Wood, residing at 1000 First Street New Suffolk New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. WOOD 1000 FIRST STREET, NEW SUFFOLK SCTM# 1000-117-7-32 Dear Mr. Cole: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 28, 2020 regarding the above matter: WHEREAS, Cole Environmental Services on behalf of ALBERT G. WOOD applied to the Southold Town Trustees for a permit under the provisions of Chapter,275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 7, 2020, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 28, 2020, at which time all interested persons were given an opportunity to be heard, and, j WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of ALBERT G. WOOD to remove an existing concrete seawall and install a 133± linear feet of new 6' wide angled rock revetment to be constructed as follows; 8.0' of along north property line, 6.6' of stone armoring landward of existing bulkheading, 16.4' along north east corner, 75.4' along east side fronting Cutchogue Harbor, 11.8' along south east corner and 15.2' return along southern property line. Back fill with approximately 69 cubic yards of clean upland fill, install 6.0' of splash apron landward of the. revetment and 10' of planted beach grass on 1.0' centers. Wooden bulkhead within the subject property to be modified to elevation 5.9 at point of intersection with revetment. Concrete seawall debris to be'trucked to an NYS approved upland disposal facility; and as-depicted on the site plan prepared by Michael K. Dunn, R.A., received on September 25, 2020, and stamped approved on October 28, 2020., Permit to construct and complete project will expire two years from the date the permit is signed. I was pleased to see this property being looked after and cleaned up this summer. In August, Mr. Wood installed a split rail fence around his property. Before the fence, this property served as a de facto parking lot for Legends employees, customers, as well as for attendees of the Waterfront Fund Events. In his 2017 application for the fence,Mr. Wood rightly noted that the fence was required to "prevent unauthorized access to property and to prevent dumping of unauthorized junk." Mr. Wood is correct that his property has been subject to significant erosion. The high tides on First Street have been much higher than they were decades ago, and where there used to be plenty of beach,there is now very little. The town recently installed a rock revetment at the Orchard Street road end after high tides and storm surges regularly breached the road. However, on the survey submitted with Mr. Wood's application, the "mean high tide mark" is cited as being accurate as of 1989. This measurement is very outdated and no longer applicable. If that high tide mark were accurate, Mr. Wood's property would not be experiencing erosion. My only worry with this application is the unintended consequences for King Street. The King Street road end is the only unprotected plot of land for a big stretch of the First Street waterfront. It is regularly flooded.A more substantial barrier on Mr. Wood's property would likely add to the funnel effect that already occurs during storms. Mr. Loria who previously owned Captain Marty's Fishing Station, now Peeko Oysters, expressed his concerns about flooding and drainage near this lot in his 2014 letters regarding the New Suffolk Waterfront Fund's plans. He wrote, "My property and the NSWF site are,historically, underwater on a good Nor'easter. These storms are common here. What many don't know is that the drainage on both properties is very poor, mostly because of the soil content. People think it's sand,but I know from past excavations that there is a layer of oyster shells that is thick and a impervious. This layer runs beneath Captain Marty's main building and the NSWF adjoining property and it impedes drainage." Mr. Wood's LWRP application states that debris will be removed that includes wood, concrete etc. He states, "These items, while not hazardous, do constitute physical debris that could add to water quality degradation. Removal of these items would minimize environmental degradation." I was surprised to see then,that the dilapidated shed on the property was labeled on the map to remain. Everything on both Mr. Loria and Mr. Wood's properties has been cleared except for this structure which sits between the two properties. It is very close to the water and completely falling apart. More importantly,Mr. Wood points out in his application that it does not have a C.O. I do not know who owns or is responsible for this structure. But, if it does not have a C.O. it should be removed. I would hate to think that this dilapidated shed would someday be labeled a pre-existing structure in some future application by either Mr. Wood or Mr. Loria.As it is, it is very hard to understand why it has not already been cleared from the site. It should be noted that this August,Mr. Loria rebuilt his bulkhead and did extensive excavation on his property without a Trustee permit or inspection. This work may or may not have implications for Mr. Wood's property and application as the two properties share a shoreline. I do not know what Mr. Loria or Mr. Wood's plans are for their properties.After years of neglect, it has been shocking to see how quickly both properties have been put in order. I would only ask that they both follow proper procedures and that the Board do their due diligence in considering their applications. Lastly, I would ask that the Board require a copy of permits from the NYSDEC before any work begins on Wood's property. I have enclosed four pages of photos.
