That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee,will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. No right to trespass or interfere with riparian rights. OnUNT1 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD October 19, 2020 Chris Rivera - 250 Sound Beach Drive Mattituck, NY 11952 RE: PANAYIOTIS & PANAGIOTA BASIOS 2505 SOUNDVIEW AVENUE, MATTITUCK SCTM# 1000-94-1-12.2 Dear Ms. Rivera: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 14, 2020 regarding the above matter: WHEREAS, Chris Rivera on behalf of PANAYIOTIS & PANAGIOTA BASIOS, applied -to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 9, 2020, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 16, 2020 and October 14, 2020, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the - Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town`, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the'application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of PANAYIOTIS & PANAGIOTA BASIOS to construct an'approximately 30'x50' in-ground swimming pool; pool patio pavers around pool approximately 60'x50'; and pool enclosure fencing to be added to existing fencing with a gate; and as depicted on the survey prepared by Young & Young, last dated September 23, 2020, and stamped approved on October 14, 2020. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 18, 2019 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 23, 2020. Based upon the information provided on the LWRP Consistency Assessment Form as well as the records available describing a top of the bluff setback for the inground swimming pool of 45 feet, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. The following is a summary of LWRP comments: Policy 1: The Long Island Sound bluff systems within this area are traditionally unstable and experience periods of normal and accelerated erosion. There is room on the property to locate the pool near the house thereby increasing the setback to the top of bluff. Policy 4: The Town Board of Trustees requires a setback of 50 feet from a pool and related structures to a top of bluff. Policy 4.1: In order to minimize potential loss and damage, structures should be located as far from erosion hazards as possible. It is recommended that the pool is relocated to achieve the greatest setback from the top of bluff. Policy 6.3: Development on or near bluff ecosystems has resulted in loss and impairments to these and other dependent natural features (beaches) and their functions; cumulatively impacting the Town of Southold's ecosystem. Based upon the aforementioned comments by the LWRP Coordinator, the Board requested that the applicant relocate the pool to a more conforming location in order to mitigate the described adverse impacts to the environment. The applicant submitted a survey, last revised February 6, 2020, depicting an amended location and design of the proposed swimming pool, setback 76 feet from the top of the bluff. Given the increased setback from Page 2,February 20,2020 #7364,Basios SCTM No. 1000-94-1-12.2 the bluff proposed in the amended application AND THE CONDITIONS IMPOSED HEREIN, the Board finds the proposed action to be CONSISTENT with the UAW. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred to Suffolk County Soil and Water Conservation District(SCS&WCD) for review and comment and the agency issued its reply received February 19, 2020 indicating an inventory, evaluation and site visit had occurred on February 18, 2020. Agency comments include: • Irrigation located throughout the property should be monitored and regularly maintained to eliminate the risk of erosive runoff and ensure stability of the bluff face. • It is essential for the health of the bulkhead and stability of the bluff to perform regular maintenance on the structure. • Installation of a pool is a ground disturbing a6tivity. It is important to use caution during any type of construction in close proximity to the bluff. Compaction from heavy machinery should be minimized by creating and utilizing necessary paths to enter, work and exit the property. Areas that have experienced disturbance of vegetation should be revegetated with plant species native to the ecology. • Heavy equipment should not be stored near critical areas of bluffs or near any unstable soils. • Water runoff is a major contributor to bluff destabilization. It is advised to vegetate bare soil with native species to mitigate the effects of stormwater runoff. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 41,894 square foot parcel located in an R-40 Zoning District. The parcel has 102.53 feet of bulkhead frontage along Long Island Sound. The parcel measures 105.00 feet fronting Sound View Avenue, along the southerly property line, measures 395.43 feet along the westerly property line, and measures 416.71 feet along the easterly property line. The parcel is improved with a two-story concrete dwelling and garage, a concrete deck and a second story concrete deck. There is also a staircase going down the bluff which includes a wood walkway and two landings. All is shown on a survey prepared by Howard W. Young, L.S. last revised February 6,2020. BASIS OF APPLICATION: Request for a Variance from Sections 280-116(A)(1) and the building inspector's September 25,2019 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool at, 1) located less than the code required 100 feet from the top of the bluff; located at 2505 Soundview Avenue, (Adj. to the Long Island Sound)Mattituck NY. SCTM# 1000-94-1-12.2 RELIEF REQUESTED: The applicant requests a variance to construct an accessory in ground swimming pool located 45 feet from the top of the bluff where the Town Code requires a minimum 100-foot setback from the top of the bluff. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 11, 2020 submitted a survey last revised February 6, 2020 increasing the bluff setback to 76 feet thereby bringing the plan into more conformity with the Town Code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3,February 20,2020 #7364, Basios SCTM No. 1000-94-1-12.2 1. Town Law &267-b(3)(b)(1). Grant of the variance as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family waterfront homes setback 100 feet or more from the top of the bluff. Swimming pools in code conforming locations are characteristic in this neighborhood. However, the placement of the existing home does not leave space to construct a swimming pool in a rear yard location and still meet the code required minimum 100-foot setback from the top of the bluff. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could build a swimming pool located in the side yard in order to meet the code required minimum 100 foot setback from the top of the bluff, or in a code conforming front yard if the sanitary system is not located there. However, the proposed 76-foot bluff setback is the minimum distance from the bluff that is practical to allow the pool to be placed in the code permitted rear yard. 3. Town Law &267-b(3)(b)(3). The variance as Amended granted herein is mathematically substantial, representing 24% relief from the code. Additionally, the relocation of the swimming pool partially located in the side yard is mathematically substantial representing 100% relief from the code. However, the house is exists and the applicant is proposing the minimum practicable bluff setback while constructing the pool in the code conforming rear yard. 4. Town Law 4267-b(3)(b)(4). Comments received from the LWRP coordinator suggest that a variance in this residential community may have adverse impacts on the physical or environmental conditions in the neighborhood. The coastal area may be adversely affected by structures that are located in close proximity. The applicant has attempted to mitigate any possible impacts by increasing the top of bluff setback to 76 feet. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of relief As Amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT RELIEF AS AMENDED as follows for a swimming pool located 76 feet from the top of the bluff and shown on the survey prepared by Howard W.Young, L.L.S. last revised February 6, 2020.
