The ZBA Chairperson and staff have consulted with the Planning Department staff and determined that the Planning Board will declare Lead Agency for the purposes of SEQR, once this variance determination is rendered. As of the date of this determination, the Planning Board has not asserted Lead Agency and therefore no determination under SEQRA has been made. Therefore, as set forth below, any grant of relief will necessarily be subject to the Planning Board issuing a"Negative Declaration"under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 30, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN OF SOUTHOLD PLANNING BOARD: The Planning Board offered comments on this application in their June 24, 2020 memorandum. The Planning Board summarized that the variance request is only 0.8 percent relief from the zoning code and that the creation of rental apartments in the proposed location for people over 55 years of age supports a large need in Southold Town and is consistent with the planning goals of the Town's Comprehensive Plan. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a vacant conforming 99,208 square foot parcel located in an Hamlet Business (HB) Zoning District. The parcel measures 147.31 feet fronting the Main Road (NYS Route 25) along the northerly property line, measures 671.78 feet along the westerly property line, measures 149.89 feet fronting Wells Avenue along the southerly property line and measures 664.12 feet along the easterly property line. All is shown on a survey prepared by John C. Ehlers, LLS, last revised October 8, 2019, BASIS OF APPLICATION: Request for a Variance from Article X, Section 280-46 and the Building Inspector's January 14,2020 Notice of Disapproval based on an application to construct a mixed-use commercial building with accessory apartments and four single family dwellings upon a 99,208 sq. ft. parcel; at, 1) one commercial and four Page 2,August 6,2020 #7387,Hard Corners Properties SCTM No. 1000-64-4-1 residential uses upon a single parcel measuring less than the minimum allowed 100,000 sq. ft. in total area; located at: 53530 Main Road, Southold,NY. SCTM No. 1000-61-4-1. RELIEF REQUESTED: The applicant requests a variance to construct five buildings on a 99,208 square foot parcel. According to the Town's bulk schedule in this zoning district, each building requires a minimum 20,000 square feet, or in order to construct the proposed five (5) retail and residential buildings, a minimum 100,000 square foot parcel is required. ADDITIONAL INFORMATION: The applicant is proposing a mixed-use development consisting of retail space, affordable rental apartments, and rental houses for tenants over the age of 55 years. Other developments in the neighborhood along Main Road include the Feather Hill Shopping Center, the Southold Library, the Bank of America Branch, Einstein Square, a drug store, offices, restaurants, antique and curio stores, other business uses, some with second floor apartments, and residences along Wells Avenue and Main Road. A letter objecting to the variance was received from an adjacent homeowner on July 7, 2020. A memorandum was received from the Town of Southold Planning Board on June 24, 2020 supporting the requested variance because the amount of relief is small, and because the need for affordable rental housing, especially in the hamlet centers, is supported by the Town's Comprehensive Plan. Prior to the Zoning Board of Appeals July 23, 2020 Special Meeting the applicant's representative contacted the ZBA office and requested that the Board grant the application a "conditional" approval subject to the Planning Board, as Lead Agency, issuing a "Negative Declaration" pursuant to SEQRA. At the July 23, 2020 Special Meeting the Board discussed the applicant's request. After a discussion with the Town Attorney, the matter was adjourned for the Town Attorney to research the issue and further advise the Board. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 9, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a mixed-use neighborhood consisting of single-family residences, retail stores, municipal buildings, restaurants, offices, and apartments. The proposed retail stores, apartments, and rental homes are in keeping with the character of the neighborhood. The proposed lot coverage is code conforming. 2. Town Law _4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could propose four larger buildings and accomplish the same goal of building retail space, affordable apartments, and rental homes. However,the Southern part of the parcel is part of the residential neighborhood and building several smaller buildings as opposed to larger buildings keeps the size and scale of the project in line with the character of the residential neighborhood. 3. Town Law X267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 0.8% relief from the code. Additionally, the development of affordable rental apartments in the HB zoning district is recommended in the draft of the Town of Southold's proposed comprehensive plan, Page 3,August 6,2020 #7387,Hard Corners Properties SCTM No. 1000-64-4-1 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of retail space, affordable housing rental apartments, and over age 55 rental houses while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Request for a Conditional Approval. The Board has a custom and practice of not closing a public hearing, no less granting a conditional approval, prior to a SEQRA determination and has concerns about setting a precedent by granting an approval conditioned on the issuance of a negative declaration. However, given the uniqueness of the application, the need for affordable housing, and other factors considered by this Board, the Board finds that an approval conditioned on the issuance of a negative declaration is appropriate in this particular situation based on the following: 1. The variance requested is exceptionally minor in that it represents less than one percent relief from the code; 2. The Planning Board favors the granting for the variance, because the relief is so minimal and because the need for affordable rental housing, especially in the hamlet centers, is supported by the Town's Comprehensive Plan; 3. This Board, also finds that the need for affordable housing, especially in the hamlet centers is currently great and that the granting of the relief requested with help facilitate affordable housing in this particular instance in that it will provide the applicant with some assurances that multiple modifications to the site plan will be less likely with a conditional approval from this Board; 4. The Town Attorney advised that in his opinion the granting of the relief requested conditioned on a "Negative Declaration" in this particular instance is appropriate and will have little precedence value on future applications. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Dantes, and duly carried,to GRANT the variance as applied for, and shown on the Site Plan and Architectural Plans prepared by Robert I. Brown, Architect, dated January 15, 2020 and labeled A1-A9. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The Planning Board, declares Lead Agency, and as such finds that the proposed action, as applied for to this Board, will have no significant or moderate adverse environmental impacts and issues a Negative Determination of Environmental Significance ("Negative Declaration)"pursuant to Part Page 4,August 6,2020 #7387,Hard Corners Properties SCTM No. 1000-64-4-1 617 of State regulations issued pursuant to Article 8 the State Environmental Quality Review Act of the Environmental Law issues a"Negative Declaration". 2) The units labeled as affordable rental apartments shall be rented to an individual who registers on the Town of Southold's affordable housing registry. 3) That the proposed uses and improvements receive Site Plan Approval by the Town of Southold Planning Board. That the above condition #2 be written into the Building Inspector's Certificate of Occupancy, when issued. This approval shall not be deemed effective until such time that the conditions cited above are met; and failure to comply with all of the said conditions will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. I own a house which abuts the area where four large scale houses are planned. I have studied the site plan and reviewed the NOTICE OF DISAPPROVAL of January 14,2020 from The Town of Southold to Robert Brown, Hard Corner Properties clearing stating that the plans have too many buildings for the square footage. In looking at the site plan what I observe is that clearly the square footage of the lot is not only too small to gracefully accommodate such large footprints of five buildings but, in fact it is Seven buildings since the frontage on Main Road juts out into three buildings creating a second floor for three housing units. This is seven uses not five. This means that also the parking area has to have enough spaces which results in a large area being covered by tarmac when there is a town public parking lot just steps away for visitors. The result of the buildings and the parking means that a large area, which once acted as a wildlife corrider, is now almost completely covered in buildings and tarmac. The rules are made to ensure that development is done responsibly and carefully in Southold Town. There has always been an attitude of"Protect what's left". We can't stop progress,we need affordable housing (although here I also question what does affordable mean—how much to rent a brand new independent house with an attached garage of considerable size-) but we need to be more modest in approach. Keep more green, make the houses smaller so they relate to the space they inhabit. Make the development be in scale-- not large buildings crammed into a small space. The developers knew the rules when they designed the project. Why would they assume that they could get a variance? Why not design it properly in the first place? We believe that the appeal should be denied. We apologize for the submission a day before the hearing, but please understand that we only became aware of the application, and this associated appeal, upon receipt of a letter from the applicants' agent dated June 24, 2020. We have owned our home in Southold for 12 years. We chose to buy our house, and to invest substantial amounts in its renovation, with the recognition that there was a vacant, commercially zoned property next door. We knew that the combination of the town's zoning and parking requirements, coupled with the practical and environmental constraints of the parcel's terrain, would govern what someone could reasonably do with the southern—75% of the property. We object to the concept of a `rounding error'justification. The applicants are sophisticated developers, and the dimensions of the parcel haven't changed. The parcel in question was for sale, off and on, for more than a decade. The implications of the plot's shape, and of its being under 100,000 square feet, were there for all potential buyers, including the applicants, to consider. The formulaic impact on commercial buildings was clear (though now under appeal here), as was its impact on the potential to subdivide a portion of the property into 20,000 sq ft residential lots. While the applicants' purchase price shouldn't drive zoning decisions, the practical reality is that the applicants were able to acquire the subject lot for a fraction of the previous owner's original asking price as a result of the transparent restrictions on its utility. Development density clearly matters. In this particular part of Southold, we'll draw your attention to the common space that was required long ago when the homes in our homeowners' association were developed. In our view, the appeal should be denied simply on the basis that the lot size requirements should be enforced as written. However, we'd also like to draw your attention to two statements made by the plicants in their appeal which we believe need to be confronted head on. A) The applicants assert that"The scale and scope of the proposed structures are in keeping with the surrounding neighborhood". This may well be true about the proposed building on Main Road, but it is not at all true about the houses proposed along Wells avenue. With proposed spacing of 25 feet between the homes, these will represent a cluster unlike anything else south of Main Road on Wells Avenue or the roads into which it connects. B) The applicants assert that they cannot comply with zoning requirements because "elimination of one building would render the project unfeasible", but have not provided any projections to support this assertion. While we have no doubt that the project would potentially be more profitable with four houses instead of three, we do not believe it is anything resembling a straightforward assertion that the project would be uneconomic with one fewer structure. While not a real estate developer, I (Richard) am a professional in the financial services industry, and have educational background in both financial valuation and project development economics. I am very well acquainted with the present value and rate-of-return concepts that presumably would underlie such an assertion. It seems highly improbable that the marginal rental rate on a fourth house would be sufficient, after accounting for the cost of building that fourth house, to turn an otherwise uneconomic project into an economic one. While we do not believe that the committee should get beyond the density impact, if you choose to consider the economic argument, we believe that you should insist on a proper set of comparative financial projections and analysis, to assess the merits of this assertion. These should be part of the public filing if this is a basis for the appeal. The applicants should have no commercial concerns about these projections being in the public domain, since they control the property and there is no equivalent property nearby on which one could build a competing project (and, as an aside, if the economics were that good, three houses would work just fine for them....). Please keep in mind that the price paid by the applicants for the land should not function into any economic calculus. This is a sunk cost on the part of the applicants, and the risk they chose to take in buying a lot everyone knew was oddly sized at a big discount to the previous owner's asking price history. "We won't build anything if you don't let us build everything we want" is not the basis for a zoning variance. One additional comment, since we don't know the format of the zoom hearing: please don't give any credence to any assertion that the applicants have turned over every stone looking for an alternative. The first we have seen of this plan was the June 24 letter received in advance of this hearing. At no point previously have the applicants communicated with us. If we had a non-compliant project proposal, and in good faith wanted to look for alternatives other than just pushing forward our original plan, we would have at least reached out to the neighbors. Perhaps one might have found some mutually beneficial use of the southern portion of the lot, or a path to jointly protecting a portion thereof(in a town with many protected spaces). The lack of outreach appears to us consistent with the tone of the appeal. I understand that a variance is being requested because the property is slightly smaller in square footage than the code requires for five structures. But the code is there for a reason, and every variance that comes before the ZBA is asking that a little piece of that code be overlooked. If that lot is too small for five structures, and the owner and architect always knew it was, they should have designed it for four rather than five. But instead they figured it wouldn't be that hard to get a variance, because "overbuilding" is the new game in town and everyone is playing it. The overall consequence, which is painfully noticeable, is that Southold is rapidly turning into the suburban sprawl that is typical of the rest of Long Island. It is starting to look like Anywhere USA, not the town I fell in love with decades ago. My property is roughly 1.35 acres and is certified as a wildlife habitat by the National Wildlife Federation. We slowly and arduously worked over the years to pull invasive plants that were strangling our majestic native trees, and established only native vegetation to attract rabbits, cardinals, osprey, frogs and turtles. Our property is a crucial green belt (perhaps the only one) in Southold village that provides a corridor to the bay and a refuge for wildlife. Within the past year, a new house was built next door, advertising itself as being in a "nature preserve setting" (referring to our property, not the property it sits on). That also required and was given a variance from the Zoning Board. (It is incredulous to me that in 2020 in Southold a new construction is not required to use any green energy, not even install an eco-friendly septic system.)This enormous house was built using every allowable inch of the small lot it sits on, and resulted in all the native trees on the lot being cut down, toxic chemicals used to create a perfect green lawn, and the paving of our private gravel road, so that the run off from the tarmac leads to the flooding of our unpaved driveway and pollutes our pond. I mention this new construction because with it, Hard Corners becomes even more essential as an access route for the town's remaining wildlife to reach our safe haven. For that reason, the number of houses built on the property and the amount of paved parking areas associated with those houses and the commercial structure are a huge environmental concern. Before becoming Supervisor, Scott Russell as the Town Assessor told me he was committed to Southold Town buying Hard Corners and keeping it as the village's remaining green zone. Instead it is now being developed for mixed commercial and residential use. There are already three empty commercial spaces for rent on Main Road between Youngs Avenue and Wells Avenue, and at least four to five more empty storefronts in Feather Hill. When I mentioned to the developer of Hard Corners that much of Feather Hill is for rent, so there doesn't seem to be a big demand for more retail space, he essentially told me that he is the one who built that shopping mall and sold it, so now whether it is in use or lies empty isn't his problem. I am all in favor of Southold providing affordable housing—if in fact these four houses will be affordable, which is questionable from viewing the site plans-- but rather than "under build" which urgently needs to become the new mantra for Southold town in order to retain its' historic character, again the ZBA is considering another request to "overbuild".There is a price far beyond money for each of these approvals by the ZBA, and it,will be too late when you look around, see what Southold has become and realize that price was way too high. The"developer" (sic) left only the invasive Norway Maples. These weed trees are banned from sale in Suffolk County and much of the-USA. Next a McMansion was built on a lot down the shared Private Road. They too cut down the Eastern Red Cedars,cleared the brush and put down sod dependent on irrigation and toxic lawn chemicals. The house sold for 1.3 million yet the realtor/developer told me he,did not put in a modern septic system because he was not YET required by law. (BTW-these systems add less than$5,000 to,a build.), Such a system would diffuse the nitrates this lawn and no doubt the chemicals used in the house will generate,leaking poison into our fragile water table. The questions to consider when granting a building variance are multiple. A) If this project is given a variance, will each bigger and bigger variance be granted? B) With so much empty commercial space in Southold-will we have even more empty space? C) Why not build 3 homes,or a set of-townhouses that will allow for-more green space? D) Will solar or geothermal be required on new,construction? E) Will only native trees and bushes be used in landscaping? We have planted native bushes and trees and even during droughts they thrive.The birds, rabbits and other wildlife thrive here. They too are part of our cultural heritage. F) The town of Riverhead has just declared a water emergency. Irrigation of lawns wastes precious water. It is only a matter of time until Southold must do the same. To reiterate the reasons for our request for a 0.8% relief from Article X, 280-46 requiring"20,00 s.f. of property per building" (as per the letter of denial from the Building Department) as follows: The character of the surrounding neighborhoods is, in our opinion , maintained in that as a property designated `HB', we have located the mixed-use building on the Main Road, in proximity to other commercial and mixed-use structures. We have placed the four `over 55' residential units in proximity to the surrounding residential structures and in a density that resembles other nearby residential developments in `HB and `R-40' zones. We feel it is unrealistic to compare the proposed density of this property to properties to the south and west (zoned `R-40')which are farther removed from the commercial uses on the Main Road. It is not feasible to reduce the number of buildings proposed without creating larger structures that would be out of character with the surrounding residential neighborhood. As mentioned above, the amount of relief requested is minor, only 0.8% of the lot area. We believe the benefit to the Town clearly outweighs the amount of relief requested. My property is directly south and west at 890 Wells Ave(SCTM 1000-63.-7-9). On 6/26/20, 1 received an 11 x 17,single page site plan dated 1/15/2020 mailed by Robert Brown Architect's office.Subsequently, I have had the opportunity to review it,access the town property records and evaluate the impact of the proposed development on the surrounding neighborhood. As I understand the plans,the development will include a new two-story mixed-use building housing(3)commercial spaces and (3)affordable apartments fronting on Main Rd.with a 30-car parking lot in the rear. Further south on the same property there will be(4) 55-and-over,one story,single-family residences'each with their own driveway. It is my position that the proposed development,commissioned by Hard Corners Properties LLC,will produce an undesirable impact on and change to the character of the adjoining neighborhood.The(4)55 and older homes planned for the south end of the property are spaced 25 feet apart and will be inconsistent with most of the surrounding lots in the neighborhood. Currently the neighborhood homes sit on 1/2 acre or more lots(Zoned R-40) and have much greater separation between them. The applicants could have located three single family homes on the 99,208-sf property, spaced further apart,thus avoiding the need to appeal to the Zoning Board.The decision to add the fourth single family home is both substantial and self-created and it impacts the characterof the neighborhood,This increase in density will depreciate the value and desirability of the adjoining properties and the neighborhood as a whole. I would also like to submit that granting this variance will have adverse effects on the following conditions in the neighborhood: Congestion:Authorizing five new curb cuts on Wells Avenue along the 660 feet west property line will only add to the already busy traffic in and out of the neighborhood.As it stands now,there is barely enough room along Wells Ave.for two cars to pass. Due to the current pandemic and summer season we are seeing more walkers, runners and bikers, exacerbating this congestion even more. Traffic: Even before the proposed addition of a 30-space parking lot and 4 driveways,,the intersection of Wells Ave and Main Rd posed a significant traffic and safety concern.Two entrances from Feather Hill, Michelangelo's customers pulling in and out, Bank of America patrons stopping for the ATM and the Hampton Jitney stop all make this intersection exceedingly difficult to navigate. There must be some consideration to how the extra volume will impact traffic and flow at this intersection. Safety:At the south end and west side of the proposed development there is a dangerous "S"curve on Wells Avenue.This curve often has cars swerving to avoid each other. Placing 4 driveways aalong Wells Avenue will pose a significant safety issue when cars pull out of the new residences as a vehicle is approaching the curve traveling north. Environmental:The current 2.25-acre wooded property offers one of the last unbuilt lots along Main Road in downtown Southold. This property serves as a noise buffer and an important swale,collecting the stormwater runoff for the surrounding areas. The proposed regrading of the property(see page Al)will require a significant amount of fill be brought,on to the property and will result in directing the.runoff towards Wells Ave and the surrounding properties. Economic:Adding more,commercial retail space to downtown Southold will also adversely affect the surrounding businesses. Feather Hill consistently has retail space available and the recently built Einstein Square is sitting empty; raising the question of why would we approve more commercial space along Main Rd.? There has been a steady turnover among the commercial spaces in Feather Hill,it seems likely the addition of more commercial units on Main Rd.will increase this turnover and result in more empty store fronts.
