wetlands shall be disturbed during the demolition or the construction phase. The habitats adjacent to the project will be protected by improvements in stormwater and sanitary wastewater management described throughout this application. Policy 7.Protect and improve air quality in the Town of Southold.See LWRP Section III-Policies Pages 32 through for evaluation criteria. Construction will adhere to all regulations in air quality control, to prevent disruption to surrounding neighbors and areas. The proposed comfort station will not add to the air quality in a negative manner. There will be no change in air quality after construction. Policy 8. There will be no solid waste or hazardous waste generated by the proposed facility. Sanitary wastewater will be handled by a more modern system in accordance with current water quality standards.
