TERMS.AND CONDITIONS The Permittee Ayda Candan,residing at 55955 CR 48, Greenport, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work-shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Moore,'Esq`:;'-on behalf'of AYDA CANDAN applied to the Southold Town Trustees for a permit under the provisions-of Chapter 275 of the Southold Town Code,the - - -,Wetland Ordinance of the Town of Soutfiord;and-Chapter T11=of-the Southold-Town-Cotte;------" -- Coastal Erosion Hazard Areas, application dated December 5, 2019, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policies 4 and 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures and the removal of the stairs from the neighboring property line; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on . We are all in agreement that the existing house and portion of the deck which is below the cantilevered second floor pre-dates the Trustees Wetland Ordinance and Coastal Erosion Permit. At the last public hearing the Board was prepared to approve a permit for the existing structures in order to allow my client to obtain the building permit to make the needed repairs to the existing structure. The structural repairs are urgently needed. 2. The Board,based on neighbor's photos,believes that the existing 20.2' x 19'deck which has been in place for the last 20 years does not predate the Coastal Erosion Law. However, the Coastal Erosion Law does allow a "minor structure" which is a structure that is no more than 200 sq.ft . The Caridans would like to reduce the existing deck to 20' x 10 (200 sq.ft.). Candan Purchased 1-14-1972 (2 story house as it exists today) Deed description runs 103' & 107from the Middle Road to the ordinary high water mark of the Long Island Sound(see Deed attached as Exhibit 1) History of improvements: All existing structures and improvements pre-date Trustees and CEHLaw. LAW: Coastal Ersosion Hazard Law was enacted in 1991. The house, deck and improvements to the property pre-date Coastal Erosion Hazard Law. Town of Southold Coastal Erosion Hazard Area Law(Capter 111) defines "Normal Maintenance as "Periodic replacement or repair of same-kind structural elements or protective coatings which do not change the size, design or function of a functioning structure. A "functioning structure" is one which is fully performing as originally designed at the time that normal maintenance is scheduled to begin. "Normal maintenance" of a structure does not require a coastal erosion management permit. Chapter 34 of Environmental Conservation Law(Coastal Erosion Law) states that normal maintenance of structures are unregulated activities. State Law defines "Normal Maintenance" as the periodic replacement or repair of same-kind components or protective coatings which do not change the size, design, or function of a structure(for example, shingle, siding, or window replacements or painting). Candan has requested repairs to the existing structural supports. This work is required in order to obtain a building permit for any work to the house made after 1957. The house was constructed prior to zoning(Pre-CO application pending)however, we are waiting for the Trustees permits in order to get a building permit for improvements made after 1957. A Sea Wall existed in front of the bulkhead prior to 1971 (see Exhibit 2-VanTuyl Survey 12/9/71 survey) s, Footprint of 2 story house: The existing house is shown on the 12%9/7 f survey prepared by VanTuyl....the footprint of the house is unchanged. The survey shows"patio (porch over)"on the seaward side of r - I house. As is today,part of the original deck is covered by 2nd floor and there is a cement patio on the first floor. (VanTuyl amended the survey in 1994 showing only the bulkhead for the purposes of the NYSDEC permit) Front Porch: The front porch entrance has not changed since the house was purchased in 1972. The entrance was always a porch. In 1973 Storm windows were added to the screens for a 3 seasons room. In 1973 the house was re-shingled(wood siding), walkways and retaining walls were repaired. (See Exhibit 3-Contractor's Receipt) Waterfront deck: In 1973 the "red wood deck with 36" high railings and stairs"was constructed/reconstructed(See Exhibit 2-Contractor's Receipt&Exhibit 4-picture showing the deck with the original sea wall which is currently behind the bulkhead). Existing Bulkhead: In 1994 the bulkhead was constructed in front of the existing cement wall (storm damage) Trustees permit dated 1/4/94 and NYSDEC permit#4738-00852 was issued Building Department: An application for a pre-co was filed by Patricia Moore in 2014 and after the inspection the building department requested a building permit for any work done after 1957 and the following was requested by the building department: carbon/smoke detectors (installed) handrails(installed) electrical inspection(done 4-17-14) survey(done) engineer's letter- structural integrity of deck needed. Trustee's permit is needed to add the structural supports to the deck. As soon as the Trustee's permit is issued we can make the structural repairs to the deck footings The application for the Trustee's Wetland Permit and Coastal Erosion Hazard permit is pending (hearing in January).
