That if future operations of the Town of Southold require the,removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided'within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. Moore, Esq. on behalf of ROBERT & KELLY KRUDOP`applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 19, 2020, and, WHEREAS, said application was referred to-the Southold Town Conservation Advisory - Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing.was held by the Town Trustees with respect to said application on November'18, 2020 and December 21, 2020, at which time all interested - persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with.the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, -RESOLVED, that the Board of Trustees have-found the app.lication-to be,Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application-of ROBERT & KELLY KRUDOP to install 87 linear feet of deer fencing; plant a row of arborvitae; plant staggered row of cedar trees (@45') landward of bank; install and perpetually maintain a 10' wide non-turf buffer (cedar trees and gravel) along the landward edge of the top of the bank; remove one (1) 38" oak, one (1) 16" oak, and one (1) 18" oak; and install a proposed 8'x12' shed; with the condition that the deer fence is to be removed at the two (2) year expiration of the permit issuance and will be installed no less than 6" off the ground so that small animals can pass underneath it and preventing habitat -„ fragmentation; and as depicted on the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC, received on December 16, 2020, and stamped approved on December 21, 2020. I would appreciate it if you could enter my concern below into the record for the upcoming hearing scheduled this Wednesday, December 16, 2020. Namely the survey calls out Cedar Trees to be planted adjacent to the creek. For your consideration I am under the understanding that the trees will be True Cedar Trees and not Leyland Cypress which is a totally different genre. The True Cedar is a genus Cedrus which is what I assume his survey/plan is detailing. Cypress trees are very aggressive growers and I believe will grow out over the embankment of the creek and compromise my view of the waterway in a very short period of time. I defer to the Board to ensure my understanding of the planting is accurate. I am the adjoining property owner to the north and the proposed work directly affects my property. I would like to start out by stating I am all for property owners having specific rights relative to the use of their property if done in accordance with the laws of the municipality and also in accordance with respect for the environment and the character of the neighborhood. This application stretches the limit in certain respects that I will detail as follows: Please enter into the record of the Public Hearing the following comments: • I do not see a pending application with the NYDEC for this proposal. Will the Trustees grant approval without clearance from the DEC and can any construction begin without such approval? The pending application with the DEC for the previously proposed Wetlands Permit is still listed as incomplete. • The plans are not very clear on the type of fence proposed and its exact location. The term "estate fence" is quite vague. I think the Trustees should require more detail on the type and style of fencing proposed and make that available prior to making a decision. • 1 take issue with the proposed 6' foot vinyl fence to the north. First, I cannot tell from the survey the exact length along my property line. The term "estate fence" is also pointing at the same line of fencing. Currently there is an existing row of mature arborvitaes whose root balls are contained within my property boundary. These trees predate the Krudop purchase of the property and the building of their home. Granted the trees have grown and branches extend over the property line. I am very concerned that in order to install the proposed fence, cutting those trees back to far will kill them. Maybe the board could consider moving the proposed fence line to the south a few feet so the existing trees can survive. Also, I don't think vinyl fencing has any place in this neighborhood or the Town of Southold for that manner. Its installation would definitely devalue my property and be quite the eye sore. This is not Nassau County. I think there is more to the proposed location for vinyl than that shown. Why is it not proposed on the south side line of the property also? Perhaps a neutral color could be specified if vinyl is approved. The survey shows a line of fencing within 10 feet of the top of the bank. I did not think that close a proximity to the creek or embankment was allowed by code. • The survey calls out "deer fencing". There are no details provided. Is it the standard agricultural 8 foot high wire fence? I am under the understanding that if approved by the Trustees, a building permit would be required for this type of fence. I would encourage the board to question the installation of deer fencing on this property. The deer habitat has always included the heads of creeks. The random and incomplete proposal of the deer fence will only tend to corner and confuse them. I question the logic for this proposal. The Krudops do not have a garden to protect and they have grown children. There is no health and safety issue that can be adequately demonstrated. I strongly urge the board not to set a president in this neighborhood. • I defer to the board on the proposed location of the shed and the tree removals. I urge you to table this proposal so that the questions above can be addressed and the character of the neighborhood may be maintained. The plans lack detail on how this will be constructed and how the embankment will be restored.Will a construction easement and contractor insurance be required to remove and reinstall my dock and grade the embankment? • The application calls out the existing piles,dock,ramp and float to remain.It appears that the float with a vessel attached would exceed the 1/3 rule of Chapter 275-11,section C, part(b)Dock location and lengths[2] (Photo attached) • In my opening paragraphs I show my support for the intent of the property owners to protect their embankments.I also have to mention that the Trustees should be stewards of the environment and promote neighboring aesthetics.It is very disappointing that the Town would approve the proposed rip-rap armoring in a small residential creek.Even Strong's Marine just down the creek has installed environmentally friendly plantings and a low-sill bulkhead that meets the Town definition.This is not an area subjected to heavy wave action to justify rock armoring.The justification vegetation would not be effective because of active ducks and geese is interesting.Does that mean that the ducks and geese are more suited to walking over rip-rap?The existing embankments throughout the creek are heavily vegetated adding to the beauty of the creek.It would be of great detriment to the area to allow the armoring of any kind over vegetation.I'm sure the value of my home and view would be severely compromised if the proposed rip-rap is approved.This is a residential area,not a commercial marina or inlet subjected to heavy wave action or currents.
