You informed us that your client could not be contacted so the public hearing was rescheduled for March 5, 2020. On February 18, 2020 Jeffrey Sperling informed us via email correspondence that the applicants could not be reached, and were unavailable, so we adjourned the hearing without a date. In our letter dated February 28, 2020, we asked that you contact us once you are able to communicate with your client so that we can reschedule another hearing date. Because we have not heard from you and the application has been open and inactive for approximately eight months,the file is now considered withdrawn, and any further relief that the property owner might require, will have to be done as a new application with a new Notice of Disapproval. An assessment of this property has been conducted. This single-family dwelling is located adjacent to the bluff, facing the Long Island Sound, in a residential/agricultural area. The site proposal for this location is for the demolition and reconstruction of an existing deck on the dwelling on the backside of the property—facing the bluff. This document contains information on what has been observed in relation to potential bluff erosion issues. A site visit was conducted on September e, 2019, in response to your request to review and evaluate a proposal for the parcel located at 340 Castle Hill Road, Cutchogue. The proposal has been previously disapproved for the following reasons: The proposed construction is not permitted pursuant to Article XXII Section 280-116A(1), which states: "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The construction notes a setback of+/-76 feet from the top of bluff, at its closest point. Office Hours:Monday through Thursday 7:30 a.m.to 4:00 p.m. I+nday 7:30 a.m.through 3:00 p.m. RECEIVED 13�-'J 3 OCT 0 3 2019 Zoning Board Of Appeals Observations and Current Conditions: The front, sides, and back yard of this property were very well-vegetated with turf grass. Around the dwelling and the front of the property,was landscaped with ornamental plant species and mulch bedding. There was bare soil underneath the deck which did show some signs of runoff. A majority of the back end of the property, towards the top of the bluff, was covered with an ornamental shrub. The dwelling had gutters, downspouts, drywells, and PVC piping for collecting and conveyance the stormwater runoff away from the dwelling and the bluff. Irrigation heads were observed in the front yard; a few irrigation heads could be seen on the side and back yards. Along the edge of the shrubs. Irrigation lines have a potential of causing runoff issues especially if they're on or close to the top of the bluff. It is important to note that despite there being runoff issues from the bare-soil under the deck; the whole property is sloped from the top of the bluff,towards the front yard and street. The only observable runoff issue is shown to be traveling along the edge of the mulch bed towards the front of the property, away from the bluff. The stairway on the bluff was in moderately good condition. Approximately halfway down, a dozen tires were spotted on the bluff to either side of, and underneath the stairway. Towards the bottom of the stairway and at the toe of the bluff exists a fortified wooden bulkhead. The bulkhead is in great condition. Looking from the beach up the face of the bluff,the bluff from top to toe is steeply sloped, and considerably tall in elevation. There is evidence of invasive plant species such as mile-a-minute and bittersweet vine throughout the bluff,however,the bluff is extensively covered in native vegetation as well. So, it appears only about 10/20 percent of the bluff is covered with invasive species verses 80/90 percent covered with native species. RECEIVED �3q 3 OCT 03W9 Comments: Appeals [zoning Board Of App Based on the circumstances and current conditions of the bluff and property, it doesn't seem apparent that there are any existing major issues that are significantly impacting the bluff. Any current runoff issues do not current impact the bluff due to the slope of the property from the bluff towards the front of the property. To reduce runoff, it is recommended to cover bare soil and install any additional gutters, downspouts, and/or drywells as necessary. Invasive plant species threatened the stability of the bluff by outcompeting with the native bluff plant species. It is recommended that the invasive species are continuously monitored and eradicated as often as possible. Therefore, the proposed reconstruction of the existing deck is not likely to impact the bluff, as long as the construction process is careful not to cause any major ground disturbances. Please look at the additional information below for further recommendations. Additional Considerations prior to Construction: The demolition and construction process can raise concern for the stability of the bluff. Ground disturbances can have a negative impact. Minimizing soil disturbance is encouraged to lessen the overall impact of the activity. Undisturbed and vegetated areas should remain undisturbed if at all possible. Protection of existing vegetation should be clearly identified with bright colored ribbon and/or fencing prior to the start of construction. Additionally, stockpile locations, staging areas, and access points must be clearly defined to minimize impacts; and must be as far away from the bluff as possible. Any improvement that alters the natural course of drainage(ex: structures, impervious surfaces, conveyances)will increase the impact of stormwater runoff. Consideration should be taken to minimize the impact of runoff during and after construction. Erosion and sediment control measures should be implemented prior to ground disturbing activities. All efforts should be taken to vegetate and stabilize disturbed soils as soon as possible. This includes"cut and fill"plans as necessary. See NYS Standards and Specification for Erosion and Sediment Control (`Blue-Book")for additional control measures and considerations. Construction and the use of heavy equipment may impact the stabilization of soils. Vibrations from machinery as well as soil compaction have adverse impacts. Machinery should not be left to idle and only running when in use. The location and storage of such equipment should be as far away as possible from critical areas such as bluffs and any unstable soils.
