LG FINDINGS, DELIBERATIONS AND DETERMINATION Soul old Town Clerk MEETING OF AUGUST 20, 2020 ZBA FILE: 7392 NAME OF APPLICANT: George & Lynn Krug PROPERTY LOCATION: 1175 2nd Street,New Suffolk,NY SCTM No. 1000-117-7-20 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 6, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 5,500 square foot property located in an R-40 Zoning District. The property has a 50-foot frontage along Second Street, then runs west 110 feet to the rear property line. The property then runs south 50 feet before returning 110 feet to Second Street. The property is improved with an existing one- and one-half story single family residence with a shed in the rear yard as shown on the survey prepared by Michael W. Minto, L.S., last revised January 2020. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's December 16, 2019 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 10 feet; 3) located less than the code required minimum combined side yard setback of 25 feet; 4) more than the code permitted maximum lot coverage of 20%; located at: 1175 Second Street,New Suffolk,NY. SCTM No. 1000-117-7-20. RELIEF REQUESTED: The applicant requests variances for a proposed front yard setback of 22.1 feet where a minimum 35 foot setback is required by code; a proposed single side yard setback of 3 feet where a minimum of 10 feet is required; a combined side yard setback 11.1 feet where the code requires a minimum of 25 feet; and a proposed lot coverage of 23. 9%where 20% maximum is permitted by code. Page 2,August 20,2020 #7392,Krug SCTM No. 1000-117-7-20 ADDITIONAL INFORMATION: Testimony from the applicants/homeowners and from an adjacent neighbor in support of the application was taken during the public hearing. Letters from two of the neighboring property owners in support of this application have been received. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 9, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many of the residential structures in this neighborhood have pre-existing non-conforming setbacks and lot coverage. The majority of this application is for a second-floor addition that falls within the existing footprint of the house. The first floor living space addition on the rear of the existing dwelling is only 12.5 square feet, will not be seen from the street and maintains the pre-existing non- conforming setbacks of the subject dwelling. The proposed pergola addition in the side yard is an open structure and is not habitable space. Therefore, an undesirable change in the character of the neighborhood will not happen. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Any alteration to this pre-existing non-conforming house will need variance relief, even for additions to the second floor over the existing footprint. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, the lot coverage variance request represents 19.5% relief from the code; the front yard setback variance represents 36.85% relief from the code; the single side yard setback represents 70% relief from the code; and the combined side yard setback represents 55.6% relief from the code. However, the majority of the variance relief is for second floor additions that fall within the existing footprint of the residence. The side yard setback relief is for an open-air pergola that is not living space, but an overhead covering. 4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of first and second floor additions and alterations and an exterior pergola while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried,to Page 3,August 20,2020 #7392, Irug SCTM No. 1000-117-7-20 GRANT the variances as applied for, and shown on the survey prepared by Michael Minto, Land Surveyor, last revised January 2020, and Architectural Plans prepared by Charles Thomas, Architect, last revised January 22, 2020. SUBJECT TO THE FOLLOWING CONDITION: 1. The proposed pergola shall remain,unenclosed and non-habitable space. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has'not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. In your letter;you explain that the project was completed in June of 2021 and a final building inspection was conducted on August 2, 2021. Based upon the final inspection, it-was discovered that a newly installed pergola 'intrudes into the side yard setback 1.4 feet instead of the granted relief of 3 feet. Furthermore, itis your belief that,the pergola was built in accordance with the submitted and approved plans. I reviewed your letter, the revised site plan, and the Zoning Board of Appeals determination dated August 20, 2020, and have determined that your request is de minimus in nature because the change only slightly increases the degree of nonconformity and upholds the intent of the ZBA decision. Variances for this project were granted by the ZBA on August 20, 2020. The building permit, #45806, was issued on February 10, 2021. The project was completed in June and John Jarski of the Southold Building Department did the final inspection on August 2, 2021. We were alerted today by Mr. Jarski that, based on his review of our final survey, the overhang of our newly installed pergola intrudes into the required 3-ft side-yard setback by 1.4 ft. The columns supporting the pergola do meet the setback requirement. I've included a picture below for clarity. Lynn and I took another look at our documentation, and the pergola was built in accordance with the submitted and approved plans. We are very concerned that this issue has surfaced despite our efforts to ensure that everything about this project was done correctly. Mr. Jarski directed us to submit this "de minimus" request to the ZBA to resolve the issue, hereby respectfully submitted.
