Since the three owners abut this land and have pending wetland applications with the involved regulatory agencies we request that the applications pending with the Trustees be placed on hold until such time that the underwater land title issue is resolved. I would like to start out by stating I am all for property owners protecting their property from erosion if done in accordance with the laws of the municipality and also in accordance with respect for the environment and the character of the neighborhood.These pending applications do neither. Please enter into the record of the Public Hearing the following comments: • My understanding is that the only allowable shore stabilization is by a low-sill bulkhead. The Town's own definition in accordance with Chapter 275 is"A subtidal structure designed to stabilize the toe of a slope or shore and often associated with boat basins or other navigable waterways."The structure submitted will not be submerged during most tidal cycles due to its design elevation.Even your own LWRP has commented that this is of concern.Does this design set precedent? • The plans show 8 inch diameter piles projecting 4 feet above the top of the low-sill top plate.The piles are part of the low-sill structure and should be cut off flush to meet the definition in the previous comment.Is this to be considered a fence? • It is my understanding that a NYS DEC permits have been applied for but currently designated as incomplete.I trust that no construction is to take place without that approval. • Is a Suffolk County permit required as an adjacent landowner? • The current plans do not detail the proposed finish elevations of dredging that is to be utilized as backfill.The current erosion of the Krudop property in the area north of the existing rip-rap has compromised my dock.Also on the opposite side of the creek the Krudop property erosion has shallowed the channel.(SCTM# 1000-122-4-42)(Photo attached) • The Krudop plans show the low-sill bulkhead running under my existing dock catwalk. The plans lack detail on how this will be constructed and how the embankment will be restored.Will a construction easement and contractor insurance be required to remove and reinstall my dock and grade the embankment? • The application calls out the existing piles,dock,ramp and float to remain.It appears that the float with a vessel attached would exceed the 1/3 rule of Chapter 275-11,section C, part(b)Dock location and lengths[2] (Photo attached) • In my opening paragraphs I show my support for the intent of the property owners to protect their embankments.I also have to mention that the Trustees should be stewards of the environment and promote neighboring aesthetics.It is very disappointing that the Town would approve the proposed rip-rap armoring in a small residential creek.Even Strong's Marine just down the creek has installed environmentally friendly plantings and a low-sill bulkhead that meets the Town definition.This is not an area subjected to heavy wave action to justify rock armoring.The justification vegetation would not be effective because of active ducks and geese is interesting.Does that mean that the ducks and geese are more suited to walking over rip-rap?The existing embankments throughout the creek are heavily vegetated adding to the beauty of the creek.It would be of great detriment to the area to allow the armoring of any kind over vegetation.I'm sure the value of my home and view would be severely compromised if the proposed rip-rap is approved.This is a residential area,not a commercial marina or inlet subjected to heavy wave action or currents.
