Although the federal government is not subject to local zoning laws,the OPF is within the Marine U District(MU)zoning designation-a district which is shared by the two abutting properties:Orient by the Sea Marina and the Cross Sound Ferry. The MII zoning designation allows for uses such as a one-family dwelling,marina,or retail space associated with waterfront uses and uses permitted by special exception including restaurants,ferry terminals,transient hotels,and other uses associated with waterfront uses. The Zoning Amendment targets the OPF by restricting the as-of-right use to a ferry terminal for service to and from Plum Island with a limited number of accessory uses(ticket office,waiting area,parking, storage,and museum).This change would prohibit any viable redevelopment of the OPF other than allowing for the construction of a structure to support the ferry service.We are concerned that the Zoning Amendment,targeting a single parcel,may constitute unlawful spot zoning.
