Main Road, Mattituck Town of Southold, New York
Dear Supervisor Russell and Town Board Members,
The Orient Association (OA) is a civic group that focuses on issues of sig-
nificance to Orient and the broader Southold community. While working on
the Southold Comprehensive Plan, over 80% of Orient residents endorsed
open space provisions as part of community character.
The OA is aware that the Town Board is now considering adoption of deter-
minations and findings of public benefit regarding the property located at
12500 Main Road, Mattituck. While our primary focus is on issues pertain-
ing to the Orient community, from time to time, matters of town wide signifi-
cance come to our attention.
In considering necessary actions to pursue acquisition of the above noted
parcel at this hearing, the OA would like to draw your Board's attention to
an important Community Character goal (5) of the new Southold Compre-
hensive Plan as recommended by the Planning Board:
Mattituck/Laurel B. Target area (located south of State Route 25 and
east of New Suffolk Avenue) to create a village green/ park for com-
munity events.
This policy, past actions by the Town and communications from community
organizations and others provides important information in your Board's de-
termination and findings that the acquisition of a parcel in the Target area
would be for a public benefit and use, that its location best serves the com-
munity and that it would have a beneficial impact on the environment and
residents of the Mattituck-Laurel community.
We believe that the Town Board does have adequate information to deter-
mine that a parcel in the Target area to be used as a village green and park
for community events will serve an important public purpose and benefit.
The OA would also like to state that it is aware of a pending development
proposal for the parcel that is the subject of this hearing and takes no posi-
tion on this proposal.

Although I do not want the hardware complex on that site,-I do not think the town should invoke Eminent
Domain. There must be a better way for the town and the brinkman's to find a way to maintain the green space
and for Brinkman's to do their business somewhere more appropriate. Shared values for the community should

will polarize the community at a time when we need to work together more.

If the town wanted a park here, there was ample opportunity to purchase the tract in the past. The town's failure
to act has created this 'crisis', and with eminent domain, the town is trying to undo its error of inaction at the
11th hour. It's like trying to purchase insurance with a back-dated contract to cover a loss that has already
occured. If a citizen did that it would be called fraud. I like the trees too, but the property at New Suffolk Ave.
was appropriately purchased and property rights and ownership should remain intact. If the town board knows
of other parcels like this one, where there 'just has to be a park', I encourage you to act now,before a new crisis
forces additional strong-arm behavior in the future.

I find it hard to comprehend that the Town Board is still considering invoking eminent domain for the property in
Mattituck on rt. 25. This is a slippery slope for the town.That piece of-land-would-be harrible fora park,that corner is
way too busy. The reason for eminent domain is for an important public need.Transportation projects like roads,
railroad's and bridges. Government buildings, structures related to the water supply, like aquifers. EXPANSION OF PUBLIC
AND NATIONAL PARKS.A park there.....Who is kidding who? They should, and must,find an alternate to this ill-
conceived idea.

am a Southold town resident for over 30 years an hearing about_ this proposed eminent domain
action is very alarming to me. �Nc one=or=no town should-have the power to take anyone property
from them just because they do not like what the person or persons are planning on building.lf you do
this you are opening Pandora's box nothing could stop the further attack on private property. I am not
saying that I want what they are proposing to be built in my town, but a compromise could be made;
cutting the size of the building(s) in half and/or only permitting one building. We do not need nor want
a huge eye sore along our little country road. Not to mention the impact on the traffic at the New
Suffolk intersection that is already an issue. Perhaps if you do permit them to move forward with
some compromises they could pay for the improved traffic infrastructure such as a traffic circle.

The Town of;Southold kas'rio right to this extreme action. There are many rational reasons the
application of eminent domain should not to be considered. The long term tax consequences to the

their project are just a few.
Many years ago it was told to me by a life long resident, "This town is run like a small Central American
government..." If this seizure is allowed to happen here, his observation will truly be fact.

I am againsftlie=Town Board's-attempt;Wo take the Brinkmann"property by'eminent.domain. If,the town wanted to
prevent development of that piece of property they should have bought it or changed the zoning. This is clearly a taking
of a landowners property rights, I would be the first to say we do'not need a hardware store on that corner but that is
not the'point,the property is zoned for that type of use. The Brinkmann's are not asking for a zoning change, a variance,
or anything else they'ar'eJust asking to be treated fairly according to the town building codes!!!! 1 urge the Town Board

Good afternoon, my name is Paige Romanowski and I am a resident of Mattituck, New York and a small business owner.
The town's plan to seize the Brinkman property via "eminent domain" for the purpose of building a park for the
residents of Mattituck makes no sense.Since when was there an overwhelming deafening cry for yet another park in our
town?How does the town plan to build a park on a corner that was supposedly problematic for any kind of
development due to traffic concerns? I would like to know how much money it's going to cost tax payer dollars to build
such a park.We need sidewalks,we need pedestrian crossways, we need appropriate lighting, we need parking etc.
What the town is proposing is expensive and I know this fact very well because I am in the business of asphalt and
street/parking lot maintenance.This does not seem like a well formulated plan...Again let me reiterate that building a
park is not something our town has been crying and begging for for years but yet it's important enough to take away a
family's property?!The north fork continues to be overwhelmed by growing swarms of people year after year from all
over looking to vacation and enjoy our beaches and our vineyards and our restaurants and bars etc.The current
infrastructure that exists is not enough to accommodate the enormous amount of people coming out here season after
season.A park is not what our town needs and not where our taxpayer dollars should be spent. But more importantly
the seizure of this property strikes me as un-American and just flat out wrong. In doing so, I strongly believe this sets a
very dangerous precedent moving forward for the future of our community in terms of growth and commerce.
Regardless of what the Brinkman family intends to do with the commercially zoned property the seizure of their
property without true cause is wrong on every level.
It's important that you know that I am a registered Republican and for the history of my life I have always voted in favor
of my party. Until as of recently for the first time in my life I voted Democrat across-the-board when Scott Russell was up
for reelection. A lot of young, hungry entrepreneurs that are striving to be successful here on the north fork have similar
feelings of frustration, outrage and disgust towards the leadership governing the township of Southold.
I strongly oppose this action of eminent domain against the Brinkmann Family.

Open Letter to the Town Board,
I am writingthis_letter in firm-opbbsition to Southold-Town taking the Brinkmann( or any other.property_for
that-matter)by Eminent bonia—in. I am do adjoining-property owner with a similarly zoned property (HB) albeit
a bit larger than the Brinkmann property.
I am not against this action because of the possible negative consequences to my property, or any subsequent
application tendered on it, although I do feel that this dangerous precedent will irreparably tarnish the future
prospects for my land. Moreover, I am against taking of any property against the will of a landowner,
specifically in reaction to an application for development under the present zoning.
My greatest hope is that while it seems that this effort is to "save "the comer , what you are sacrificing in return
- confidence in our government to "do the right thing" for the right reasons will forever alter property rights on
the North Fork.
I see your votes on August 11 as a vote for integrity in our Government, and I don't believe that this vote should
be help in a closed or Zoom session. We should all have the right to be present and express our views.
