Box 2124 Greenport, NY 11944 RE: CLAUDIA,PURITA 19995 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-51-4-6 Dear Mr. Costello: The following action was taken by the Southold Town Board of'Trustees at their Regular Meeting held on Wednesday, October 28, 2020: WHEREAS, Costello Marine Contracting Corp., on behalf of CLAUDIA PURITA applied to the Southold Town Trustees for an Amendment to Wetland Permit#9276 and Coastal Erosion Permit#9276C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 25, 2019, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to construct a revised stairway and walkway consisting of a 4' wide terraced walkway from top of bluff towards top retaining wall; construct 3' wide by 14'2" long stairs off top retaining wall to area between two retaining walls; construct a 5'x4' cantilevered platform with 3' wide by 14'2" long set of steps to area in between lower retaining wall and bulkhead; construct a 5'x4' cantilevered platform off bulkhead with 3'x9'2" seasonal aluminum stairway to beach; and to revegetate bank with native plantings be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, z WHEREAS, the LWRP Coordinator issued a recommendation that the application to allow for the "as-built" installation of 1.5 to 3 ton rock armoring in front of the newly constructed bulkhead, ±1,260 cubic foot (60.5 tons) of rock to be placed below spring high water level; as-built two 11 foot high concrete terracing block retaining walls in lieu of the previously approved 5 foot high retaining walls on face of bluff; install a pervious gravel splash curtain landward of bulkhead be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit , and WHEREAS, the structure complies with the standards set forth in Chapter 275 of the - Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit#9276 and Coastal Erosion Permit#9276C to modify "as built" structure by removing one 2'x4' row and one 4'x4' row of concrete block from each of the two existing retaining walls, reducing the height of the walls 6-feet. The remaining concrete retaining wall not to exceed 5' above,grade. Construct a new third retaining wall at top of bluff reusing one 2'x4' and one 4'x4' concrete block. This third retaining wall will have a 2' exposure above grade. Create a 12" high berm. Regrade bank, creating an approximate 40-degree slope. Allow gravel splash curtain landward of bulkhead. Allow for the installation of 1.5 to 34on rock armoring in front of bulkhead. Rebuild stairway down bank and install a 4'x5' aluminum platform and 3' aluminum stairway from bulkhead to beach. Install as needed on Pluff face (slope area) Place and pin biodegradable geo fabric textile on grade in grass planting areas that exceed 40 Degree slope.lnstall staked 1"x 12" untreated pine boards and or 8" to 12" 3 staked Coir logs 12" to 30" on center to create stepped terraces on bluff face between lower retaining wall to New proposed upper retaining wall. 5. 12" high berm landward of upper proposed new retaining wall Plant Switch grass, Little Blue stem and or American Beach Grass 12" on center on entire berm area; and as depicted on the site plan prepared by Costello Marine Contracting Corp., received on October 13, 2020, and stamped'approved on October 28, 2020. On a scale of 1 to 10,I originally evaluated the property at a 6 to 7 in terms of erosion. However, after a series of storm events,my evaluation of the seriousness increased considerably after the collapse of the bulkhead and degree of fill lost. It then became a 9 to 10 on the scale of j eopardizing the upper retaining wall and possibly the house(home). Large Liability Another item used in the evaluation of the situation was liability involved. We took into account such questions as: • Will the continued erosion cause additional damage to the adjacent neighboring properties? - Our answer was yes,their structural integrity was being jeopardized. • Is the degree of debris entering the Sound minor or significant? - It was certainly approaching significant;hopefully not causing an accident. • What is the degree of loss fill? - The degree of fill and materials lost was in excess of 1,000 cubic yards. After the total collapse,the loss was possibly up to as much as 2,000 cubic yards entering the Sound. • What is happening to the costs to replace the structure? - The angle of repose on the cliff face was approaching considerably more than a 45- degree angle and the costs were accelerating as additional material was lost. IQ ® °o 0 0 0 Town of Southold,p.2 12/10/19 One of the variables that confronted our decision was the time it takes to obtain all the required permits allowing us to proceed. The only permitting that was reasonable to obtain were the emergency permits from the Town of Southold Trustees and the New York State Department of Environmental Conservation(NYSDEC). The second major variable considered was the availability and obtainment of the materials. Steel would require time for the treatment and coating to obtain a 30 year construction life. The costs of the steel and the longer time to obtain it changed our decision to using the heaviest vinyl material available. The cost of the vinyl is slightly lower; and it is more readily available vs.the steel. However,this also forced us to increase other costs such as requesting and installing a required Energy Dispersion Device(EDD -rocks). The next variable required in our decision making was how to properly access the jobsite with materials and equipment. We needed to install a small access roadway along the east side of the owner's property which required moving a shed/building out of the way. Then we installed filter cloth and an RCA blend to allow small trucks and equipment to access the site.' With the continual loss of fill and the increased angle of repose, access with major equipment over the bluff was abandoned. A barge must be used as the tides will allow. We made daily adjustments to obtain the answers to the aforementioned questions while considering the variables involved. We also enlisted as much advice from a qualified structural engineer who insisted that without logically developing a practical"angle of repose",loss of additional fill would increase. Given that the angle was more than 45-degrees pre-existing and was now approaching 60-degrees or more,the engineer concluded and advised that unless the angle was less than 30-degree,and preferable 26-degrees,the stability of the entire cliff face would be in j eopardy. He recommended elevating the terracing from 5' to approximately 10' using"Doublewal"concrete system to obtain the allowable angle of repose. He stated he had used the system in the past. All decisions were being made on a daily basis and involved substantial costs. Our company was and is being forced into a position of financing a major part of the project. Presently,upon the conclusion of the entire project,we will assist in any recommendation of revegetation to soften the look of the concrete structure. Vegetation recommended include Cape American beach grass,Rosa rugosa,phragmites and,in particular,Boston Ivy which will adhere to the concrete face. My analysis focused on a comparison between the original final design dated July 30, 2018 and the as-built design dated October 7, 2019. This original design was approved and permitted in August of 2018 by all required agencies. The majority of the construction work was accomplished in 2019. My findings from the comparison of the designs include three major areas. My assessment of the areas is: 1 —Bulkhead at Water Line—The original design called for 95 feet of sheet steel sheeting with wood piling and framing to be installed to elevation 10.5', matching the height of the adjacent bulkhead to the west. The as-built design calls for 95 feet of heavy duty vinyl sheeting with wood piling and framing to be installed to elevation 10.5'. For additional strength and protection the as-built design calls for precast concrete blocking behind the sheeting and rock armoring in front of the sheeting. The as-built design is equal in size and structural strength to the original design. The as- built design (vinyl sheeting) has superior durability and maintenance characteristics to the original (steel sheeting). These improvements are from the materials resistance to deteriorating and decay from natural elements. To fiilly obtain the improvements additional face protection (rock armoring) is required for the vinyl sheeting bulkhead. The rock armoring installed was composed of 1.5 to 3 ton boulders which match the typical occurrence for this coastline. This additional protection is required to disperse the wave energy and meet the 30 year life cycle requirement for the bulkhead. The terraces had 5 foot face exposure and were constructed of heavy timber boxes with continuous back walls and tie anchors. The terraces were to be set 12.5 feet and 22.5 feet back from the waterfront bulkhead line. The terraces were to be backfilled modifying,the slope of the embankment. The resultant soil slope angles of the fill line were designed as follows: bulkhead to terrace 1 — 10 degrees; terrace 1 to terrace 2 26 degrees and terrace 2 to top of embankment—14 degrees. f i The as-built design calls for two rows of terracing with top elevations at 22.5' and 34.5 . The terraces had 10 foot face exposure and were constructed of precast concrete boxes that interlocked into a self-supporting structure. The terraces were to be set 12.0 feet and 30.0 feet back from the waterfront bulkhead line. Theiinterior of the precast boxes and terraces were to be backfilled modifying the slope of the embankment. The resultant soil slope angles of the fill line were designed as follows: bulkhead to terrace 1 — 10 degrees; terrace I to terrace 2—6 degrees and terrace 2 to top of embankment—26 degrees. i The as-built design terraces are made of precast structural concrete elements, not wood. The shape of the precast elements provides improved stability and soil retention. The resulting terrace wall; are self-supporting and put minimal stress on the underlying soil embankment. These precast concrete elements have superior durability and main compared to the original wood design. On a scale of 1 to 10,I originally evaluated the property at a 6 to 7 in terms of erosion. However, after a series of storm events,my evaluation of the seriousness increased considerably after the collapse of the bulkhead and degree of fill lost. It then became a 9 to 10 on the scale of jeopardizing the upper retaining wall and possibly the house(home). Large Liability Another item used in the evaluation of the situation was liability involved. We took into account such questions as: e Will the continued erosion cause additional damage to the adjacent neighboring properties? - Our answer was yes,their structural integrity was being jeopardized. e Is the degree of debris entering the Sound minor or significant? - It was certainly approaching significant;hopefully not causing an accident. e What is the degree of loss fill? - The degree of fill and materials lost was in excess of 1,000 cubic yards. After the total collapse,the loss was possibly up to as much as 2,000 cubic yards entering the Sound. e What is happening to the costs to replace the structure? The angle of repose on the cliff face was approaching considerably more than a 45- degree angle and the costs were accelerating as additional material was lost. • : e ee , � a off e ' e e Mrs— Town of Southold,P.2 12/10/19 One of the variables that confronted our decision was the time it takes to obtain all the required permits allowing us to proceed. The only permitting that was reasonable to obtain were the emergency permits from the Town of Southold Trustees and the New York State Department of Environmental Conservation(NYSDEC). The second major variable considered was the availability and obtainment of the materials. Steel would require time for the treatment and coating to obtain a 30-year construction life. The costs of the steel and the longer time to obtain it changed our decision to using the heaviest vinyl material available. The cost of the vinyl is slightly lower; and it is more readily available vs. the steel. However,this also forced us to increase other costs such as requesting and installing a required Energy Dispersion Device (EDD -rocks). The next variable required in our decision making was how to properly access the jobsite with materials and equipment. We needed to install a small access roadway along the east side of the owner's property which required moving a shedibuilding out of the way. Then we installed filter cloth and an RCA blend to allow small trucks and equipment to access the site. With the continual loss of fill and the increased angle of repose, access with major equipment over the bluff was abandoned. A barge must be used as the tides will allow. We made daily adjustments to obtain the answers to the aforementioned questions while considering the variables involved. We also enlisted as much advice from a qualified structural engineer who insisted that without logically developing a practical"angle of repose", loss of additional fill would increase. Given that the angle was more than 45-degrees pre-existing and was now approaching 60-degrees or more,the engineer concluded and advised that unless the angle was less than 30-degree, and preferable 26-degrees,the stability of the entire cliff face would be in jeopardy. He recommended elevating the terracing from 5' to approximately 10' using"Doublewal"concrete system to obtain the allowable angle of repose. He stated he had used the system in the past. All decisions were being made on a daily basis and involved substantial costs. Our company was and is being forced into a position of financing a major part of the project. Presently,upon the conclusion of the entire project,we will assist in any recommendation of revegetation to soften the look of the concrete structure. Vegetation recommended include Cape American beach grass, Rosa rugosa,phragmites and, in particular,Boston Ivy which will adhere to the concrete face. My analysis focused,on a comparison between the original final design dated July 30, 2018 and the as-built design dated October 7, 2019. This original design was approved and permitted in August of 2018 by all required agencies. The majority of the construction work was accomplished in 2019. My findings from the comparison of the designs include three major areas. My assessment of the areas is: 1 —Bulkhead at Water Line—The original design called for 95 feet of sheet steel sheeting with wood piling and framing to be installed to elevation 10.5',matching the height of the adjacent bulkhead to the west. The as-built design calls for 95 feet of heavy duty vinyl sheeting with wood piling and framing to be installed to elevation 10.5'. For additional strength and protection the as-built design calls for precast concrete blocking behind the sheeting and rock armoring in front of the sheeting. The as-built design is equal in size and structural strength to the original design. The as- built design(vinyl sheeting) has superior durability and maintenance characteristics to the original (steel sheeting). These improvements are from the materials resistance to deteriorating and decay from natural elements. To fully obtain the improvements additional face protection (rock armoring) is required for the vinyl sheeting bulkhead. The rock armoring installed was composed of 1.5 to 3 ton boulders which match the typical occurrence for this coastline. This additional protection is required to disperse the wave energy and meet the 30 year life cycle requirement for the bulkhead. E C E VE 0 EC 1 1 2019 Southold Town Board of Tris 2—Terracing - The original design called for two rows of terracing with top elevations at 20.0' and 25.0'. The terraces had 5 foot face exposure and were constructed of heavy timber boxes with continuous back walls and tie anchors. The terraces were to be set 12.5 feet and 22.5 feet back from the waterfront bulkhead line. The terraces were to be backfilled modifying the slope of the embankment. The resultant soil slope angles of the fill line were designed as follows: bulkhead to terrace 1 — 10 degrees; terrace 1 to terrace 2—26 degrees and terrace 2 to top of embankment—34 degrees. The as-built design calls for two rows of terracing with top elevations at 22.5' and 34.5'. The terraces had 10 foot face exposure and were constructed of precast concrete boxes that interlocked into a self-supporting structure. The terraces were to be set 12.0 feet and 30.0 feet back from the waterfront bulkhead line. The interior of the precast boxes and terraces were to be backfilled modifying the slope of the embankment. The resultant soil slope angles of the fill line were designed as follows: bulkhead to terrace 1 — 10 degrees; terrace 1 to terrace 2—6 degrees and terrace 2 to top of embankment—26 degrees. The as-built design terraces are made of precast structural concrete elements, not wood. The shape of the precast elements provides improved stability and soil retention. The resulting terrace walls are self-supporting and put minimal stress on the underlying soil embankment. These precast concrete elements have superior durability and maintenance characteristics compared to the original wood design. These improvements are from the materials increased structural capabilities,resistance to deteriorating and reduction in routine maintenance needs. These upgraded concrete elements are superior to wood timbers when considering the 30 year life cycle requirement for the wall system. 3 —Embankment Stability—The major problem to this area of coastline is the height of the embankments causing the underlying soils to be near the limit of their angle of repose. In other words,the land height coupled with the shoreline erosion from wave action creates angles on the hill that destabilize the underlying soils. When this happens the soil cannot stay in place and large"envelopes" of soil slip along a failure plane and slide downhill. The only way to economically solve this problem is to reduce the embankment angles by with bulkheads at the shoreline and terracing the embankment. To fully obtain the benefits from the as-built terrace material improvements taller face exposures and increased horizontal spacing from the bulkhead line were used. The resultant embankment soil angles were greatly reduced improving the long term stability of the entire system. The reduction of the soil angle of repose from 34 degrees to 26 degrees improves the retaining systems ability to meet the 30 year life cycle requirement. D EC EE VE DEC 1 1 2019 Southo;d Town Board of Trustees Summary of the Engineering Review: Bulkhead- The as-built design is equal in size and structural strength to the original design. The as-built design has superior durability and maintenance characteristics to the original design. Terracing—Both the original and as-built designs used two terraces. The overall length is the same for both. For the as-built the face exposure is greater(10 feet vs. 5 feet) and the horizontal position was changed. To optimize the efficiency of the as-built design these factors were changed to improve the slope stability and support the 30 year life cycle requirement. The as-built design does have superior durability and maintenance characteristics when compared to the original design. Exposure -As a trade off to the greatly improved slope stability and life cycle performance the as-built design does have an increased face exposure. By design,the Double Wall product considers this potential issue. The product is design to support natural plantings. Grasses, shrubs and trees can all be used in the terrace areas and on top of the walls to alter the esthetic appearance is desired. Slope Angle—The resultant Soil Angle of Repose provided by the as-built design greatly improves the stability of the embankment. The soil angle of repose was reduced from 34 degrees, which is above the desired limit of 30 degrees,to 26 degrees. The use of this design provides an efficient and long term solution to the most critical problem that exists in the coastal area. This system will readily meet the criteria in the Southold Town 30- Year Maintenance Agreement for Erosion Protection Structures. The bluff staircase's integrity is compromised limiting the property owners'ability to access the water. Securing the toe of the bluff and providing the additional retaining walls will allow vegetation to root and stabilize the bluff from further slumping. Once the bluff is stabilized, the property owners will gain access.to the water and be able to resume their normal water-dependent activities such as kayaking.
